P RESOLUTION NO. 92- 533 A RESOLUTION RELATED TO THE 16th ANNUAL BANYAN ARTS & CRAFTS FESTIVAL TO BE CONDUCTED BY THE COCONUT GROVE CHAMBER OF COMMERCE NOVEMBER 14-15, 1992; AUTHORIZING THE CLOSURE OF DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC AND ESTABLISHING A PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF PERMITS BY THE DEPARTMENTS OF POLICE AND FIRE, RESCUE AND INSPECTION SERVICES; AUTHORIZING A TWO-DAY PERMIT TO SELL BEER AND WINE IN CONNECTION WITH SAID EVENT SUBJECT TO THE ISSUANCE OF ALL PERMITS REQUIRED BY LAW; ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF SAID EVENT; CONDITIONING ALL APPROVALS AND AUTHORIZATIONS HEREIN UPON THE ORGANIZERS PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES AND FEES AND OBTAINING INSURANCE TO PROTECT THE CITY IN THE AMOUNT PRESCRIBED BY THE CITY MANAGER OR HIS DESIGNEE. WHEREAS, the Coconut Grove Chamber of Commerce will conduct the 16th Annual Banyan Arts & Crafts Festival on November 14-15, 1992; and WHEREAS, certain streets shall be closed to through vehicular traffic during specified dates and hours to insure the safety of the participants and pedestrians attending said event; and WHEREAS, the Coconut Grove Chamber of Commerce has requested permission to sell beer and wine for a two-day period in connection with the 16th Annual Banyan Arts & Crafts Festival on Saturday, November 14, 1992 and Sunday, November 15, 1992; and CITY COtdMISSION MEETUIG OF Resolution No. 92- 533 WHEREAS, the Coconut Grove Chamber of Commerce has requested that retail peddlers be prohibited within the specified area of the event for a specific period of time during the festival; and WHEREAS, the restriction imposed by Ordinance No. 10764 as to the limitation of the number of events in the Coconut Grove Special Events District does not apply to the Banyan Festival since this event has been held in the past in the Coconut Grove area; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. In order to effectuate safe passage and establish a temporary pedestrian mall during the 16th Annual BanyanArts & Crafts Festival, to be conducted by the Coconut Grove Chamber of Commerce, the following streets are hereby closed to through vehicular traffic from 4:00 A.M. Saturday, - November 14, 1992 to 6:00 P.M. Sunday, November 15, 1992, as specified below: Main Highway from McFarlane Road to Charles Avenue. _ Commodore Plaza from Grand Avenue to Main Highway. - Fuller Street from Grand Avenue to Main Highway. 92- 533 - 2 - hst NaiIlk Included in the herein closure are all streets, avenues, alleys, ways and thoroughfares which intersect the enumerated areas delineated in this Section. Section 3. Such closing of streets is subject to State approval and issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services. Said permit from the Department of Police is to be issued upon full approval of the Chief of Police after giving all due consideration to the safety and traffic needs of residents, businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgement predicated upon all factors set forth herein. Section 4. Upon the issuance of a temporary permit by the Florida Department of Business Regulation, Division of Alcoholic Beverages and Tobacco, to sell beer and wine pursuant to Section 54-12.1 of the City Code, the request of the Coconut Grove Chamber of Commerce to sell beer and wine for a two-day period in E,•. connection with the 16th Annual Banyan Arts & Crafts Festival to be held November 14 and 15, 1992, is hereby granted subject to the issuance of all permits required by law. Section 5. Pursuant to Section 39-13 of the City Code, all R. retail peddlers' occupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be valid during the hours of 4:00 A.M. to 6:00 P.M. on November 14-15, 1992, on the streets designated hereinabove and on all intersecting streets for two blocks in all directions. - 3 - y2- -33 Section 6. The herein approvals and authorizations are hereby conditioned upon the organizers paying for all costs of City services and fees associated with said event and obtaining insurance to protect the City in the amount as prescribed by the City Manager or his designee. Odi City Manager RECOMMENDATION: DATE : c E p _ 21992 FILE SUBJECT: Resolution/Street Closure/ Beer & Wine Permit/Retail Peddlers for Banyan REFERENCES pestival ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached resolution authorizing the closure of certain streets in the Coconut Grove area, the sale of beer and wine and the restriction of retail peddlers in the area in connection with the 16th Annual Banyan Arts & Crafts Festival, to be conducted by the Coconut Grove Chamber of Commerce on November 14-15, 1992. These authorizations are conditioned upon the organizers paying for any costs of City services and applicable fees and the requirement that the City will be insured against any potential liability. BACKGROUND: The Department of Community Development has prepared the appropriate legislation in connection with the 16th Annual Banyan Arts & Crafts Festival, to be conducted on November 14-15, 1992 by the Coconut Grove Chamber of Commerce. The organizers have met with the Special events Committee (including the Police Department) to discuss said event. This will be the sixteenth year that the Chamber has conducted this event. Since the aforementioned event has been held in Coconut Grove in the past, the limitations imposed by Ordinance 10764 as to the number of events in the Coconut Grove Special Events District do not apply in this case.
