A RESOLUTION, WITH ATTACHMENTS, AUTHORIZING
THE CITY MANAGER TO EXECUTE AN AMENDMENT TO
THE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED
FORM, BETWEEN THE CITY OF MIAMI AND BORRELLI
& ASSOCIATES ARCHITECTS PLANNERS, P.A., AS
ARCHITECTURAL/ENGINEERING CONSULTANTS ON THE
FIRE GARAGE/FIRE STATION #3 MODIFICATION AND
EXPANSION PROJECT, FOR EXTRA WORK PERFORMED
WITHIN THE SCOPE OF THE PROJECT, AT AN EXTRA
COST OF $61,133; ALLOCATING FUNDS THEREFOR
FROM CAPITAL PROJECT FUND, FIRE GARAGE/FIRE
STATION #3 MODIFICATION AND EXPANSION PROJECT
(313019).
WHEREAS, the City of Miami engaged the services of Borrelli
& Associates, Architects Planners, P.A., on July 16, 1985, for
architectural design and technical services for the planning,
design, and construction consultation on the Fire Garage and Fire
Station #3 Expansion and Modification Project, for the lump sum
fee of $241,926; and
WHEREAS, the Department of Fire, Rescue and Inspection
Services found it necessary to provide for additional
construction work and modifications due to existing conditions,
omissions, and/or unforeseen conditions within the scope of the
Project, including revising the Fire Station's shower/bathroom
and kitchen areas, removing asbestos from the existing Fire
Station and Fire Garage structures, and to make other revisions
to the garage complex involving the oil interceptor system,
office areas, and the provision of emergency power and a
protective cover for emergency apparatus; and

WHEREAS, the actual construction time exceeded the allowable
construction time by more than 25%, through no fault of the
design consultant, necessitating the consultant to provide
extended construction administrative services; and
WHEREAS, cost of the additional architectural design,
technical services, and extended construction administrative
services performed by Borrelli & Associates, in relation to the
above work totals $61,133, and said amount must be incorporated
into the contract as an amendment approved by the City
Commission; and
WHEREAS, funding for said services is available in the
Capital Project Fund, Fire Garage/Fire Station #3 Modification
and Expansion Project (313019);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution, are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized'/ to
execute an Amendment to the Agreement dated July 16, 1985, in
substantially the attached form,, between the City of Miami and
Borrelli & Associates, Architects Planners, P.A.,
Architectural/Engineering Consultants on the Fire Garage/Fire

Station #3 Project, for extra work performed within the scope of
the project, at an extra cost of $61,133, with funds therefor
hereby allocated from the Capital Project Fund, Fire Garage/Fire
Station #3 Modification and Expansion Project (313019).
Section 3. This Resolution shall become effective
immediately upon its adoption.

AMENDMENT NUMBER
AMENDMENT TO CONTRACT BETWEEN THE
CITY OF MIAMI AND BORRELLI & ASSOCIATES
ARCHITECTS PLANNERS, P.A.
This AMENDMENT, entered into this day of
1992, by and between the CITY OF MIAMI, a
municipal corporation of the State of Florida (hereinafter called
"CITY"), and BORRELLI & ASSOCIATES PLANNERS, ARCHITECTS PLANNERS,
P.A., 4950 Southwest 72 Avenue, Suite 110, Miami, Florida 33155,
(hereinafter called "PRINCIPAL"), amending the existing Agreement
between the CITY and the PRINCIPAL, dated July 16, 1985.
In consideration of the mutual covenants and agreements
hereinafter set forth, and for and in consideration of other
valuable consideration, the parties hereto covenant and agree as
follows%
1. That in the opinion of the CITY, unforeseen WORK
within the scope of the PROJECT has been required for
additional modifications to the building and site, all
as described in Exhibit A, attached and made a part
hereof.,
2. That pursuant to SECTION VII - ADDITIONAL WORK
AUTHORIZED BY THE CITY, the CITY has authorized the
PRINCIPAL to provide additional services, found
necessary by the CITY, the fee for these services
being in the amount of $61,133.

3. The herein Amendment supersedes any prior contractual
terms to the contrary and all other terms and
conditions remaining as agreed.

It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing the City Manager to execute an
Amendment, in substantially the form attached hereto, to the July
16, 1985 Agreement between the City and Borrelli & Associates,
Architects Planners, P.A., consultants of the Fire Garage/Fire
Station #3 Modification and Expansion Project, for extra work
performed within the scope of the Project, at an extra cost of
$61,133. Funds to cover these services are to be allocated from
the Capital Project Fund, Fire Garage/Fire Station #3
Modification & Expansion Project (313019).

In the course of redevelopment and refurbishment of the Fire
Garage and Fire Station #3, it was necessary for the Department
of Fire, Rescue and Inspection Services to authorize additional
design services of the architectural and engineering consultant
to cover unforeseen work. The extra work included:
Revisions to the Fire Station Shower & Bathroom Areas
Revisions to Fire Station Kitchen
Removal of Asbestos from the Fire Station & Fire Garage
Addition of Protective Cover for Emergency Apparatus
Revisions to the Oil Interceptor System Re: new DERM regs.
Revisions to Office Floor & .Light -Ceiling Plan
Revisions to the A/C System Re: Emergency Power
In addition to the above costs, the actual construction time
exceeded the allowable construction time by more than 25%, due to
no fault• of the design consultant, and extended construction
administrative services had to be provided by the consultant at
additional expense.
