( `7 13 A RESOLUTION APPOINTING AND REAPPOINTING INDIVIDUALS AS CITY OF MIAMI REPRESENTATIVES ON THE METRO DADE COUNTY BISCAYNE BAY SHORELINE DEVELOPMENT REVIEW COMMITTEE AND DIRECTING TRANSMISSION OF THIS RESOLUTION TO METRO DADE COUNTY AGENCIES. WHEREAS, Sections 33D-31 through 34 of the Code of Metropolitan Dade County established the Biscayne Bay Shoreline Development Review Committee ("Committee"); and WHEREAS, the Committee is comprised of seven recognized professional architects, landscape architects or urban designers appointed by the Dade County Commission for the purpose of reviewing and making recommendations on projects and plans proposed on the shoreline of Biscayne Bay and adjacent uplands, and extending generally to the first paralleling arterial roadway; and WHEREAS, Section 33D-33 of the Dade County Code allows the City of Miami to appoint two additional representatives, who are recognized professionally in the fields of architecture, landscape architecture and/or urban design, to be added to the Committee as full voting members when projects are proposed for real property lying boundaries within the boundaries of the City of Miami; and CITY CONI PT-USSION MEETING OF 1� •ice F E B 13 1992 IIJ MOLUT1014 fto. WHEREAS, a vacancy has occurred by reason of the untimely death of Edward C. Wright, who was appointed to the Committee by the City Commission in 1985; and WHEREAS, it is now in order for the City Commission to make an appointment to fill this vacancy; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Daniel Perez-Zarraga, AIA, a professional architect, is hereby appointed, for a term of six years, expiring February 13, 1998, as an additional City of Miami representative on the Metro Dade County Biscayne Bay Shoreline Development Review Committee, to serve in those instances in which plans and projects involve real property lying within the boundaries of the City of Miami. Section 3. Jose Feito, FAIA, a professional architect, is hereby reappointed, for a term of three years, expiring February 13, 1995, as a City of Miami Representative on the Metro Dade County Biscayne Bay Shoreline Development Review Committee, to serve in those instances in which plans and projects involve real property lying within the boundaries of the City of Miami.. Section 4. The City Manager is hereby directed to forward copies of this Resolution to the County Manager, County Clerk, and the Chairman, Metro Dade County Biscayne Bay Shoreline Development Review Committee. Odio REFERENCES: Development Review Committee City Manager ENCLOSURES: Agenda Item: City Commission Meeting of February 13, 1992 RECOMMENDATION It is recommended that the Commission architect, landscape architect or urban Miami representative to fill a vacancy o Shoreline Development Review Committee, Commission should also specify terms of years for this appointment and three years BACKGROUND n appoint a recognized professional designer as an additional City of the Metro Dade County Biscayne Bay per the attached resolution. The appointment; staggered terms of six for the incumbent are recommended. The Chairman of the Metro Dade County Biscayne Bay Shoreline Development Review Committee has requested the Planning, Building and Zoning Department to facilitate this appointment, citing the untimely death of Edward C. Wright, architect, the former incumbent. (See attachment). In 1985, per Section 33D-31 through 34 of the Metro Dade County Code, the Board of County Commissioners (BCC) established and appointed the Biscayne Bay Shoreline Development Review Committee, comprised of five professionals and two lay citizens. The purpose of the Committee is to review and make recommendations to municipalities on projects and plans proposed on the shoreline of Biscayne Bay and upland property extending generally to the first paralleling arterial roadway. The Committee can also, through an appeal procedure to the BCC, seek compliance with their recommendations. In addition to the standing Committee, shoreline municipalities may appoint two additional professional representatives, who are added to the composition of the committee, when projects are proposed which lie within the boundaries of the municipality. The last City appointments made in 1985 were made collegially by the Commission, no terms of office were established. (See Resolution 85-789, July 18, 1985, attached). The Law Department has recommended that terms of office be established. Staggered terms of six years are recommended for this appointment and by reappointment, three years are recommended for the current incumbent, Jose Feito. Although Section 33D-33 of the Dade County Code provides, inter alia, that the term of office of the City's representative "shall be determined at the discretion of the (City of Miami)," said section also provides that: _ Said appointments may be for a specified term or may be limited to a single development, action or plan. Further, the word "term" specifically is defined in law as a fixed and definite period of time. Although the County left the term of office to the discretion of the City, it is clear from the text of the subject section that it was never intended that the City's representatives terms would last for an indefinite period of time but would, as the section indicates, be for a time or event certain period. Thus, the term of office of all appointees under section 33D-33 should be limited in such a manner as to conclude on a certain date or upon conclusion of the review of a specific application or plan. I have revised the proposed resolution to reflect this requirement along with a provision which would reappoint Jose Feito (if he is the City Commission's choice) for a term specific. The terms of Mr. Feito as the reappointee and the yet unnamed new appointee have left blank on the revised resolution for your recommendations.
