CITY COMT•2ISSIDAN n!ELTL'1G OF. t- C D 's 1992 o o Aes'ution N. c-1 _ 4 r f, - WHEREAS, the Miami Zoning Board at its meeting of February 10, 1992, Item No. 9, duly adopted Resolution ZB 15-92 by a eight to zero (8-0) vote, granting a special exception as i' hereinafter set forth; and WHEREAS, the proposed grant of the Special Exception herein contemplated requires City Commission Approval, and WHEREAS, the City Commission after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to approve the special exception and to affirm the decision of the Zoning Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Miami Zoning Board to grant a special exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, Schedule of District Regulations, to allow a Community Based Residential Facility for a residential substance and alcohol abuse/homeless facility for the property located at 800 Northwest 28th Street, Miami, Florida, also described as Tract "A" of DADE COUNTY YOUTH HALL TRACT, a subdivision in the West 1/2 of the Northeast 1/4 of the Southeast 1/4 of Section 26, Township 53 South, Range 41 East, Miami, Dade County, i - 2 - Florida, according to the plat thereof recorded in Plat Book 62 at Page 96 of the Public Records of Dade County, Florida, less the West 270.00 feet thereof and less the South 100 feet thereof, containing 2.4 acres more of less; subject to the following conditions: (1) the appropriate parties obtaining all necessary licenses and regulatory permits including but not limited to certification of Better Way by Florida HRS as a substance abuse rehabilitation provider; (2) a long-term lease with the City of Miami; (3) limited to 39 adult males and staff; and (4) submittal of a landscape and site plan within 120 days to be approved by the Planning, Building and Zoning Department; with all exterior improvements to be made in the subsequent twelve months for the following: (A) repair and paint for picnic shelters, sign and bus shelter in courtyard, remove storage shed in Southeast corner of courtyard, (B) remove dumpster in Northeast corner or build CBS screen wall for dumpster location, (C) remove furniture shed in East basketball court, (D) rearrange and restripe for twelve vehicles in Southeast parking lot, Dade County lot does not accommodate arrangement as shown, and (E) resod site; Zoned G/I Government and Institutional; said special exception having a time limitation of twelve months in which a building permit must be obtained, is hereby affirmed and the special exception is hereby granted. IMPROVEMENTS PERMITTEE agrees that no construction, repairs, alterations or improvements may be undertaken upon the AREA unless the plans: A. Be first submitted to the Property and Lease Manager for presentation and review by all departments and offices of the CITY with jurisdiction, and B. Be approved by the City Manager which approval shall not be unreasonably delayed or denied, and C. Be in compliance with all State, Dade County and City of Miami rules and regulations, and any other agency that may have jurisdiction in these matters. ����... PERMITTEE also hereby agrees to pay for and obtain the necessary and applicable permits in compliance with all State, Dade County and City of Miami laws, rules and regulations in connection with any additions, partitions or improvements made by PERMITTEE to the AREA. PERMITTEE shall maintain the AREA in good order and repair at all times, and in an attractive, clean and sanitary condition during the period of this PERMIT, or as long as PERMITTEE continues to enjoy the privilege granted hereunder. 12. CITY'S RIGHT OF ENTRY CITY, or any Hof its properly designated . agents, representatives, or employees, shall have the right to enter the AREA at any time, to examine and/or inspect the same. 13. RISK OF LO$.S • m PERMITTEE shall indemnify and save CITY harmless ag4nstr--a 11 z n risk of loss, injury or damage of any kind or nature wmtsal�r Cz to property now or hereafter placed on or within the AREA and:Jail risk of loss, injury or damage of any kind or nature whatsoQ,J r to the contents of such building or improvements made-_ by l_ PERMITTEE to the structure or structures, or to any* goods, chattels, merchandise or to any other property that may now or hereafter be placed upon the AREA, whether belonging to PERMITTEE or others, whether said loss, injury or damage results from fire, hurricane, rising water or from any other cause or other contingency, and whether the same be caused by the claimed negligence of CITY or any of its employees, agents or otherwise, and shall keep CITY harmless from all claims and suits growing out of any such loss, injury or damage. 14. INDEMNIFICATION AND HOLD HARMLESS PERMITTEE covenants and agrees that it shall indemnify, hold harmless and defend CITY from and against any and all claims, suits, actions, damages or causes of action arising during the period of this PERMIT, for any personal injury, loss of life or damage to property sustained in or on the AREA, by reason of or as a result of PERMITTEE's use or operations thereon, and from and against any orders, judgments, or decrees which may be ,-2 entered thereon, and from and against all costs, attorney's fees, expenses and liabilities incurred in and about the defense of any such claim and the investigation thereof; provided however, that the foregoing indemnification shall not apply if the claims, costs, liabilities, suits, actions, damages or causes of action arise from the sole negligence or willful misconduct of CITY or any of its employees, agents or otherwise. rev >' 15 . General liability insurance on a comprehensive form, or its equivalent, including premises, operations, and contractual coverages with an aggregate limit of at least $500,000 for bodily injury liability and property damage. B. Any other coverage deemed necessary in the course of business including builder's risk for construction and renovations, broad form property coverage in building, fire and extended coverage on a replacement cost basis and worker's compensation as determined by State law. ADVERT,�S ING_ PERMITTEE shall not permit any signs or advertising matter to be placed either in the interior or upon the exterior of the AREA grounds without having first obtained the written approval of the City Manager or his designee. PERMITTEE hereby understands and agrees that the CITY may, at its sale discretion, s erect or place upon the AREA an appropriate sign in cicat;Dng CITY's having issued this PERMIT. cCi� 19. NONDISCRIMINATION T PERMITTEE shall not discriminate against any per-qpns _ 3 account of race, color, sex, religious creed, ancestry, j:Z�tiodal origin, mental or physical handicap, in the use of the AREA and improvements thereon. If PERMITTEE in any manner violates the restrictions and conditions of this PERMIT, then, and in the event,.after ten (10) days written notice given to PERMITTEE by the City Manager within which to cease such violation or to correct such deficiencies, and upon failure of PERMITTEE to do so after such written notice, this PERMIT is hereby revoked automatically without the need for other or further action by CITY. 21. TAXLS During the period of this PERMIT, PERMITTEE shall pay any and all taxes of whatever nature lawfully levied upon or assessed i(.0 U a D. The policy or policies of insurance required shall be ~so written that the policy or policies may not be cancelled or adversely changed without thirty (30) days advance written notice to the City of Miami being delivered to the Insurance Coordinator, Risk Management Office, 174 E. Flagler St., Florida 33131. A current Certificate of Insurance showing the required coverage shall be supplied to the Property and Lease Management Office of the CITY. Insurance policies required above shall be issued by companies authorized to do business under'the laws of the State, with the following qualifications as to management and financial strength: The company must be rated no less than "B" as to management, and no less than "Class C" as to financial strength, in accordance with the latest edition of Best's Key Rating Guile.
