HomeMy WebLinkAboutR-92-0246I J-92-270 4/2/92 RESOLUTION NO. 92-- 246 A RESOLUTION CONTINUING THE ENGAGEMENT OF THE LAW FIRM OF TEW & GARCIA-PEDROSA TO SERVE AS CO -COUNSEL BEFORE THE UNITED STATES DISTRICT COURT FOR PRE-TRIAL LITIGATION SERVICES IN CONNECTION WITH THE CASE OF MIAMI MARINE EXPOSITION, INC. VS. CITY OF MIAMI, CASE NO. 90-967-CIV-MOORE, WITH AN ADDITIONAL INTERIM FEE FOR SUCH SERVICES NOT TO EXCEED $25,000.00; SAID MONIES THEREFOR BEING ALLOCATED FROM THE CITY OF MIAMI'S SELF- INSURANCE AND INSURANCE TRUST FUND. WHEREAS, the City Commission adopted Resolution No. 91-847 on November 14, 1991, which approved the engagement of the law firm of Tew & Garcia -Pedrosa to serve as counsel before the United States District Court for pre-trial litigation services, in connection with the case of Miami Marine Exposition, Inc. vs. City of Miami, Case No. 90-967-CIV-HIGHSMITH, with the interim fee for such services not to exceed $75,000.00; and WHEREAS, said case has been transferred twice to newly invested federal judges and is now styled as Miami Marine Exposition, Inc. vs. City of Miami, Case No. 90-967-CIV-MOORE; and WHEREAS, the newly assigned judges have postponed the trial dates to accommodate their criminal calendars; and WHEREAS, further discovery must be taken and pre-trial motions prepared and filed, and the case generally prepared further for trial; CITY CO4MI55ION MEETING OF AP? 0 2 1992 Resolution No. 9 2 - 24G NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Attorney's continuing engagement of the law firm of Tew & Garcia -Pedrosa to serve as co -counsel on behalf of the CITY OF MIAMI, before the United States District Court for pre-trial litigation services, in connection with the case of Miami Marine Exposition, Inc. vs. City of Miami, Case No. 90-967- CIV-MOORE, is hereby approved. Section 3. An additional interim fee for such services, not to exceed $25,000.00, is hereby approved with said monies therefor hereby allocated from the City of Miami's Self -Insurance and Insurance Trust Fund.
