WHEREAS, the Miami Zoning Board at its meeting of
November 4, 1991, Item No. 2, duly adopted Resolution ZB 77-91 by
a seven to two (7-2) vote, granting a special exception subject
to City Commission approval, as hereinafter set forth; and
WHEREAS, Zoning Ordinance 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, requires City
Commission approval of the special exception as hereinafter set
forth;
WHEREAS, the City Commission after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to
approve the special exception and to affirm the decision of the
Zoning Board;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The decision of the Miami Zoning Board to
grant a special exception from Ordinance No. 11000, as amended,
the Zoning Ordinance of the City of Miami, Florida, Article 4,
Zoning Districts G/I Government and Institutional, entitled
"Conditional Principal Uses: ... (9) Mausoleums, either alone or

in conjunction with a cemetery, only by Special Exception with
City Commission approval ...", to allow the construction of three
Mausoleum Buildings, each being 21 feet and 2 1/2 inches in
height and having a building area of 3,360 square feet, to house
a total of 384 single crypts, as per plans on file, subject to
provision of 1) a sidewalk on Northwest 53rd Avenue from Flagler
Street to 3rd Street and a sidewalk on Northwest 3rd Street from
53rd Avenue to 55th Court, 2) provision of six (6) required
parking spaces, 3) a wrought -iron fence on top of the existing
wall to a total height of eight (8) feet along the Northwest 53rd
Avenue perimeter of the property and the 3rd Street property
line, 4) provision of an eight (8) foot high landscaped buffer
along all of the Northwest 53rd Avenue property line and the 3rd
Street property line, including the planting of trees both inside
and outside of the existing wall, in order to buffer the cemetery
from the adjacent residential area for the property located at
5301 West Flagler Street, Miami, Florida, more particularly
described as Sections 1, 2 and 3, FLAGLER MEMORIAL PARK IN
FLAGLER CEMETERY, as recorded in Plat Book 34 at Page 60 of the
Public Records of Dade County, Florida, and FLAGLER MEMORIAL PARK
SECTION 9, as recorded in Plat Book 46 at Page 18 of the Public
Records of Dade County, Florida, Zoned G/I Government and
Institutional, said special exception having a time limitation of
twelve months in which a building permit must be obtained, is
hereby affirmed and the special exception is hereby granted.

ENCLOSURES: January 23, 1992
At the request of+the City Commission in Motion 91-80, November 14, 1991, the
Planning, 8uildi and Zoning Department sponsored a meeting between the
neighbors and the management of Flagler Memorial Park at 7:00 p.m., Wednesday,
December 11, 1991, at City Hall, 3500 Pan American Drive, Dinner Key. The
purpose of the meeting was an attempt to reach a compromise between the
neighbors and the management of Flagler Memorial Park pertaining to a request
for a special exception (requiring City Commission approval) on the November
14, 1991 agenda (Item PZ-7).

The meeting opened at 7:15 p.m.
Mrs. Dougherty nd the management team 1) explained the status of the
mausoleum now un er construction; and 2) presented their proposal for the new
mausoleum, toget r with those additional restrictions which Flagler Memorial
Park had put for rd pertaining to design, walls and setbacks.
The neighbors col lained that a house on the northeast corner of the property
had been removed and that they had previously been promised a sidewalk on SW
53rd Avenue, which has not been constructed. Representatives of the Cemetery
explained that d molition of the house was necessary to provide the area for
the expansion of the cemetery. The sidewalk is being constructed now and will
be completed sho tly.

worsen and adversely affect the
adjoining neighborhood. The
requested 8' high landscapo buffer
will soften the visual impact of the
proposed 21' high construction of
the adjoining single story
residential area.

At its meeting of November 4, 1991, the
Zoning Board adopted Resolution ZB 77-91
by a 7-2 vote, recommending approval of
the above.
Six OPPONENTS and two PROPONENTS were
present at the meeting.
Three replies AGAINST and one in FAVOR
were received by mail.
CITY COMMISSION At its meeting of November 14, 1991, the
City Commission continued consideration
of the above for staff to meet with
neighbors and applicant.
Note: Staff met with neighbors and
and applicant on 12/11/91.
Conclusion: No agree'ent (see attached
memo).
At its meeting of January 23, 1992, the City
Commission continued the above.
