RESOLUTION NO.
A RESOLUTION REJECTING THE FINDINGS AND ALL
RESPONSES TO REQUESTS FOR PROPOSAL ("RFP"),
NO. 90-91-098, RECEIVED BY THE SELECTION
COMMITTEE CONCERNING THE SELECTION OF THE
MOST QUALIFIED FIRMS TO PROVIDE DESIGN,
CONSTRUCTION, ACCEPTANCE TEST, FINANCE AND
OWNERSHIP/OPERATION OF A SOLID WASTE
PROCESSING FACILITY; FURTHER DIRECTING THE
CITY MANAGER TO ISSUE A NEW RFP CONTINGENT
UPON PRESCRIBED SPECIFICATIONS AS DESIGNATED
IN SAID RFP, AND TO BRING SAID RESPONSES BACK
TO THE CITY COMMISSION FOR REVIEW AND
APPROVAL.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The findings and all responses to Requests
for Proposal ("RFP"), No. 90-91-098, received by the Selection
Committee concerning the selection of the most qualified firms to
provide design, construction, acceptance test, finance and
ownership/operation of a solid waste processing facility, are
hereby rejected.
Section 2. The City Manager is hereby directed to issue
a new RFP, contingent upon prescribed speoifioations as
designated in said RFP, and to bring said responses back to the
City Commission for review and approval.
Section 3. This Resolution shall beoome effective
immediately upon its adoption.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached resolution accepting the recommendations of the
Evaluation Committee for RFP No. 90-91-098, as to the most
qualified company, in rank order, to design, construct,
acceptance test, finance, own/operate a solid waste processing
facility.

On June 20, 1991, the City Commission authorized issuance of a
Request for Proposals (RFP) to select a firm with the
capabilities to undertake the above noted project. RFP No. 90-
91-098 was subsequently advertised on August 12, 1991; however,
several issues not addressed in the RFP document arose and three
addenda were released between August and November 1991 to clarify
same.
Four proposals were received on
companies listed below:

Reidel Waste Systems,

A selection committee was assembled to evaluate the proposals in
accordance with the criteria set out in the RFP. Five names were
submitted for your review on March 16, 1992, two of which
represented commission nominations. At the City Commission
meeting held on April 2, 1992, you were offered the opportunity
to add names for consideration to this committee; however, no
additional names were provided. The final committee was
comprised of two City staff persons and five other individuals,
including two university professors, one college instructor, a
businessman and the director of National Composting Program for
the U.S. Conference of Mayors.

located at City Hall, 3500 Pan American Drive, Miami, Florida
33133 not later than 200 p.m.__September 16, 1991 to select a
firm that has the capabilities to design, construct, acceptance
test, finance, own/operate a solid waste processing facility.
This RFP is only for companies employing proven aerobic
composting technologies.
Proposals submitted past such deadline and/or submitted to any
other location or office shall be deemed not responsive and will
be rejected.
Ordinance No. 10062 as amended, established a goal of Awarding
51% of the City's total dollar volume of all expenditures for All
Goods and Services to Black, Hispanic and Women Minority Business
Enterprises on an equal basis.
Minority and women vendors who are interested in submitting
proposals and who are not registered with the City as minority or
women vendors are advised to contact the City Procurement Office,
1390 N.W. 20th Street, Second Floor, Telephone 575-5174.

GENERAL CONDITIONS
BIDDER: To Insure acceptance of the bid, follow these instructions.
SEALED BIDS: All bid sheets and this form must be executed
and submitted in a sealed envelope. The faceof the envelope shall
contain, In addition to the above address, the date and time of the
bid opening and the bid number. Bids not submitted on attached
bid form may be rejected. All bids are subject to the condltlons
specified hereon and on the attached sheets.
1. EXECUTION OF BID: Bid must contain a manual signature
of an authorized representative In the space provided above.
The company name must also appear on
each page of the bid as required.
2. NO BID: If not submitting a bid, respond by returning this
form, marking it "NO BID", and explain the reason In the
suufsufficientnt justification ce provided shall be cause fforve. Repeated failure tremovawithout l of the
supplier's name from the bid mailing list, NOTE: To qualify
as a respondent, bidder must submit a "NO BI D", and It must
be received no later than the stated bid opening date and hour.
2. BID OPENING: Shall be public, on the date and at the time
specified on the bid form. It is the bidder's responsibility to
assure that his bid Is delivered at the proper time and place of
the bid opening. Bids which for any reason are not so
delivered, will be returned unopened. Offers by telegram or
telephone are not acceptable.
4. PRICES, TERMS and PAYMENT: Firm prices shall be
quoted; typed or printed in ink and Include all packing,
handling, shipping charges and delivery to any point within
Dade County, Bidder is requested to offer cash discount for
prompt Invoice payment. Discount time will be computed
from the date of satisfactory delivery at place of acceptance
or from receipt of correct invoice at the office specified,
whichever is later.
a) TAXES: Do not Include State or Federal taxes not ap-
plicable to municipalities. The applicable Tax Exemption
number is shown on the Purchase Order.
W MISTAKES: Bidders are expected to examine the
specifications, delivers schedule, bid prices, and all In-
structions pertaininy to supplies and services. Failure to
do so will be at bidder's risk.
e) CONDITION AND PACKAGING: It Is understood and
agreed that any Item off eyed or shipped as a result of this
bid shall be new (current production model at the time of
this bid). All containers shall be suitable for storage or
shipment, and all prices shall include standard com-
mercial packaging.
d)SAFETY STANDARDS: Unless otherwise stipulated In
the bid, all mAnufactured items and fabricated assemblies
shall ran ply with applicable requirements of Oc-
cupational Safety and Health Act and any standards
lhercv. nder.
e) INVOICING AND PAYMENT: The contractor shall be
paid upon submission of properly certified Invoices to the
city of Miami at the prices stipulated on the purchase
order, less deductions If any, as provided. All Invoices
shall bear the purchase order, invoicing at variance with
this provision may subject the contract to cancellation.
S. MANUFACTURER'S NAMES AND APPROVED
EQUIVALENTS: Any manufacturers' names, trade names,
brand names, information or catalog numbers listed in a
specification are for information, not to limit competition.
The bidder may offer any brand for which he is an authorized
representative, which meets or exceeds the specification for

12. NONCONFORMANCE TO CONTRACT CONDITIONS: Items
may be tested for compliance with specifications under the
direction of the Florida Department of Agriculture and
Consumer Services, or by other appropriate testing
laboratories. The data derived from any tests for compliance
with specifications are public records and open to
examination thereto in accordance with Chapter 119, Florida
Statutes, 1971. Items delivered not conforming to
specifications may be rejected and returned at vendor's

15. GOVERNMENTAL RESTRICTIONS: In the event any
governmental restrictions may be Imposed which would
necessitate alteration of the material, quality, workmanship
or performance of the items offered on this proposal prior to
their delivery, It shall be the responsibility of the successful
bidder to nolify the purchasing agent at once, indicating In his
letter the specific regulation which required an alteration.
The city reserves the right to accept any such alteration,
including any price adjustments occasioned thereby, or to
cancel the contract at no expense to the city.
16. LEGAL REQUIREMENTS: Federal, State, county, and city
laws, ordinance, rules, and regulations that in any manner

20. EXTENSION: Thecityof Miami reserves the option to extend
the period of this contract, or any portion thereof, for an
additional contract period. Extension of the contract period

21. ABNORMAL QUANTITIES: While It is not anticipated,
should any unusual or abnormal quantity requirements arise,
the city reserves the right to call for separate proposals

23. ASSIGNMENT: Any Purchase Order Issued pursuant to this

After reasonable notice to an actual or prospective contractual party, and after reasonable
opportunity to such party to be heard, the city manager, after consultation with the chief
procurement officer and the city attorney, shall have the authority to debar a contractual
party for the causes listed below from consideration for award of city contracts. The
debarment shall be for a period of not fewer than three (3) years. The city manager shall
also have the authority to suspend a contractor from consideration for award of city

be rejected.
Ordinance No. 10062, as amended, established a goal of Awarding
51% of the City's total dollar volume of all expenditures for all
Goods and Services to Black, Hispanic and Women Minority Business
Enterprises on an equal basis.
Minority and women vendors who are interested in submitting
proposals and who are not registered with the City as minority or
women vendors are advised to contact the City Procurement Office,

Ordinance #10032 established a "First Source Hiring Agreement"
program to stimulate the creation of employment for City of Miami
