A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO A GRIEVANCE SETTLEMENT WITH THE
FRATERNAL ORDER OF POLICE, LODGE NO. 20, ON
BEHALF OF � THE FRATERNAL ORDER OF POLICE
HEALTH TRUST, IN AN AMOUNT OF $62,724.44;
AUTHORIZING THE DIRECTOR OF FINANCE TO PAY
SAID AMOUNT TO THE FRATERNAL ORDER OF POLICE
HEALTH TRUST IN FULL AND COMPLETE SETTLEMENT,
UPON THE EXECUTION OF A RELEASE, RELEASING
THE CITY OF MIAMI FROM ANY AND ALL CLAIMS AND
DEMANDS; ALLOCATING FUNDS THEREFOR FROM THE
GROUP INSURANCE TRUST FUND, ACCOUNT NO.
620101-661.
WHEREAS, the City Manager and the Fraternal Order of Police,
Lodge No. 20, have agreed to settle Grievance #12-88 as it
relates to certain medical claims covered under Article 37 -
Heart Bill of the collective bargaining agreement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized to enter
into a grievance settlement with the Fraternal Order of Police,
Lodge No. 20, for payment of medical bills in a total amount of
$62,724.44, with funds therefor hereby allocated from the Group
Insurance Trust Fund, Account No. 620101-661.
Section 3. The Director of Finance is hereby authorized to
pay the Fraternal. Order of Police Health Trus nn>>nt

full and complete settlement of the medical expenses as claimed
by the Fraternal Order of Police under Grievance #12-88, upon the
execution of a release, releasing the City of Miami from any and
;all claims and demands.
Section 4. This Resolution shall become effective
immediately upon its adoption.

It is respectfully requested that the City Commission authorize
the City Manager to enter into a settlement of a grievance filed
by the Fraternal Order of Police, Lodge No. 20 on behalf of the
Fraternal Order of Police Health Trust.
BACKGROUND:
In 1988 a dispute arose between the City of Miami and the
Fraternal Order of Police, Lodge No. 20 on the effective date of
Article 37 - Heart Bill in the collective bargaining agreement in
extending the provisions of Florida Statutes, Section 112.18 to
sworn employees of the bargaining unit.
After lengthy discussions and Identification and review of
medical bills, the City and the FOP have agreed to settle the
outstanding grievance.
The grievance settlement will require the City to pay $62,724.44
to the Fraternal Order of Police Health Trust.
This amount will cover the medical claims for two individuals,
one in the amount of $41,872.75 and one in the amount of
$20,851.69. The settlement will be paid from the Group insurance
Trust Fund.
