L. SAUM CONSTRUCTION COMPANY, INC., FOR THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION AND SOLID WASTE AT A TOTAL PROPOSED AMOUNT OF $109,709.44; ALLOCATING FUNDS THEREFOR FROM THE 1991-92 STATE RECYCLING GRANT, PROJECT NO. 197004, ACCOUNT CODE NO. 420306-340. WHEREAS, there is a need to continue and expand the City's mulching operation at Virginia Key within the conditions specified in the Mulching Permit issued by Metro -Dade Department of Environmental Resources Management (DERM), and as required by our application to the State of Florida, Department of Environmental Regulation (DER) for a permit to compost the material; and WHEREAS, said work requires the construction of a retention pond, two deep drainage wells, grading, shaping and compaction of existing fill and limerock base material and asphalts concrete surface at Virginia Key; and CITY COMMISSION MEETING OF MAY 14 1992 Roeolution No. 92- 329 WHEREAS, said project when completed will allow the City to obtain a State Permit to use the Virginia Key Mulching area as a composting site; and WHEREAS, informal bids were obtained from seven (7) contractors and R. L. Saum Construction Company Inc., has been selected as the lowest responsive and responsible bidder; and WHEREAS, the City Manager has made a written finding that a valid emergency need existed to accelerate the start-up of the composting facility by waiving formal bidding and by accepting the informal bid and awarding the site preparations project to R. L. Saum Construction Company, Inc., at a proposed amount of $109,709.44; and WHEREAS, funds for these services are available from 1991- 1992 State Recycling Grant, Project No. 197004, Account Code No. 420306-340. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By affirmative vote of 4/5ths of the Members of the City Commission, after a properly advertised public hearing, the action of the City Manager in making an emergency finding, waiving competitive sealed bids, and authorizing the issuance of .qk U an emergency purchase order for the preparation of the Virginia Key mulching area for composting to R. L. Saum Construction Company, Inc., at a proposed amount of $109,709.44 is hereby ratified approved and confirmed, with funding therefor hereby allocated from the 1991-1992 State Recycling Grant, Project No. 197004, Account Code No. 420306-340. L. Saum Construction Company., Inc., a non-minority/Dade County vendor as an emergency action by the City Manager at a total proposed amount of $109,709.44. Allocating funds therefor from the 1991-92 State Recycling Grant, Project No. 197004, Account Code No. 420306-340. DACKQROUND The Departments of Public Works and General Services Administration and Solid Waste, in an effort to construct, permit and start-up the City's Virginia Key yard/garden waste composting facility without delay, have received informal quotes from seven (7) contractors to perform this work. The project consists of the construction of a retention pond, two deep drainage wells, grading, shaping and compaction of existing fill and limerock base material and asphalt concrete surface at Virginia Key.* in order to obtain a State Permit for use as a composting facility. The lowest responsive and responsible bid was from R. L. Saum Construction Company, Inc., at a proposed total cost of $109,709.44. The City Manager made a written finding that a valid emergency existed and wadded formal bidding procedures in order to accelerate the start-up of the composting facility and to realize the savings projected from its operations. The City Manager determined the emergency award of this contract to be an appropriate action. The work required includes the installation of two (2) deep drain wells (approximately $40,000), the spreading and grading of limerock and the laying of asphalt (approximately $140,000). The Department of Public Works has prepared the documents required to formally bid these items, however, we anticipate that it would require approximately four (4) months to complete the bidding process, award the bids and begin the work, which will take approximately one (1) month to complete. In the interim period we would be forced to reduce our production of mulch at Virginia Key and the storage of yard/garden waste because the mulching permit does not allow the storage or further processing for this material nor the accumulation of yard/garden trash waiting to be mulched at the facility. In light of the substantial savings projected for this department through the diversion of eighty percent (80%) of our yard/garden waste to Virginia Key our facility for composting and free distribution to residents, we are compelled to request this approval to meet this objective. It is important to note that this goal is based on composting and that mulching is only the first step in this process. In order to become permitted to compost, however, we must first protect the ground and the aquifer by overlaying the lime rock and asphalt and installing the storm drain wells. Your signature below will authorize us to waive the formal bidding process for this work.
