RESOLUTION NO. 9 2 w 319
A. RESOLUTION, APPROVING THE CHIEF PROCUREMENT
OFFICER'S DECISION TO REJECT THE PROTEST OF
DANVILLE-FINDORFF, INC., IN CONNECTION WITH
BID NO. 91-92-069, ORANGE BOWL MODERNIZATION
PROJECT, PHASE II (1992) - SEAT REPLACEMENT,
AS IT HAS BEEN DETERMINED TO BE WITHOUT
MERIT.
WHEREAS, on April 7, 1992, the City of Miami (City)
advertised for bids for installing replacement seats at the
Orange Bowl Stadium; and
WHEREAS, on April 23, 1992, the City received six (6)
responses under Alternate Bid "A" -and five (5) responses under
Alternate Bid "B" of this bid; and
WHEREAS, on May 12, 1992, the City received a protest from
Danville-Findorff, Inc., alleging, inter alia, that the low
bidder under Alternate Bid "A" did not meet the City's bonding
requirements as specified in the bid documents; and
WHEREAS, the Chief Procurement Officer, pursuant to Section
=' 18-56.1 of the City Code, in her role as arbiter, investigated

the matter; and
WHEREAS, the Chief Procurement Officer has determined that
the protest was without merit and has rejected the protest; and

WHEREAS, the City Manager and the City Attorney concur with
and approve the finding of the Chief Procurement Officer and
recommend rejection of the protest filed by Danville-Findorff,
Inc.;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The Chief Procurement Officer's decision to
reject the protest from Danville-Findorff, Inc., in connection
with Bid No. 91-92-069, Orange Bowl Modernization Project, Phase
II (1992) - Seat Replacement, is hereby approved.
Section 3. This Resolution shall become effective
immediately upon its adoption.
