A RESOLUTION, BY AN AFFIRMATIVE VOTE OF
4/5THS VOTE OF THE MEMBERS OF THE CITY
COMMISSION, WAIVING COMPETITIVE SELECTION
PROCEDURES FOR THE ACQUISITION OF
PROFESSIONAL DESIGN SERVICES IN THE FIELDS OF
ARCHITECTURE, ENGINEERING AND/OR LANDSCAPE
ARCHITECTURE, AS MAY BE REQUIRED, FOR THE
"LUMMUS PARK REDEVELOPMENT PROJECT", CAPITAL
IMPROVEMENT PROJECT NO. 331042; RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING THAT A VALID PUBLIC EMERGENCY EXISTS
JUSTIFYING SUCH WAIVER FOR SAID PROJECT;
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE THE NECESSARY AGREEMENT(S), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE
MOST QUALIFIED FIRM(S) . FOR PROFESSIONAL
DESIGN SERVICES AS REQUIRED FOR SAID PROJECT;
ALLOCATING FUNDS THEREFOR IN AN AMOUNT NOT TO
EXCEED $55,000 FROM THE CAPITAL IMPROVEMENT
PROJECT NO. 331042.
WHEREAS be the
ginning with Improvement Appropriations
Ordinance of 1978, as amended by the Capital Improvement
Appropriations Ordinance No. 10938, adopted December 5, 1991,
funds in the total amount of $677,700 have been appropriated into
Capital Improvement Project No. 331042, entitled "Lummus Park
Redevelopment"; and
WHEREAS, said funds include $75,000 in Sunshine State
Revenue Bond Pool monies, $504,800 in Community Development Block
Grant funds and $97,900 in Land and Water Conservation Funds, the
latter of which is a federal grant through the Florida Department
of Natural Resources; and

WHEREAS, said funds are to be used for the complete
redevelopment of recreational facilities at Lummus Park, located
Florida,
at 404 Northwest Third Street, Miami,/ including entry and
activity plazas, demolition, lighting, site furnishings, picnic
shelters, a playground, fencing, recreation building renovations,
landscaping and general site improvements; and
WHEREAS, a portion of this work has been completed, namely
partial demolition, an entry plaza, fencing and some lighting
improvements, at a total estimated cost of $241,057, leaving an
estimated balance of $436,643 for all remaining work including
design, administration and construction; and
WHEREAS, due to time restrictions on the Land and Water
Conservation Fund grant as mandated by the U.S. Department of
Interior/National Park Service through the Florida Department of
Natural Resources, the City must complete all grant -funded
improvements by January 1994; and
WHEREAS, additional pressure to complete this work has been
put upon the City by the Federal Department of Housing and Urban
Development which has provided the Community Development Block
Grant funds; and
WHEREAS, due to the massive number of projects currently
under design in the Public Works Department, sufficient resources
do not exist in-house that would enable the City to complete the
project within the time constraints; and
WHEREAS, the City Manager has made a written finding that
the redevelopment of Lummus Park constitutes a valid public
emergency which requires the immediate procurement of the

required professional design services in order to protect the
health, safety and welfare of residents and for the convenience
of the City; and
WHEREAS, the nature of said valid public emergency is based
on the community's need for adequate recreational facilities in
this depressd. area of the City and on the potential financial
detriment to the City if funds are lost due to its inability to
comply with completion deadlines; and
WHEREAS, City Code Sections 18-52.3 and 18-52.6 provide for
the emergency procurement of required professional design
services; and
WHEREAS, the City Manager and Directors of the Departments
of Public Works and Parks and Recreation recommend that an
informal interview process be conducted to determine the most
qualified design firm or firms and that negotiations be conducted
to determine fair compensation for the required services; and
WHEREAS, it is that the cost of design services shall not
exceed $55,000, which amount is available in the "Lummus Park
Redevelopment Project" No. 331042; and
WHEREAS, upon conclusion of design, formal competitive
sealed bids will be conducted to procure construction services,
equipment, goods and/or materials, with award to the lowest
responsive and responsible bidder(s) by the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby incorporated by reference
thereto and adopted as if fully set forth in this Section.

Section 2. The City Manager's finding that a valid public
emergency exists justifying the waiver of formal competitive
selection procedures for the Lummus Park Redevelopment Project
(C.I.P. No. 331042) is hereby ratified, approved and confirmed.
Section 3. By an affirmative vote of 4/5ths of the members
of the City Commission, formal competitive selection procedures
for the procurement of professional design services, in the
fields of architecture, engineering and/or landscape architecture
as may be required, for the Lummus Park Redevelopment Project are
hereby waived.
Section 4. The City Manager is hereby authorized to
negotiate and execute the necessary agreement(s)-I/, in a form
acceptable to the City Attorney, for professional design services
required for said Project, with funds therefor hereby allocated
in an amount not to exceed $55,000 from the Lummus Park
Redevelopment Project, C.I.P. Project No. 331042.
Section 5. This Resolution shall become effective
immediately upon its adoption.

ENCLOSURES
It is respectfully recommended that the City Commission adopt the
attached resolution which waives formal competitive selection
procedures for professional design services needed for the
"Lummus Park Redevelopment Project" based on the City Manager's
written finding that a valid public emergency exists justifying
such waiver. The resolution also authorizes the City Manager to
negotiate and execute an agreement with the most qualified
firm(s), and allocates funds in the proposed amount of $55,000
from the Capital Improvement Project (No. 331042) of the same
name.
The Department of Parks and Recreation has prepared the attached
legislation, with assistance from the Department of Public Works.
Over the years, the City Commission has appropriated funds in the
total amount of $677,700 for the redevelopment of Lummus Park in
Downtown, based on a series of community meetings and
recommendations from the City's Community Development and Park
Advisory Boards. These funds include $75,000 in Sunshine State
Revenue Bond Pool monies, $504,800 in Community Development Block
Grant funds and $97,900 in Land and Water Conservation Funds, the
latter of which is a federal grant which the City recently
received through the Florida Department of Natural Resources
(DNR).

A preliminary Master Plan has been developed for the site, which
includes entry and activity plazas, demolition, lighting, site
furnishings, picnic shelters, a playground, fencing, recreation

the Curtis Park Sports Complex, Clemente Park and Williams Park),
sufficient resources do not exist in-house that would enable the
City to complete the project within the time constraints.
Therefore, the City Manager has made a written finding that the
redevelopment of Lummus Park constitutes a valid public emergency
which requires the immediate procurement of the required
professional design services, based on the community's need for
adequate recreational facilities in this depressed area of the
City and on the potential financial detriment to the City if

SUBJECT : Emergency Finding: Waiver
of Competitive Selection
Procedures for

This memorandum serves as the written finding of a valid public
emergency for the Lummus Park Redevelopment Project. This
finding is based upon the following:
* Lummus Park, located in the economically depressed Downtown
Community Development Target area, is a valuable recreational
resource of the City for the benefit of its citizens and
visitors, but requires substantial renovation facilities to
meet the recreational needs of the surrounding community.
* The City has appropriated a total of $677,700 for the
rehabilitation of this Park within its Capital Improvement
Program, and the majority of these funds must be spent within
grant -mandated deadlines.
* Due to failed negotiations with an existing tenant (the
Pioneer Club), to the need for additional funds to complete
the Master Plan improvements which were only recently
received, and to other legal actions related to the homeless
persons in the Park, the City has been unable to begin
substantial renovations until this time.
* Because of the massive number of projects currently under
design in the Public Works Department (such as the Curtis
Park Sports Complex, Clemente Park and Williams Park),
sufficient resources do not exist in-house that would enable
the City to complete the project within the time constraints.
* The experience of the community in this area of the City
demonstrates a critical and immediate need for adequate
leisure activities and recreational opportunities.
By hastening the pace of lengthy competitive selection
processes, these needs can be more expeditiously addressed.
* Adherence to normal competitive selection procedures for this
project would impose a significant hardship on the City and
area residents, deleterious to the health, safety and welfare
I of its citizens and to the convenience of municipal affairs.

Such conditions indicate the need for extraordinary measures to
protect the health, safety and welfare of the community and the
convenience of the City. In order to initiate and complete
improvements in a timely manner, formal competitive selection
procedures shall be waived for the procurement professional
design services in the field(s) of architecture, engineering
and/or landscape architecture, as may be required, pursuant to
Sections 18-52.3(c)(2), 18-52.3(i), and 18-52.6 of the City Code.
