A RESOLUTION, BY A 4/5THS AFFIRMATIVE VOTE OF THE MEMBERS OF THE CITY COMMISSION AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING THE CITY MANAGER'S FINDING OF SOLE SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE PURCHASE OF 1,025 FLORIDA LAW ENFORCEMENT HANDBOOKS FROM THE METRO DADE POLICE DEPARTMENT, THE SOLE SOURCE VENDOR FOR THESE HANDBOOKS, AT A PROPOSED COST OF $8,713 FOR THE DEPARTMENT OF POLICE; ALLOCATING FUNDS THEREFOR FROM THE POLICE DEPARTMENT'S GENERAL FUND, INDEX CODE NO. 290201-760; AND AUTHORIZING THE CITY MANAGER TO INSTRUCT THE CHIEF PROCUREMENT OFFICER TO ISSUE A PURCHASE ORDER FOR THESE HANDBOOKS. WHEREAS, the Department of Police is in need of purchasing 1,025 Florida Law Enforcement Handbooks from Metro -Dade Police Department; and WHEREAS, the Department of Police will utilize these handbooks as a valuable tool in assisting police officers who must, on a daily basis, make quick, on -the -spot decisions that could have far reaching effects upon the officer and his or her Department; and WHEREAS, these handbooks are revised every year in order to provide officers with an up-to-date compilation of state statutes and legal guidelines, as amended, and produced following each Florida Legislative session; and CITY COT ni.USSION ME£'i a'r OF F t B 13 1992 RESOLUTION RO. '1 I WHEREAS, funds for this purchase are available in the Police Department's General Fund, Index Code No. 290201-760, in the amount of $8,713; and WHEREAS, the Chief Procurement Officer has adopted a finding wherein Metro -Dade Police Department is the sole source for this purchase; and WHEREAS, the findings of the Chief Procurement Officer have been approved and adopted as the findings of the City Manager; and WHEREAS, the City Manager and the Chief Procurement Officer recommend that the requirement for competitive formal sealed bids be waived and the procurement from Metro -Dade Police Department, as the sole source, be approved; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's written finding that Metro -Dade Police Department is the sole source of supply to the City for furnishing Florida Law Enforcement Handbooks is hereby ratified. Section 3. The requirement for competitive sealed bids is hereby waived and the Department of Police request for the purchase of 1,025 Florida Law Enforcement Handbooks is hereby - 2 - W # approved with funds therefor hereby allocated from the Police Department's General Fund, Index Code No. 290201-760, in the amount of $8,713. Section 4. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this purchase. Section S. ENCLOSURES It is respectfully recommended that a Resolution waiving sealed bids and approving the purchase of 1,025, 1992 Florida Law Enforcement Handbooks, at a cost of $8,713, be approved. i BACKGROUND: Police officers for the City of Miami Police Department are required to make on -the -spot decisions regarding the legality of a person's actions on a routine basis. One of the officers' best references in these instances are the Florida Law Enforcement Handbooks. Metro Dade Police Department currently holds the copyright on these handbooks. It is, therefore, recommended that the Resolution waiving sealed bids and authorizing the purchase of 1,025, 1992 Florida Law Enforcement Handbooks, in the amount of $8,713, funding to be provided from the Police Department General Fund, Index Code 290201-760, be approved. The total cost associated with this purchase is estimated to be in the amount of $8,713.00 for this year. Funds for this purchase are available in the 1991-92 Operating Budget, Account Code No. 290201-760. Future purchases will be subject to the availability of funds.
