A RESOLUTION AMENDING RESOLUTION NO. 91-206, ADOPTED MARCH 14, 1991, WHICH ALLOCATED AN AMOUNT NOT TO EXCEED $7,000 AS A GRANT TO THE COCONUT GROVE FAMILY HEALTH CENTER, INC. FOR SAID TENANT'S OPERATION OF A HEALTH CLINIC, TO COVER THE COST OF ROOF REPAIRS AT VIRRICK PARK AND ITS RECREATION BUILDING KNOWN AS THE REVEREND THEODORE GIBSON COMMUNITY CENTER ("CENTER"), SAID GRANT BEING A ONE-TIME WAIVER OF ROOFING MAINTENANCE REQUIREMENTS IN EFFECT FOR THE TENANCY OF THE COCONUT GROVE FAMILY HEALTH CENTER, INC., THEREBY RESCINDING THE ALLOCATION OF SAID GRANT TO THE COCONUT GROVE FAMILY HEALTH CENTER INC.; RATIFYING, APPROVING AND CONFIRMING, BY A FOUR -FIFTHS AFFIRMATIVE VOTE OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, THE ACTION OF THE CITY MANAGER IN FINDING THAT THE EXTRA ROOFING REPAIRS AT SAID CENTERTO BE AN EMERGENCY AND IN AUTHORIZING THE AWARD OF SAID REPAIRS TO P INO-FONTICI ELLA & ASSOCIATES, INC., IN THE AMOUNT OF $6,050, WITH FUNDS THEREFOR ALLOCATED FROM THE PROPERTY AND LEASE MANAGEMENT SPECIAL REVENUE FUND, PROJECT NO. 113010, AS PREVIOUSLY APPROVED BY RESOLUTION NO. 91-206, ADOPTED MARCH 14, 1991. WHEREAS, a contract dated September 6, 1990, exists between the City of Miami, Florida and Pino-Fontioiella & Associates, Ino. for Reverend Theodore R. Gibson Community Center/Coconut Grove Neighborhood Center Renovations, Capital Improvement Project No. 331316; and :CITY COP.-M ISSION MEETING OF APR 0 2 1992 Resolution Ito. 92- 239 WHEREAS, said project included roofing repairs over the activities room area of the neighborhood center but did not - include any repairs over the medical clinic portion of the building; and WHEREAS, during the course of performing the contracted roofing repairs, the contractor and City inspector visually and physically determined the need for additional repairs to the roof over the clinic area; and WHEREAS, Resolution No. 91-206, adopted March 14, 1991, authorized a one-time waiver for the maintenance requirements in effect for the tenancy of Virriok Park and its Recreation Building, known as the Reverend Gibson Community Center by the Coconut Grove Family Health Center for said tenant's operation of a health clinic and allocated an amount of $7,000 as a grant to said tenant to cover its cost of roof repairs at said building; and WHEREAS, the City Manager made a written finding that a valid emergency existed justifying the authorization for Pino- Fontioiella & Associates, Inc. to continue the roofing repairs beyond the original scope of work by performing extra roofing repairs over the clinic area; and WHEREAS, the Director of Public Works, the Director of Parks and Recreation and the City Manager considered the contractor's $6,050 estimate for accomplishing the extra roofing repairs to be fair and reasonable; and -2- 92- 239 WHEREAS, funds to cover the extra roofing repairs were previously allocated from Property and Lease Management Special Revenue Fund, Project No. 113010, pursuant to Resolution No. 91-206, adopted March 14, 1991; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. March 14, 1991, is particulars : .`/ Resolution No. 91-206, adopted hereby amended in the following "Section 1. The applicable maintenance requirements in effect for the tenancy of Virrick Park and its Recreation Building, also known as the Reverend Theodore Gibson Community Center, by the Coconut Grove Family Health Center, Inc. for said tenant's operation of a health center are hereby waived on a onetime basis for the purpose of roof repairs as provided herein. Section 2. An amount not to exceed $7,880 $6.050 is hereby allocated from the Property and Lease Management Special Revenue Fund, Project No. 113010, Account No. 590401, Lis jz grtLnb to the eucoLlub Grove inc., to cover its costa far .a, roofing repairs to said building, Section 3. The City Manager is hereby authorized to execute the necessary document(s), in a form acceptable to the City Attorney, with said tenant for said purpose, provided that said dooument(s) are in compliance with all requirements that may be imposed by Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. - 3 - 92- 239 K the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Section 4. This Resolution shall become effective immediately upon its adoption." Section 3. By a four -fifths affirmative vote of the Members of the City Commission after a duly advertised public hearing, the City Manager's action in finding that the extra roofing repairs at the Reverend Theodore Gibson Community Center was an emergency and the award of said repairs to Pino- Fontioiella & Associates, Inc. in the amount of $6,050 is hereby ratified, approved and confirmed, with funds therefor allocated from the Property and Lease Management Special Revenue Fund, Project No. 113010, as previously approved by Resolution No. 91-206, adopted March 14, 1991. Section 4. This Resolution shall become effective immediately upon its adoption. Odi City Manager RECOMMENDATION DATE MAR 2 51992 SURJECT Reverend Theodore Community Center Roofing Repairs REFERE14CES ENCLOSURES -:LAB-3229 Gibson It is respectfully recommended that the City Commission adopt the attached Resolution amending Resolution No. 91-206 adopted March 14, 1991, by rescinding the allocation of a $7,000 grant to the Coconut Grove Family Health Center, Inc. for roof repairs at the Reverend Gibson Community Center, and ratifying the City Manager's finding that an emergency existed justifying the award of said repairs to Pino-Fonticiella & Associates in the amount of $6,050 from funds therefore previously allocated by the aforesaid Resolution No. 91-206. BACKGROUND The Department of Public Works and the Department of Parks and Recreation, in an effort to serve all residents of the City of Miami, have determined that it is now appropriate and in order for the City Commission to ratify the City Manager's decision to award additional roofing repairs at the Reverend Theodore Gibson Community Center, 3230 Hibiscus Street, to Pino-Fonticiella & Associates, Inc., and to ratify the City Manager's emergency finding that allowed the roofing construction to continue. The City Commission awarded a contract to Pino-Fonticiella & Associates, Inc. for construction of Reverend Theodore Gibson Community Center/Coconut Grove Neighborhood Center Renovations, Project No. 331316, on May 24, 1990. Said project included roofing repairs over the neighborhood activities room area of the community center but did not include any repairs over the medical clinic portion of the building. During the course of performing the contracted roofing repairs, the contractor and City inspector visually and physically determined the need for additional repairs to the roof over the clinic area. 92- 239 3E- -1 Honorable Mayor and Members of the City Commission Resolution No. 91-206 adopted March 14, 1991, authorized a one- time waiver of the maintenance requirements in effect for the tenancy of Virrick Park and its recreation building, known as the Reverend Gibson Community Center, by the Coconut Grove Family Health Clinic. Said resolution also allocated $7,000 as a grant to said tenant to cover the cost of roofing repairs needed at the clinic. Since the City already had a contractor, Pino- Fonticiella & Associates, working on other portions of the roof, the tenant agreed to have the City's existing contractor continue the roofing repairs over the clinic. The contractor was subsequently paid directly by the City, therefore, the $7,000 grant to the tenant can be rescinded. The cost of the extra roofing work as negotiated with the contractor was $6,050. This price is considered fair and reasonable by Public Works staff. Funds are available for this extra work from the Property and Lease Management Special Revenue Fund, Project No. 113010, as previously allocated by Resolution No. 91-206 adopted March 14, 1991. Odio City Manager EfJGLOSURES I Based on information supplied to me by the Director of the Department of Public Works, I have found that an emergency existed justifying the authorization for Pino-Fonticiella & Associates to continue roofing repairs beyond the original scope of work by performing extra roofing repairs at the clinic area of the Reverend Theodore Gibson Community Center. The reasons for the emergency need and subsequent authorization to perform the work are as follows: The City Commission awarded a contract to Pino-Fonticiella & Associates, Inc. for construction of Reverend Theodore Gibson Adult Center/Coconut Grove Neighborhood Center Renovations, Project No. 331316, on May 24, 1990. Said project included roofing repairs over the neighborhood activities room area of the community center but did not include any repairs over the medical clinic portion of the building. During the course of performing the contracted roofing repairs, the contractor and City inspector visually and physically determined the need for additional repairs to the roof over the clinic area. It was decided that the most cost effective and expeditious method to correct the additional roofing problems would be to allow the contractor already on the project, Pino-Fonticiella & Associates, to accomplish all of the roofing work needed at that time. The cost of the extra roofing work as negotiated with the contractor was $6,050. This price is considered fair and reasonable by Public Works staff. P0 92- 239
