A RESOLUTION BY A 4/6THS AFFIRMATIVE VOTE OF
THE MEMBERS OF THE CITY COMMISSION AFTER A
DULY ADVERTISED PUBLIC HEARING, RATIFYING,
CONFIRMING AND APPROVING THE CITY MANAGER'S
EMERGENCY FINDING; WAIVING FORMAL COMPETITIVE
SEALED BID PROCEDURES AND APPROVING THE
OBTAINING OF INFORMAL QUOTES FOR THE
REBUILDING OF THE ORANGE BOWL STADIUM FIELD
AND THE ISSUANCE OF A PURCHASE ORDER FOR THIS
CONTRACTUAL SERVICES TO RECIO & ASSOCIATES,
INC., AT A PROPOSED COST NOT TO EXCEED
$80,380.00; ALLOCATING FUNDS THEREFOR FROM
THE ENTERPRISE FUND ACCOUNT CODE NO. 350503-
340, PROJECT NO. 415000.
WHEREAS, on November 13, 1991, bids were received for the
rebuilding of the Orange Bowl field and after evaluation by the
Department of Conferences, Conventions and Public Facilities in
conjunction with the Chief Procurement Officer, it was determined
that none of the bidders met the basic bid requirements resulting
in the City Manager rejecting all bids due to the non -
responsiveness of all bidders; and
WHEREAS, scheduled games to be held at the Orange Bowl by
the Miami Freedom Soccer Team and the Processional Spring
Football League require that the field be ready for use no later
than mid -March of 1992 therefore, requiring contractual work for
the rebuilding of the field to be completed on or before
March 1, 1992; and

WHEREAS, these games and additional events scheduled at the
Orange Bowl preolude the rebuilding of the field prior to
August 20, 1992, the date by which the City is committed to the
University of Miami and the Orange Bowl Committee to complete the
( refurbishing of the Orange Bowl Stadium in its entirety; and
WHEREAS, since the time needed to rebid this work would be
approximately two months and thus, would not allow the City
sufficient time to complete the project prior to March 1, 1992,
it became critically necessary that an emergency be declared and
that formal bidding procedures be waived in accordance with
Section 18-52.8 of the City Code in order that City may proceed
to immediately prooure these much needed services and to have the
field in prime condition for the spring season; and
WHEREAS, the City Manager has made a written finding of an
emergency which allows the waiving of formal competitive sealed
bids and has obtained informal quotes in accordance with the
City's specifications and requirements; and
WHEREAS, these contractual services are to be awarded to
Recio & Associates, Inc. at a proposed amount not to exceed
$80,380.00 which services are the most advantageous to the City;
and
WHEREAS, funds for these services are available from
a

- NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this

Section 2. By affirmative vote of 4/5ths of the Members of

s; the City Commission, after a properly advertised public hearing,
the action of the City Manager in making an emergency finding,
waiving competitive sealed bids, obtaining informal quotes, and
authorizing the issuance of an emergency purchase order for
contractual services to rebuild the Orange Bowl field to Reoio &
Associates, Inc. in accordance with City's specifications and
requirements at a proposed amount not to exceed $80,380.00 is
hereby ratified, approved and confirmed, with funding therefor
hereby allocated from the Enterprise Fund Operating Budget,
Account Code No. 350503-340, Project No. 415000.
Section 3. This Resolution shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached resolution ratifying, approving, and confirming the
action of the City Manager in making an emergency finding,
waiving of formal competitive sealed bids, obtaining informal
quotes, and authorizing the issuance of an emergency purchase
order for contractual services to rebuild the Orange Bowl field
in Accordance with City's specifications and requirements. The
total cost associated with this purchase will not exceed
$86,563.00; which funds are available from the Enterprise Fund,
Account Code No. 350503-340.

Emergency Finding for
the Rebuilding of the
Orange Bowl field
On November 13, 1991, bids were received for the rebuilding of
the Orange Bowl field, Bid No. 91-92-008.
After the initial evaluation the department in conjunction with
the Chief Procurement Officer determined that none of the bidders
met the basic bid requirements. Due to time constraints involved
in completing the project, the department thru the Chief
Procurement Officer subsequently requested from all affected
vendors required information that had been omitted from the
original bid documents.
