HomeMy WebLinkAboutR-92-0368J-92-399 04/01/92 RESOLUTION NO. 92- 368 A RESOLUTION AUTHORIZING THE FUNDING OF THE CAREER CRIMINAL PROGRAM AND ALLOCATING FUNDS THEREFOR IN AN AMOUNT NOT TO EXCEED $32,980 FROM THE CITY OF MIAMI LAW ENFORCEMENT TRUST FUND, SUCH EXPENDITURE HAVING BEEN APPROVED BY THE CHIEF OF POLICE. WHEREAS, Florida State Statute 932.704(3)(a), as amended, authorizes the expenditure of forfeiture proceeds for protracted and/or complex investigations; and WHEREAS, Resolution No. 88-655, adopted on July 14, 1988, authorized the funding of the Career Criminal Program, in the amount of $35,000; and WHEREAS, Resolution No. 90-592, adopted July 26, 1990, authorized funding to said Program in the amount of $35,000; and WHEREAS, Resolution No. 91-224, adopted March 14, 1991, authorized funding to said Program in the amount of $32,000; and WHEREAS, the continued need for the operation of the Career Criminal Program requires that an additional $32,980 be allocated to the Program; and WHEREAS, funds to cover the necessary costs and expenditures required for the Career Criminal Program have not been included in the Police Department's normal operating budget; and CITY COMMISSION MEETING OF J U N 1 1 1992 Resolution No. 92- 368 WHEREAS, the Chief of Police has recommended adoption of this Resolution and has determined that the expenditures proposed comply with Florida State Statute 932.704, as amended; and WHEREAS, funds to cover the necessary expenses required for this program are available in the City of Miami Law Enforcement Trust Fund; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference t thereto and incorporated herein as if fully set forth in this Section. Section 2. Funding of the Career Criminal Program is hereby authorized with funds therefor, in an amount not to exceed $32,980, hereby allocated from the City of Miami Law Enforcement Trust Fund, Project No. 690001, Index Code 029002- 247, such expenditure having been approved by the Chief of Police. Section 3. This Resolution shall become effective immediately upon its adoption. Odio = - = • F City Manager — It is respectfully requested that the City Commission allocate funding, in an amount not to exceed $32,980, to cover the necessary costs and expenses of a Career Criminal Program. Funding will be from the Law Enforcement Trust Fund. The City of Miami Police Department, in conjunction with the Dade County State Attorney's Office and the Metro -Dade Police Department, implemented a Career Criminal Program aimed at identifying and targeting offenders that meet the following career criminal criteria: (1) Three previous convictions for any forcible felony or felony drug offense, or both; (2) Any juvenile convictions as adults for any forcible felony or felony drug offense after attaining the age of sixteen; and (3) At least one state prison incarceration for any felony. Specifically, the Career Criminal Program identifies and targets offenders who meet the career criminal criteria; locates the identified criminals and places them under physical surveillance; records criminal activity; apprehends the offenders in the act of committing felony crime(s); and assists the State Attorney's Office with prosecution in order to obtain conviction and maximum penalties. The funding requested for this program will be utilized to obtain the following necessary investigative aids: rental vehicles, surveillance/investigative equipment, and miscellaneous/office supplies. It is, therefore, recommended that the funding of the Career Criminal Program, in an amount not to exceed $32,980, be approved.
