RESOLUTION NO. 9, 2—
A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT
AMOUNT NOT TO EXCEED $28,000, IN THE CONTRACT
BETWEEN THE CITY OF MIAMI, FLORIDA AND SERVICE
STATION AID, INC., DATED NOVEMBER 15, 1990, FROM
$60,921.40 TO AN AMOUNT NOT TO EXCEED $88.921.40,
FOR THE HEAVY EQUIPMENT FACILITY ENVIRONMENTAL
CONSULTING/CONSTRUCTION SERVICES PROJECT B-5579,
CAPITAL IMPROVEMENT PROJECT NO. 311009. WITH SAID
FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS
ORDINANCE NO. 10938, AS AMENDED, FROM FUNDS ALREADY
APPROPRIATED TO THE PROJECT; FURTHER RATIFYING THE
CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN
INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS OF
THE CITY COMMISSION.
WHEREAS, there exists a contract dated November 15, 1990,
between the City of Miami, Florida and Service Station Aid, Inc.,
for Heavy Equipment Facility Environmental
Consulting/Construction Services B - 5 5 7 9 , Capital Improvement
Project No. 311009; and
WHEREAS, an increase in contract not to exceed $28,000 is
required to cover the cost of necessary extra work involving the
repair of underground fuel tanks, repair and/or replacement of
defective valves or components of the fuel supply system
affecting a total of nine underground storage tanks, the
petrotite tank retesting of nine underground storage tanks, the
removal and replacement of additional concrete slab to allow
repairs, and payment for an amendment to the previously prepared

contamination assessment report to further delineate existing
underground site contamination; and
WHEREAS, the Acting Director of Public Works, the Oirector
of General Services Administration and Solid Waste and the City
Manager recommend the increase in contract to cover the
additional costs; and
WHEREAS, the City Manager has made a written finding that a
valid emergency existed for the work to continue to protect the
health, safety and welfare of the citizens of the City; and
WHEREAS, funds to cover the increase are available from
monies already appropriated to the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this
Resolution are hereby adopted by reference thereto and incorporated herein as if
fully set forth in this Section.
Section 2. After a properly advertised Public Hearing the
findings of the City Manager set forth in the preamble of this
Resolution are hereby ratified by an affirmative vote of four -
fifths of the City Commission.
Section 3. The contract between Service Station Aid, Inc.
and the City of Miami, Florida, dated November 15, 1990, for
Heavy Equipment Facility Environmental Consulting/Construction
Services B-5579, Capital Improvement Project No. 311009, is
hereby increased in an amount not to exceed $28,000, from
$60,921.40 to an amount not to exceed $88,921.40, with funds for

the increase to be provided from monies already appropriated to
the project.
Section 4. This resolution shalt become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing an Increase in the contract not
to exceed $28,000, in the contract between the City of Miami and
Service Station Aid, Inc. for the Heavy Equipment Facility
Environmental Consulting/Construction Services Project; and
further ratifying the City Manager's written finding that the
Increase resulted from emergency circumstances.
BACKGROUND:
The Department of Public Works and the Department of General
Services Administration and Solid Waste. in an effort to serve
all residents of the City of Miami, have determined that It Is
now appropriate and In order for the City Commission to ratify
the City Manager's decision to Increase the existing $60, 921 . 40
contract dated November 15, 1990, between the City and Service
Station Aid, Inc. for Heavy Equipment Facility Environmental
Consulting/Construction Services In an amount not to exceed
$28,000 for necessary extra work, and to ratify the City_
Manager's emergency finding that allowed the extra work to
continue.
The City Commission authorized Informal bids and allocated
up to $80,000 for the Heavy Equipment Facility Environmental
Consulting/Construction Services Project No. 311009 on
October 18, 1990.
Generally, the project consisted of the physical upgrading of the
fuel storage system to comply with current Federal, State and
local requirements, Petrotite Testing and certification of the
fuel storage system, and the sampling, testing quantifying and
assessment of the sub surface soil and water contamination
associated with the fueling station.
As the job progressed the need for additional work beyond the
original scope of the project became apparent. The additional
work is outlined below.

ENCLOSURES
Based on Information supplied to me by the Director of the
Department of Public Works, I found that an emergency existed
justifying the authorization for Service Station Aid, Inc., a
company located within the City of Miami, to undertake additional
work at the Heavy Equipment Consulting/Construction Services
Project beyond the original scope of their contract.
The City Commission authorized informal bids and allocated up to
$80,000 for Heavy Equipment Consulting/Construction Services
Project, Project No. 311009 on October 8, 1990. A contract was
executed November 15, 1990 between the City and Service Station
Aid, Inc. In the amount of $60,921.40.
Generally, the project consisted of the physical upgrading of the
fuel storage system to comply with current Federal, State and
local requirements, Petrotite Testing and certification of the
fuel storage system, and the sampling, testing quantifying and
assessment of the sub surface soil and water contamination
associated with the fueling station.
As the job progressed the need for additional work beyond the
original scope of the project became apparent. The additional
work Is outlined below.
1. One fiberglass fuel tank was found to be cracked
requiring specialized repair.
2. Numerous connections, valves. pumps were found to
be defective requiring extensive concrete slab
removal excavation, and component replacement which
exceeded the available contingency amount.
3. Due to the previously listed failures and repairs,
nine underground tanks were required to be
retested. All testing was done at night to avoid
disruption of City operations.

None of the Items described above were Included In the original
scope of work. Failure to correct these problems could have
endangered the health, safety and welfare of our citizens. It
was decided that the most cost effective and expeditious manner
to address all of these problems was to allow the contractor
already working on the project, Service Station Aid, Inc., to
accomplish the extra work.
The Increase in contract to cover all of the aforementioned extra
work will not exceed $28,000. Funds for the Increase are
available from monies already appropriated to the project In the
Clty's Capital Improvement Appropriation Ordinance No. 10938, as
amended, Project No. 311009.
