HomeMy WebLinkAboutR-92-0144i J-92-217 2/18/92 RESOLUTION NO. t) - I. 4 A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS OF THE MEMBERS OF THE CITY COMMISSION DECLARING THE DINNER KEY BOATYARD CONTAMINATION CLEANUP A VALID, PUBLIC EMERGENCY; AND FURTHER DIRECTING THE CITY MANAGER TO TAKE THE STEPS NECESSARY TO IMMEDIATELY REMEDIATE FUEL TANKS AND WASTE OIL TANK CONTAMINATION IN A MANNER MOST ADVANTAGEOUS TO THE CITY; ALLOCATING FUNDS FOR THE WASTE OIL TANK REMOVAL AND ASSOCIATED CLEANUP IN AN AMOUNT NOT TO EXCEED $50,000 FROM CAPITAL IMPROVEMENT PROJECT NO. 311009, ENTITLED "UNDERGROUND STORAGE TANK RETROFITTING". WHEREAS, underground petroleum contamination exists on the Dinner Key Boatyard site at two locations; and WHEREAS, on January 23, 1992, the City was served with a "Letter of Demand" by the Dade County Department of Environmental Resources Management (D.E.R.M.) requiring submission of a contamination cleanup schedule and plan for the Dinner Key Boatyard site within 30 days; and WHEREAS, to remove the existing fuel and waste oil tanks, assess and remediate the water and soil contamination in compliance with Federal, State and County regulations the City must procure the services of a certified and licensed underground storage tank and site remediation contractor/consultant; and CITY COP?fNI'IISSION MEE.—MiGi OF FEB 199Z 144 RESOLY7I0N No. WHEREAS, the 1991-9 Capital Improvement Ordinance No. _2 C pi 1 I p 10938, adopted December 5, 1991, appropriated funds for Underground Storage Tank Retrofit, Project 311009, which are available for the removal and contamination cleanup of one waste oil tank; and - WHEREAS, the State of Florida Superact Early Detection Incentive Program has approved reimbursement of funds to a certified and licensed undeground storage tank and site remediation contractor/consultant for the contamination cleanup of the five fuel tanks; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby incorporated by reference herein thereto and adopted/as if fully set forth in this Section. Section 2. By an affirmative vote of 4/5ths, the members of the Commission declare the Dinner Key Boatyard contamination cleanup a valid public emergency. Section 3. The City Manager is hereby directed to take the steps necessary to immediately remove and remediate five (5) fuel tanks and one (1) waste oil tank and associated contamination on the Dinner Key Boatyard site in a manner most advantageous to the City. Section 4. An amount not to exceed $50,000 is hereby allocated for the removal and contamination cleanup of the waste oil tank from Capital Improvement Project No. 3j.1nO9, entitled "Underground Storage Tank Retrofitting". Section 5. This Resolution shall become effective immediately upon its adoption. ^ � J PASSED AND ADOPTED this 18th day Af 1992.
