A RESOLUTION DIRECTING THE CITY MANAGER TO
CONTACT METRO-DADE COUNTY TO REQUEST THAT
PHASE II OF THE CITY -COUNTY HOMELESS
ASSISTANCE PROGRAM BE EXPANDED TO INCORPORATE
AND FUND THE DOWNTOWN DEVELOPMENT AUTHORITY
("DDA") "PILOT" HOMELESS ASSISTANCE PROGRAM
THROUGH FISCAL YEAR 1991-1992; DIRECTING THAT
FUNDING PROVIDED BY THE DDA PURSUANT TO
ORDINANCE NO. 10944 BE UTILIZED FOR THIS
PURPOSE CONTINGENT UPON AND SUBJECT TO THE
PROVISION OF SERVICES TO THE ONE HUNDRED
TWENTY-SIX (126) PEOPLE ORIGINALLY DESIGNATED
FOR SERVICES UNDER THE CITY -COUNTY PHASE II
HOMELESS ASSISTANCE PROGRAM ("PROGRAM") AS
PER STIPULATIONS OF THE COURT ORDER BY JUDGE
ATKINS DATED JANUARY 16, 1992; FURTHER
AGREEING THAT THE DDA CONTINUE ITS "PILOT"
PROGRAM UTILIZING AVAILABLE FUNDS PROVIDED BY
THE DDA TO SAID CITY -COUNTY PROGRAM; AND THAT
THE DDA ADMINISTER ITS PILOT PROGRAM IN
CONJUNCTION WITH THE CITY -COUNTY PHASE II
PROGRAM.
WHEREAS, the City of Miami has entered into an agreement
with Metro -Dade County to provide assistance to the approximately
one hundred twenty-six (126) homeless individuals in Lummus Park
and under the I-395 Expressway; and
WHEREAS, the Miami City Commission on January 23, 1992,
approved Emergency Ordinance No. 10944 appropriating Two Hundred
Fifty Thousand Dollars ($250,000) for the City of Miami/Metro-
Dade County Homeless Assistance Program which allocated One
Hundred Thousand Dollars ($100,000) from the DDA subject to
approval of the DDA Board of Directors; and

RESOLUTION Na,
WHEREAS, the Miami City Commission adopted Motion No. 91-913
approving a sixty (60) day Homeless Pilot Project and the
allocation of Thirty Thousand Dollars ($30,000) for said project;
and
WHEREAS, the DDA Board of Directors passed Resolution
No. 4/92 allocating Ninety -Five Thousand Dollars ($95,000) to the
City/County Homeless Assistance Program with the provision that
DDA retain oversight over expenditure of said funds; and
WHEREAS, the DDA "Pilot" Homeless Assistance Program has
been an effective tool in providing services to the Downtown
homeless community; and
WHEREAS, adequate funds may be available from City/County
contributions, without the DDA appropriation of Ninety -Five
Thousand Dollars ($95,000), to provide services to the one
hundred twenty-six (126) homeless identified and included in
Judge Atkin's Court Order of January 16, 1992;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby directed to contact
Metro -Dade County to request that Phase II of the City -County
Homeless Assistance Program be expanded to include the DDA's
"Pilot" Homeless Assistance Program ("DDA Program"), and that
said DDA Program be funded, as provided in Section 3 below, as an

integral part of said City/County Phase II Homeless Assistance
Program contingent upon and subject to services being provided to
the one hundred twenty-six (126) individuals as directed by Judge
Atkin's Court Order of January 16, 1992.
Section 3. The City Commission agrees that DDA should
continue its "Pilot" program utilizing funds provided by the DDA
to the City/County Phase II Homeless Assistance Program pursuant
to Ordinance No. 10944.
Section 4. The City Commission further agrees that DDA
should administer said "Pilot" program in conjunction with the
City/County Phase II Homeless Assistance Program pending County
approval.
Section 5. This Resolution shall become effective
immediately upon its adoption.

At its Emergency Meeting on _January 30J 1992i_the Board of
Directors~ of the Downtown DeveloTment___Authority ra.p)roved
Resolution No. 4/92 authorizing the sum of $95,000 be paid to the
City of Miami_for_the Homeless Assistance Program (See Attachment
"An).
With the passage of Resolution No. 4/92, the DDA makes available
$95,000 from its Fiscal Year 1992 Budget for the continuation of
the Homeless Outreach Project, requests that the Project be
expanded to include and fund the DDA Homeless Pilot Project
through September 30, 1992, insists on oversight regarding
expenditures and operation of said program and requests
authorization of a loan of up to $160,000 to cover potential
budget shortfalls that may arise with the reduction of budget
reserves resulting from funding reallocations requested by the
City Commission.
BACKGROUND
With approval of the DDA Fiscal Year 1991-1992 Budget and
Appropriations Ordinance, the City of Miami Commission passed: A
MOTION DIRECTING THE DOWNTOWN DEVELOPMENT AUTHORITY TO EXPEND 10%
OF ITS BUDGET ON THE HOMELESS ISSUE; FURTHER CLARIFYING
COMMISSION WOULD RETAIN FINAL APPROVAL AS TO DISBURSEMENT OF SAID
FUNDS,

The DDA contribution of $95,000 for the continuation of the
Homeless Assistance Program represents the remaining balance of
the $150,000 (10% of the DDA Budget for FY'92) requested by the
City Commission. It should also be noted that the DDA has
already expended an additional $20,000, above the 10%, in related
costs directly attributable to the Homeless Issue.
The DDA has, historically, been behind efforts to address the
Homeless problem in Downtown Miami. The DDA Budget for FY'91
included in excess of $25,000 to fund 50% of Livia Garcia's
salary as Homeless Coordinator; the DDA funded an equal amount in
FY' 9 2 .
In December, the DDA brought before the City Commission a
proposal for a "Homeless Pilot Program" for approval. The
program was developed to deal with the chronic Homeless that have
been negatively impacting the operations of businesses within the
Downtown Core. The DDA budgeted $30,000 for the 60 day program
which was approved by City Commission Motion 11-91-913; subject to
the DDA's coming back with a progress report on the success or
failure of its efforts.
To date, the program has exceeded expectations and the response
from the local business community has been extremely positive.
Enclosed please find a progress report on the program summarizing
accomplishments, to date, a letter from one Downtown businessman
representative of the general response from the retail community
and a motion from the Downtown Miami Business Association
requesting continuation of the program (See Attachment "B").
It had always been the intention of the DDA to continue the
Downtown Assistance Program if proved successful. The balance of
funds allocated under the directive of the City Commission were
to have been earmarked for this eventuality. With the success of
the program, so far, the DDA Board of Directors have expressed
the desire to have it continue and are concerned that the
progress made will be jeopardized due to lack of funding.
With this objective in mind, the Board of Directors of the
Downtown Development Authority requests that the Miami City
Commission include the Downtown Assistance Program as an integral
part of the Homeless Assistance Program for the I-395 and Lummus
Park areas. The DDA also requests that it retain oversight over
expenditure of these funds to ensure that the program addresses
the most critical aspects of the Downtown Homeless problem; those
issues significantly impacting the Downtown economy.

The DDA has a current fund balance of $160,000, $75,000 of which
is in the form of a loan to the City of Miami payable in November
1992, leaving an actual cash balance of $85,000. To meet the
City Commission's directive, the DDA Board of Directors has
authorized the reallocation of this $85,000.
To expedite completion of the Challenger 7 Memorial, the DDA
passed Resolution 91-43 authorizing a loan to the New World
Center Foundation in the amount of $50,000. This loan would be
secured by the donation of Ms. Lamar Louise Curry; to be held in
escrow until completion of the Memorial. To date, the loan has
not been executed. These funds were to be utilized in
conjunction with the proposed $100,000 donation from the Hispanic
American Builders Association (HABA) to complete the Memorial.
Considering the above, the actual un-encumbered cash reserve is
$35,000. To ensure DDA operations through F Y ' 9 2 , to cover
financial obligations and as protection against potential tax
shortfalls, the DDA respectfully requests approval of a transfer
of funds in the amount of $160,000 from the General Fund to be
repaid by the end of FY'92 out of ad valorem taxes received from
Metro -Dade County by the City of Miami on behalf of the DDA. The
request is being made in the event the DDA incurs cash flow
problems before the end of the fiscal year (See Attachment "C").
The DDA and its Board of Directors are committed to any and a 11
efforts that would alleviate the Homeless problem in Downtown
Miami. The DDA supports the City Commission in its actions
regarding the Homeless problem and will continue to work with the
Commission to help those citizens of the City of Miami who are in
desperate need of assistance.

A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE
CITY OF MIAMI, FLORIDA, ALLOCATING $95,000 FROM
FY'91-92 BUDGET FOR THE MITIGATION OF THE HOMELESS
PROBLEM IN DOWNTOWN MIAMI, MAKING SAID FUNDS
AVAILABLE TO THE CITY OF MIAMI/DADE COUNTY HOMELESS
OUTREACH PROJECT, EXPANDING PROJECT TO INCORPORATE
AND FUND THE CONTINUATION OF THE DDA "PILOT PROGRAM"
THROUGH FY'92, INSISTING THAT DDA BE CONSULTED ON
EXPENDING OF FUNDS AND RETAIN OVERSIGHT POWERS, AND
REQUESTING A LOAN OF UP TO $160,000 TO COVER POTENTIAL
DDA BUDGETING SHORTAGES.
WHEREAS, the Board of Directors of the Downtown Development
Authority has acknowledged that the homeless problem within Downtown
Miami has reached crisis proportions; and
WHEREAS, the Miami City Commission approved Motion M-91-689
directing the DDA to expend 10% of its budget on the homeless issue and
retaining final approval as to the disbursement of said funds; and
WHEREAS, the Miami City Commission approved Ordinance No.
10922, approving the appropriations of the DDA budget including the
$25,000 for the services of the City of Miami Homeless Coordinator and
the expenditure of an additional $15,000 of indirect costs allocated to
the position; and
WHEREAS, the Miami City Commission approved Motion M-91-913
which approved a 60-Day Homeless Pilot Project and the allocation ,of
$30,000 for said project; and
WHEREAS, the Miami City Commission approved Emergency
Ordinance No. 10944 appropriating $250,000 for the City of Miami/Dade
County Homeless Assistance Program which allocated $100,000 from the

DDA subject to DDA Board approval; and

WHEREAS, the Executive Board of the DDA is concerned that
funding provided to homeless assistance by the DDA be utilized in a
manner that will be most beneficial to alleviate the problem of the
homeless within the Downtown core which is not being addressed by
existing programs in the community; and
WHEREAS, the DDA has the fiduciary responsibility to manage
the expenditure of funds generated from the DDA Special Taxing District
to ensure that they will meet the objectives of the DDA as delineated
in the Charter and Code of the City of Miami; and
WHEREAS, insufficient funding may be available for the
operations of the DDA in FY'92 due to actions of the City of Miami
Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA:
Section 1. DDA will make available to the City of Miami/Dade
County Homeless Outreach Project the sum of $95,000 from the FY'91-92
DDA Budget.
Section 2. DDA requests that the City of Miami/Dade County
Homeless Outreach Project be expanded to incorporate and fund, at
current level, the DDA Homeless Pilot Project through September 30,
1992.
Section 3. DDA insists on being considered as regards
expenditure of said funds provided; and requests oversight powers
concerning the operation of said program.
Section 4.. That DDA requests the City Commission authorize a
loan of up to $160,000 in FY'92 to cover potential budget shortfalls
that may arise due to the reduction of the FY'92 budget reserves
resulting from the $75,000 loan to the City homeless Project and other
funding reallocations requested by the City Commission.

THE AMOUNT OF ONE HUNDRED SIXTY THOUSAND DOLLARS
($160,000) TO THE DOWNTOWN DEVELOPMENT AUTHORITY
IN THE EVENT THAT, AFTER EXPENDITURE OF AVAILABLE
FUNDS, TAX COLLECTION SHORTFALLS JEOPARDIZF THE
ABILITY OF THE DOWNTOWN DEVELOPMENT AUTHORITY TO

funds in the amount of One Hundred Sixty Thousand Dollars
($160,000) if after expenditure of available funds, tax
collection shortfalls jeopardize the ability of the DDA to
continue operations and meet its financial obligations; and

WHEREAS, it is anticipated that ad valorem taxes for the DDA
will amount to approximately One Million Four Hundred Ninety -One
Thousand Five Hundred Dollars ($1,491,500) in Fiscal Year 1991-
1992; and

OF MIAMI, FLORIDA:

Year 1991-1992, as an advance payment of ad valorem tax proceeds
is hereby authorized with said sum to be repaid before the end of
the 1991-1992 Fiscal Year out of ad valorem taxes received from
Metro -Dade County by the City of Miami on behalf of the DDA with
interest to be paid to the City of Miami at the rate of six
percent (6%) per annum.
Section 3. This Resolution shall become effective
immediately upon it adoption.
