Lin A RESOLUTION RESCINDING RESOLUTION NO. 90-523, AS AMENDED, ADOPTED JULY 12, 1990, WHICH APPROVED THE IMPLEMENTATION OF A PLAN TO INLAY PLAQUES ALONG A PORTION OF THE DEDICATED PUBLIC RIGHT-OF-WAY OF SOUTHWEST EIGHTH STREET BETWEEN SOUTHWEST 12TH AND 17TH AVENUES TO HONOR INTERNATIONAL ARTISTS, SPORTS FIGURES AND OUTSTANDING INDIVIDUALS OF THE LATIN COMMUNITY, THEREBY TERMINATING THE RIGHT AND LICENSE GRANTED TO tATIN STARS, INC. TO INLAY AND MAINTAIN SAID PLAQUES. WHEREAS, Resolution No. 90-523, adopted July 12, 1990, and as amended by Resolution 91-165, adopted February 28, 1991 and further amended by Resolution No. 91-891, adopted December 5, 1991, was adopted by the City Commission to provide for the orderly implementation of a plan to inlay plaques in the sidewalk area of Southwest Eighth Street between Southwest 12th and 17th Avenues to honor international artists, sports figures and { outstanding individuals of the Latin community; and i " WHEREAS, said implementation of a plan was approved by the City Commission conditioned upon prior approval by the City Commission of all "Latin Stars" nominees or repl.aoement of any removed or destroyed plaques before the issuance of plaque permits by the City; and CITY COM-IISSION MEETING OF MAR 1 2 1992 Resolution No. 92-- 184 WHEREAS, Latin Stars, Inc., having been granted the right and license to inlay the aforesaid plaques, continually violates the spirit, intent and direction of Resolution No. 90-523, as i amended, by applying for plaque permits and by holding ceremonies for "Latin Stars" nominees which have not received prior approval by the City Commission; and WHEREAS, pursuant to Motion No. 90-962, adopted December 6, 1990, the City Commission directed the Administration to.obtain a certified audit from Latin Stars, Inc. prior to the approval of future "Latin Stars" nominees; and WHEREAS, following the City Commission's directive the Administration requested Latin Stars, Inc. to provide the City with a certified audit of its finances; and WHEREAS, Latin Stars, Inc. has not only failed to provide said certified audit, but has also failed to seek City Commission approval for "Latin Stars" nominees, thereby breaching the requirements of Resolution No. 90-623, as amended, and Motion No. 90-962; I NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Resolution No. 90-523, as amended, adopted July 12, 1990, is hereby rescinded in its entirety. -2_ ` 9 184 Seotion 3. This Resolution shall become effeotive immediately upon its adoption. Status of "Latin Stars Walk" Program FPGt< . �. P,EFERENCES Cesar H. Odi City Manager ENCLOSURES At the February 18, 1992 City Commission meeting the Administration was instructed to prepare a report regarding the activities of Latin Stars, Inc. and its compliance with various motions, resolutions and other City directives. The following represents a status report of that request. Latin Stars, Inc. has currently placed 18 commemorative plaques in the sidewalk area of S.W. 8 Street between S.W. 12th Avenue and S.W. 17th Avenue honoring international artists, sports figures and outstanding individuals of the Latin community. Sixteen (16) more plaques remain to be installed and the names of those individuals and/or organizations have already been approved by the City Commission. Irregularities in implementing the "Latin Stars Walk" plan continue to jeopardize the program of inlaying these plaques along Calle Ocho. Most recently, on February 15, 1992, Latin Stars, Inc. held a ceremony on S.W. 8 Street to honor an individual whose name will appear on a future sidewalk plaque. This was done prior to City Commission approval of the nominee. This activity is a direct violation of Section 2 of Resolution 90-523 which requires approval of all "Latin Stars" nominees by the City Commission prior to the issuance of a construction permit by the City. Furthermore, it places the City in an awkward and somewhat embarrassing position wherein the City Commission is faced with approving a nominee "after the fact", regardless of that nominee's standing in the community. Other irregularities have occurred as well. Resolution 90-523 was adopted on July 12, 1990 as a direct result of several commemorative plaques having been installed without the necessary approvals from the Administration. In attendance at the July 12th meeting was the president of Latin Stars, Inc. who heard and agreed to the conditions set forth by the City Commission in Resolution 90-523. On February 28, 1991, Resolution 91-165 was adopted which amended Resolution 90-523 to provide that the 92- 184 _ 3�-� submission of nominees' names to the City Commission shall take place no less than 60 days prior to the issuance of permits. This amendment was adopted in response to unnecessary pressure being placed upon the City Commission and Administration by Latin Stars, Inc. to expedite the approval of the inlaying of plaques. In a related issue, Motion 90-962 was adopted on December 6, 1990, directing the Administration to obtain a certified audit from Latin Stars, Inc. as a condition to the approval of one of the nominees. The Department of Public Works has on two separate occasions requested in writing that Latin Stars, Inc. provide the City with a certified audit of the company's finances prepared by a CPA licensed in the State of Florida. As of this date, Latin Stars, Inc. has failed to provide the City with the certified audit and, therefore, the program of inlaying plaques along S.W. 8 Street remains inactive. Attached for your consideration is a proposed resolution which would terminate the involvement of Latin Stars, Inc. in the program to install and maintain decorative plaques along S.W. 8 Street. - 2 - 92- 184
