RESOLUTION NO.
A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT
AMOUNT NOT TO EXCEED $25,000, IN THE CONTRACT
BETWEEN THE CITY OF MIAMI, FLORIDA AND URBAN
CONSTRUCTORS, INC., DATED DECEMBER 179 1991, FROM
$4659000.00 TO $490,,000.009 FOR THE CURTIS PARK
REDEVELOPMENT -FIELDWORK PROJECT (SECOND BIDDING) B-
2983-H, CAPITAL IMPROVEMENT PROJECT NO. 331353, WITH
SAID FUNDS TO BE PROVIDED FROM THE CAPITAL
IMPROVEMENTS ORDINANCE NO. 10938,USINa. FUNDS ALREADY
APPROPRIATED TO THE PROJECT; FURTHER RATIFYING THE
CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN
INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN
AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS OF
THE CITY COMMISSION.
WHEREAS, there exists a contract dated December 17, 1991,
between the City of Miami, Florida and Urban Constructors, Inc.
for Curtis Park Redevelopment -Fieldwork Project (Second Bidding)
B-2983-H, Capital Improvement Project No. 331353; and
the
WHEREAS, an increase in /contract not to exceed $25,000 is
required to cover the cost of necessary extra work involving the
installation of temporary protective fencing, additional
compacted fill material including grading adjacent to the new
bleacher and walkway areas, construction of concrete supports for
future public address system control panels, additional heavy
equipment rental costs, and payment of "premium time" labor rates
for overtime and weekend work to accelerate the project schedule;
and

WHEREAS, the Director of Public Works, the Director of Parks
and Recreation and the City Manager recommend the increase in
contract to cover the additional costs; and
WHEREAS, the City Manager has made a written finding that a
valid emergency existed for the work to continue to protect the
health, safety and welfare of the citizens of the City; and
WHEREAS, funds to cover the increase are available from
monies already appropriated to the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI,FLORIDA:
Section 1. After a properly advertised Public Hearing, the
findings of the City Manager set forth in the preamble to this
Resolution are hereby ratified by an affirmative vote of four -
fifths of the City Commission, and are hereby incorporated by
reference thereto and adopted as if fully set forth in this
Section.
- Section 2. The contract between Urban Constructors, Inc.
and the City of Miami, Florida, dated December 17, 1991, for
Curtis Park Redevelopment -Fieldwork Project (Second Bidding) B-
2983-H, Capital Improvement Project No. 3313539 is hereby
increased in an amount not to exceed $25,000, from $465,000.00 to
$490,000.00, with funds for the increase to be provided from
monies already appropriated to the project.
Section 3. This resolution shall become effective
immediately upon its adoption.

The Department of Public Works and the Department of Parks and
Recreation, in an effort to serve all residents of the City of
Miami, have determined that it is now appropriate and in order
for the City Commission to ratify the City Manager's decision to
increase the existing contract dated December 17, 1991, between
the City and Urban Constructors, Inc. for Curtis Park
Redevelopment -Fieldwork Project (Second Bidding) in an amount not
to exceed $25,000 for necessary extra work, and to ratify the
City Manager's emergency finding that allowed the extra work to
continue.
The City Commission awarded a contract to Urban Constructors,
Inc. for the construction of Curtis Park Redevelopment -Fieldwork
Project (Second Bidding) , Project No.331353, on October 39 1991.
Generally, the project consisted of the construction of track and
field event amenities including miscellaneous park improvements.
As the project progressed,... the need for additional work beyond
the original scope of the project became apparent. The
additional work is outlined below:
1. Installation of a temporary chain link fence around the
perimeter of the running track was needed to protect the new
track surface from vandals and other construction activity
until the facility was officially turned over to the City.

2. Extra compacted fill material and grading were needed under
the east (home side) bleachers and at the site of the new
restroom facility on the visitors' side.
3. Additional compacted fill material and grading were needed
at the southeast corner of the park to accommodate the
proposed walkway area leading from N. River Drive to the new
sports field.
4. Construction of two concrete walls and footings were added
to the contract to accommodate the F.,blic address control
panels which will be installed by others at a future date.
5. In order to accelerate completion of the project - that the
dedication ceremony scheduled by the Cc:nmissio could be
held, the contractor was paid "premium time" labor rates for
overtime and weekend work.
6. The cost of renting a crane was authorized to lift new sod
across the running track for the January 16, 1992 dedication
ceremony. The new track surface was curing concurrent with
the placement of the sod. Heavy vehicles required to
transport the sod could not be driven across the track until
the surface had cured completely.
None of the items described above were included in the original
scope of work. Failure to correct these problems could have
endangered the health, safety and welfare of our citizens. It
was decided that the most cost effective and expeditious manner
to address all of these problems was to allow the contractor
already working on the project, Urban Constructors, Inc., to
accomplish the extra work.
The increase in contract to covey all of the aforementioned extra
work will not exceed $25,000. Funds for the increase are
available from monies already appropriated to the project in the
City's Capital Improvement Appropriation Ordinance No. 10938,
Project No. 331353.

Based on information supplied to me by the Director of the
Department of Public Works, I have found that an emergency
existed justifying the authorization for Urban Constructors, Inc.
to undertake additional work at the Curtis Park Redevelopment -
Fieldwork Project beyond the original scope of their contract.
The reasons for the emergency need and subsequent authorization
to perform additional work are follows:
The City Commission awarded a contract to Urban Constructors,
Inca for the construction of Curtis Park Redevelopment -Fieldwork
Project (Second Bidding), Project No. 331353, on October 3, 1991.
Generally, the project consisted of the construction of track and
field event amenities including miscellaneous park improvements.
As the project progressed, the need for additional work beyond
the original scope of the project became apparent. The
additional work is outlined below.
