RESOLUTION NO. 92- 330
A RESOLUTION AUTHORIZING AN INCREASE IN THE
CONTRACT AMOUNT NOT TO EXCEED $31,000, IN THE
CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA, AND
URBAN CONSTRUCTORS, INC., DATED FEBRUARY 28,
1991, FROM $394,677.00 TO $425,677.00, FOR THE
AFRICAN SQUARE PARK RENOVATIONS -BUILDING &
SITEWORK PROJECT (SECOND BIDDING) B-3237-B,
CAPITAL IMPROVEMENT PROJECT NO. 331053, WITH SAID
FUNDS TO BE PROVIDED FROM THE CAPITAL
IMPROVEMENTS ORDINANCE NO. 10938 FROM FUNDS
ALREADY APPROPRIATED TO THE PROJECT; FURTHER
RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT
THE HEREIN INCREASE RESULTED FROM EMERGENCY
CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR -
FIFTHS OF THE MEMBERS OF THE CITY COMMISSION.
WHEREAS, there exists a contract dated February 28, 1991,
between Urban Constructors, Inc. and the City of Miami, Florida,
for African Square Park Renovations -Building & Sitework Project
(Second Bidding) B-3237-B, Capital Improvement Project No.
331053; and
WHEREAS, an increase in contract not to exceed $31,000 is
required to cover the cost of necessary extra work involving the
installation of security shutters, abandonment of the existing
septic tank and construction of new sanitary sewer service,
replacement of deteriorated underground electrical conduit,
upgrading the primary electrical service, and installation of a
fire alarm system to obtain a final certificate of occupancy; and

WHEREAS, the Director of Public Works, the Director of Parks
and Recreation, and the City Manager recommend the increase in
contract to cover the additional costs; and
WHEREAS, The City Manager has made a written finding that a
valid emergency existed for the work to continue to protect the
health, safety and welfare of the citizens of the City; and
WHEREAS, funds to cover the increase are available from
monies already appropriated to the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. After a properly advertised Public Hearing, the
findings of the City Manager set forth in the preamble to this
resolution are hereby ratified by an affirmative vote of four -
fifths of the City Commission, and are hereby incorporated by
reference thereto and adopted as if fully set forth in this
Section.
Section 2. The contract between Urban Constructors, Inc.
and the City of Miami, Florida, dated February 28, 1991, for
African Square Park Renovations -Building & Sitework Project
(Second Bidding) B-3237-B, Capital Improvement Project No.
331053, is hereby increased in an amount not to exceed $31,000,
from $394,677.00 to $425,677.00, with funds for the increase to
be provided from monies already appropriated to the project.
Section 3. This Resolution shall become effective
immediately upon its adoption.

INCREASE IN CONTRACT

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing an increase in the contract not
to exceed $31,000 in the contract between the City of Miami and
Urban Constructors, Inc. for the African Square Park Renovations -
Building & Sitework Project (Second Bidding) B--3237-B; and
further ratifying the City Manager's written finding that the
increase resulted from emergency circumstances.
BACKGROUND
The Department of Public Works and the Department of Parks and
Recreation, in an effort to serve all residents of the City of
Miami, have determined that it is now appropriate and in order
for the City Commission to ratify the City Manager's decision to
increase the existing contract dated February 28, 1991, between
the City and Urban Constructors, Inc. for African Square Park
Renovations -Building & 4itework Project (Second Bidding) in an
amount not to. exceed $31,000 for necessary extra work, and to
ratify the City Manager's emergency finding that allowed the
extra work to continue.
The City Commission awarded a contract to Urban Constructors,
Inc. for the construction of African Square Park Renovations -
Building & Sitework Project (Second Bidding), Project No. 331053,
on January 10, 1991. Generally, the project consisted of the
renovation of an existing recreation building and ancillary
buildings, as well as other miscellaneous site improvements. As
the project progressed, the need for additional work beyond the
original scope of the project became apparent. The additional
work is outlined below.
1. Due to the potential for break-ins and vandalism once the
renovations were completed, Public Works and Parks
Department's personnel decided to have security shutters
installed on the exterior doors and windows.

2. The existing septic tank was not functioning properly and
had to be abandoned. A new sanitary sewer service lateral
had to be constructed to adequately serve the renovated
facilities.
3. The underground electrical conduit for the existing park
lighting system had deteriorated to the point that extensive
replacement of the conduit network was necessary.
4. The primary electrical service to the park had to be
upgraded. This upgrade included the installation of a new
utility pole, pull boxes, conduits and grounding rods.
5. The Fire Department required that a new fire alarm system be
installed prior to a final Certificate of Occupancy being
issued.
None of the items described above were included in the original
scope of work. Failure to correct these problems could have
endangered the health, safety and welfare of our citizens. It
was decided that the most cost effective and expeditious manner
to address all of these problems was to allow the contractor
already working on the project, Urban Constructors, Inc., to
accomplish the extra work.
The increase in contract to cover all of the aforementioned extra
_ work will not exceed $31,000. Funds for the increase are
available from monies already appropriated to the project in the
City's Capital Improvement Appropriation Ordinance No. 109 M
Project No. 331053.

Based on information supplied to me by the Director of the
Department of Public 'Works, I have Nund that an emergency
existed justifying the authorizoti.on for Urban Constructors, Tno.
to undertake additional work at African Square Park beyond the
original scope of their contract.
The reasons for the emergency need and subsequent authorization
to perform additional work are as follows;
The City Commission awarded a contract to Urban Constructors,

Building & Sitework (Second Bidding), Project No. 331053, on
January 10, 1991, Generally, the project consisted of the
