A RESOLUTION RATIFYING, APPROVING AND CONFIRMING, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, THE ACTION OF THE CITY MANAGER IN FINDING THAT THE REPLACEMENT OF UNDERGROUND CABLE AT THE ORANGE BOWL STADIUM TO BE AN EMERGENCY AND IN AUTHORIZING THE ISSUANCE OF AN EMERGENCY PURCHASE ORDER FOR SUCH SERVICES TO FRANK J. MORAN, INC. FOR THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION AND SOLID WASTE FOR A TOTAL PROPOSED AMOUNT OF $9,706.00; ALLOCATING FUNDS THEREFOR FROM THE 1991-1992 OPERATING BUDGET, ACCOUNT CODE NO. 420401-670. WHEREAS, an electrical problem developed at the Orange Bowl Stadium which consisted of burned -out underground cables at the east end zone; and WHEREAS, this repair is classified as an emergency as it had to be performed as quickly as possible as it was needed to assure that the stadium was ready for the Orange Bowl Classic Football Game and halftime show on January 1, 1992; and WHEREAS, Frank J. Moran, Inc. was performing work at the Orange Bowl Stadium and was asked by the City for a quote for said emergency repair; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the herein replacement of underground cables and has awarded these services to Frank J. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By an affirmative vote of 4/5ths of the Members of the City Commission, after a properly advertised public hearing, the action of the City Manager in making an emergency finding, waiving competitive sealed bids, and authorizing the issuance of an emergency purchase order for the replacement of underground cable at the Orange Bowl Stadium to Frank J. Moran, Inc. for a proposed amount of $9,706.00, is hereby ratified, approved and confirmed, with funds therefor hereby allocated from the 1991-1992 Operating Budget, Account Code No. 420401-670. Odio City Manager ENCLOSURES RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution ratifying, approving, and confirming the award of a contract for the emergency replacement of a burned out underground cable at the Orange Bowl Stadium east end zone to Frank J. Moran, Inc., a non-minority/Local vendor as an emergency action by the City Manager at a total amount of $9,706.00. Funds are available from the Department of General Services Administration and Solid Waste/Property Maintenance Division Account Code No. 420401-670. BACKGROUND The Department of General Services Administration and Solid Waste/Property Maintenance Division discovered a serious electrical malfunction at the Orange Bowl Stadium. A recommendation was made to the City Manager that it would be in the best interest of the City to act quickly in order to assure that the stadium was ready for the Orange Bowl Classic football game and halftime show on January 1, 1992. If this repair would not have been done, it would have been possible that the tower lights, which light the playing field, may not be depended upon to function through the whole game. Frank J. Moran, Inc. was presently doing other work at the Orange Bowl when this emergency occurred and was asked by the City to quote on this emergency repair. The City Manager determined the emergency award of this contract to be an appropriate action. The anticipated costs are $6,925 for the wire including air freight and $2,711 for the labor:, for an estimated total of $9,704.
