RESOLUTION NO.
A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT
AMOUNT, NOT TO EXCEED $15,000,,IN THE CONTRACT BETWEEN
THE CITY OF MIAMI, FLORIDA AND PINO-FONTICIELLA &
ASSOCIATES, INC., DATED JUNE 10, 1991, FROM
$126,625.10 TO $141,625.10, FOR THE CURTIS PARK
REDEVELOPMENT -COURTS PROJECT B-2983-A, CAPITAL
IMPROVEMENT PROJECT NO. 331353, WITH SAID FUNDS TO
BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE
NO. 10938 FROM FUNDS ALREADY APPROPRIATED TO THE
PROJECT; FURTHER RATIFYING THE CITY MANAGER'S
WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED
FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE
OF FOUR -FIFTHS OF THE MEMBERS OF THE CITY
COMMISSION.
. WHEREAS, there exists a contract dated June 10, 1991,
between the City of Miami, Florida and Pino-Fonticiella &
Associates, Inc. for Curtis Park Redevelopment -Courts Project,
Capital Improvement Project No. 331353; and
WHEREAS, an increase in contract not to exceed $15,000 is
required to cover the cost of necessary extra work involving
previously unknown underground utilities and to correct
deteriorated and hazardous surface conditions adjacent to the new

courts; and
WHEREAS, the Director of Public Works, the Director of Parks
and Recreation and the City Manager recommend the increase in
i contract to cover the additional costs; and

WHEREAS, the City tanager has made a written finding that a
valid emergency existed for the work to continue; and

WHEREAS, funds to cover the increase are available from
monies already appropriated to the project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. After a properly advertised Public Hearing, the
findings of the City Manager set forth in the preamble to this
Resolution are hereby ratified by an affirmative vote of four -
fifths of the City Commission, and are hereby incorporated by
reference thereto and adopted as if fully set forth in this
Section.
Section 2. The contract between the City of Miami, Florida
and Pino-Fonticiella & Associates, Inca dated June 10, 1991, for
Curtis Park Redevelopment -Courts Project, Capital Improvement
Project No. 331353, is hereby increased in an amount not to
exceed $15,000, from $126,625.10 to $141,625.10, with funds for
the increase to be provided from monies already appropriated to
the project.
Section 3. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached Resolution authorizing an increase in contract in the
amount not to exceed $15,000 in the contract between the City of
Miami and Pino-Fonticiella & Associates, Inc., from $126,625.10
to $141,625.10, for the Curtis Park Redevelopment - Courts
Project, CIP project no. 331353; and further ratifying the City
Manager's written finding that the increase resulted from
emergency circumstances.
BACKGROUND
The Department of Public Works and the Department of Parks and
Recreation, in an effort to serve all residents of the City of
Miami, have determined that it is now appropriate and in order
for the Commission to authorize an increase in contract for the
Curtis Park Redevelopment -Courts Project and to ratify the City
Manager's emergency finding that allowed construction to continue
on the project.
An increase in contract not to exceed $15,000 is required to
cover the cost of necessary extra work involving previously
unknown underground utilities that were discovered during the
excavation phase of the project. The discovery of these
utilities caused delays and extra expenses for the contractor.
Remedial action was required for construction of the courts to
continue.
Additionally, it was recommended by the Director of Public Works
to correct, as soon as possible, deteriorated and hazardous
surface conditions adjacent to the new courts. These surface
conditions consisted of hazardous sidewalk, curbing and pavement
which endangered the health, safety and welfare of the children
and youth playing in and about Curtis Park. This work was not
included in the original scope of work.

Based on information supplied to me by the Director of the
Department of Public Works, I have found that there exists an
emergency need for an increase in contract amount not to exceed
t15,000 in the contract between the City of Miami, Florida and
Pino-Fonticiella & Associates, Inc. for Curtis Park
Redevelopment - Courts Project, C.I.P. Project No. 331353.
The reasons for the emergency need are as follows:
During clearing and grading operations by the contractor,
additional existing plumbing and electrical lines were discovered
for which the City had no records. These existing facilities
caused delays in the construction and required additional
corrective action on the part of the contractor.
Additionally, the existing sidewalk, pavement and fencing in the
vicinity of the proposed courts were severely deteriorated and in
need of replacement. This work was not included in the original
scope of work. However, the deteriorated condition of these
surface features endangered the health, safety and welfare of
children and youths playing in and about the park.
It has been decided that the most cost effective and expeditious
manner to address all of these problems is to allow the
contractor presently on the project to accomplish the extra work.

the necessary extra work.
As required by City Ordinance, the increase of $15,000 in the
City contract is accompanied by a finding by the City Manager
that the increase resulted from emergency circumstances, an' such
finding has been prepared, signed and is attached.
