A RESOLUTION, APPROVING THE CHIEF
PROCUREMENT OFFICER'S DECISION TO
REJECT THE PROTEST RECEIVED FROM SAC
CONSTRUCTION COMPANY, INC., IN
CONNECTION WITH BID NO. 91-92-026,
ORANGE BOWL STADIUM MODERNIZATION,
PHASE II, ASBESTOS CONTAINING MATERIALS
REMOVAL, AS IT HAS BEEN DETERMINED TO
BE WITHOUT MERIT.
WHEREAS, in December, 1991, the City of Miami advertised for
bids in connection with the Orange Bowl Stadium Modernization,
Phase II, Asbestos Containing Materials Removal project;
WHEREAS, the City received several responses to this bid,
and, after the bids were tabulated, Kimmins Abatement, the lowest
bidder, withdrew its bid; and
WHEREAS, the Public Works Department determined that the
next, lowest responsible
Development Group, Inc.; and
and responsive bidder was Project
WHEREAS, on January 6, 1992, the City of Miami received a
protest from SAC Construction Company, Inc., which raised several
issues concerning the appropriate trade license for the project
and Project Development Group, Inc.'s alleged failure to complete
certain bid documents; and
WHEREAS, pursuant to Section 18-56.1 of the City Code, the
Chief Procurement Officer, in her role as arbiter, fully
investigated the matter; and

WHEREAS, the Chief Procurement Officer determined that SAC
Construction Company, Inc.'s grounds for protest were unfounded
and determined that the protest was without merit and has
rejected the protest; and
WHEREAS, the City Manager and the City Attorney concur with
and approve the finding of the Chief Procurement Officer and
recommend rejection of the protest filed by SAC Construction
Company, Inc.;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. . The Chief Procurement Officer's decision to
reject the protest received from SAC Construction Company, Inc.,
in connection with the Orange Bowl Stadium Modernization, Phase
II, Asbestos Containing Materials Removal project, is hereby
approved.

It is respectfully recommended that the City Commission adopt the
attached resolution approving the Chief Procurement Officer's
decision to reject the protest from SAC Construction Company,
Inc., in reference to the removal of asbestos containing
materials at the Orange Bowl Stadium.
On January 6, 1992, a protest was received from SAC Construction
Company, Inc. relative to the above noted bid. In the protest
letter the firm alleged that it was the lowest qualified
responsive bidder because the project required a demolition
license and the apparent low bidders failed to meet this and
other requirements called for in the bid specifications.
Pursuant to Section 18-56.1 of the City Code, the Chief
Procurement Officer fully investigated the matter and determined
that the protest lacked merit, and has, therefore, rejected the
protest.

Dear Mr. Jamme:
I, as Chief Procurement Officer of the City of Miami, have read
your protest dated December 11, 1991, reviewed pertinent
documents and talked with employees, pursuant to my duties under
Section 18-56.1, City of Miami Code, Resolution of Protest
Solicitations and Awards. Your allegations are summarized below:
1. Kimmins Abatement does not have a Certificate of
Competency for demolition and failed to provide
proper documentation with their bid.
2. Project Development Group, Inc. failed to include
a Certificate of Competency for demolition, a
Corporate Resolution and an Oath of Allegiance
with their bid.
3. Project Development Group, Inc. failed to comply
with Ordinance No. 10062.
After considerable research, I have determined the following:
Response to Issue #1
This issue is moot because Kimmins Abatement withdrew their bid
on January 6, 1992.
Response to Issue #2
Section 3, Chapter 455.302 of the Florida Statutes states that
,no person shall conduct abatement work unless ... he is licensed
as an asbestos contractor.' Predicated upon this State
requirement, City staff proceeded to classify the project under
the 'asbestos abatement' trade category and advertised it as
such. In addition, Law Engineering, the City's licensed asbestos
consultant, was engaged to do the asbestos surveying in the
Orange Bowl Modernization project. This firm, in addition to
preparing the technical specifications for the bid, confirms that

a licensed asbestos abatement contractor should be used for the
project, since the work to be done is the removal of asbestos -
containing form boards from the concrete bleachers, located in
specific sections of the Stadium.
In the "Instruction to Bidders", Paragraph 2, bidders were
required to submit a valid Certificate of Competency issued by
Metro Dade County for the appropriate trade. In my
determination, the appropriate trade is asbestos abatement, based
Oil the language used throughout the bid specifications:
Paragraphs 1 and 2 of the advertisement for bids call for removal
of asbestos containing materials; pages 3 and 4 of the price
proposal forms are structured on the removal of specific
quantities of asbestos material; Section 00803, page 2 of the
Supplementary Conditions describes the work as asbestos removal;
the same is reiterated in the "Summary of Work," Section 02080,
Hazardous Material Abatement; and the qualifications of that same
section requires that the contractor or subcontractor be a
licensed asbestos abatement contractor. The City, therefore,
appropriately let the contract out for asbestos abatement.
Any other trade requirements for the work, including demolition,
are considered incidental for the completion of this project, as
substantiated by Law Engineering. Therefore, your reference to
compliance with Metropolitan Dade County Code and the South
Florida Building Code's requirements for performing demolition
work are not applicable in this instance.
Project Development Group, Inc.'s bid contained a copy of its
state asbestos contractor's license, Certificate #CJC046273, and
a copy of its Certificate of Registration issued by Metro Dade
County for asbestos abatement. These are the trade licenses
necessary to undertake the project.
In addition, the Oath of Allegiance and- Corporate Resolution,
along with the sample contract, are not part of the bid documents
but rather part of the Agreement Forms and are not meant to be
submitted with bid documents. It is required that they be signed
after an award has been made. Paragraph 12, Instruction to
Bidders, is clearly directed to the 'successful bidder,' who is
selected for award after all bids are received tabulated and
approved by the City Commission.
Response to Issue #3
Ordinance No. 10062 accompanies all bids and is designed to
encourage the participation of minority/women owned firms in the
City's open competitive bidding process. However, the City does

not prohibit nor preclude non -minority owned firms from
participating in competitive bids, as long as they are qualified
to perform the work, meet all the bid specification requirements,
and are the lowest responsive and responsible bidder.
Minority/women set aside projects are the only cases where
compliance with Ordinance No. 10062 is mandatory.
In conclusion, I have determined that Project Development Group,
Inc. met all the specification requirements and is the lowest
responsive and responsible bidder. Therefore, based on the
above, your protest is deemed without merit and is rejected. The
City Manager and the City Attorney both concur with my decision
to reject your protest.
The protest is scheduled to be heard by the City Commission at
its January 23, 1992 meeting, beginning at 9:00 am. The meeting
is held in the City Commission Chambers, City Hall, 3500 Pan
American Drive, Miami.

Dear Ms. Carter:
In accordance with Article 14, Page 5, of the instructions to bidders for the above
referenced project, we hereby protest the bid submittals made by the first two apparent
low bidders, Kimmins Abatement and Project Development Group, Inc. We request that
their bids be declared non -responsive and that the awared be made to SAC Construction
Company, Inc., the lowest qualified responsive bidder.
Kimmins Abatement, a Tampa based company, does not hold a valid Certificate of Compen-
tency in Dade County to do demolition work as per Chapter 10 of the Contractors Code
of Metropolitan Dade County,& as per the South Florida Building Code, Chapters 2, 3,
and 33. They also failed to provide required documentation with their bid, such as
copies of appropriate licenses, Corporate Resolution, Oath of Allegiance, Sworn State-
ment on Public Entity Crimes, and failed to name any minority vendor on page 6 of the
proposal and thus failed to comply with Ordinance No. 10062. In addition, they used
the seal of another corporation, Kimmins Recycling Corporation, in at least two places
where they had to affix the bidders own corporate seal.
Project Development Group, Inc., an out of state firm, did not include a copy of a valid
Certificate of Compentency to do demolition work in Dade County nor do they have one as
per Article 2 of the Instructions to Bidders. This project requires substantial demo-
lition work and usage of large cranes and other heavy equipment. This is also in vio-
lation of Section 10-3 of the Code of Metropolitan Dade County and the South Florida
Building Code, Chapters 2, 3, and 33. They also failed to include the Corporate Resol-
ution and Oatl; of Allegiance with their bid. They did not name any minority vendors on
page 6 of the proposal and thus failed to comply with Ordinance No. 10062 although they
acknowledged and notarized page 00330 named "Statement of Compliance with Ordinance
No. 10062
SAC Construction Company, Inc., a local firm, is the lowest responsive bidder that meets
all the standards set forth in the bid documents and has submitted all required document-
ation.to support same. In addition, we listed and will use MCO Environmental, Inc., a
local minority owned and operated firm with previous Orange Bowl experience, as a sub-
contractor doing a very substantial part of the work, thus complying with the intentions
of the City of Miami and Ordinance No. 10062 in the utilization of minority vendors.

Dear Ms. Carter:
This law firm represents SAC Construction Company, Inc. ("SAC")
regarding the bid procedure on the above referenced project. SAC
is a prospective contractual party who feels aggrieved in
connection with the solicitation of award of the Contract for this
project as described in Article 14, Page 5 of the City's
Instructions to Bidders ("Instructions"). In compliance with those
instructions, SAC hand -delivered to you on January 6, 1992, a
written protest. This protest was submitted within 14 days after
SAC knew or should have known of the facts giving rise to the
action of which it complains. A copy of written protest is
attached hereto as Appendix "A".
As you are aware, SAC was the number three low bidder on this
project with Kimmins Abatement Corporation ("Kimmins") and Project
Development Group, Inc. ("PDG") providing lower bids. However, a
review of the bid documents and the licensing records leads us to
believe that Kimmins and PDG are not the lowest responsive,
responsible bidders. Rather, SAC is the lowest responsive,
responsible bidder.
Kimmins, a Tampa based company, does not hold a valid certificate
of competency of Dade County to do demolition work as described in
Chapter 10 "Contractors" Code of Metropolitan Dade County, Florida
(1989) and as provided for in the South Florida Building Code,
Chapters 2, 3, and 33. Demolition constitutes a significant
portion of the work necessary to be performed on this project and
is not nearly incidental to the removal of asbestos. Additionally,

Kimmins did not provide the documentation required by Article 2 of
the City's Instructions to Bidders. In particular, Kimmins did not
provide copies of appropriate licenses, appropriately sealed
Corporate Resolution, Oath of Allegiance and Sworn Statement on
public entity crimes. Kimmins further failed to name any minority
vendor as required by Ordinance No. 10062.
PDG, an out of state firm, also did not include with its bid
proposal a valid Certificate of Competency to do demolition work in
Dade County. It is our understanding and belief that PDG does not
have such a Certificate as required by Article 2 of the
Instructions to Bidders. As stated earlier, this project requires
substantial demolition work and usage of large cranes and other
heavy equipment. The code of Metropolitan Dade County, Section 10-
3, and the South Florida Building Code, Chapters 2, 3 and 33,
require special licensing and a Certificate of Competency to do the
type of demolition work required for this project. In addition to
these violations, it is our understanding and belief that PDG
failed to include the Corporate Resolution and Oath of Allegiance
with their bid and did not name any minority vendors on page 6 of
proposal as required by Ordinance No. 10062.
In start contrast to Kimmins and PDG, SAC, a local firm, can meet
all of the standards set forth in the bid documents and has
submitted all required documentation to support its bid. In
addition, SAC listed and will use NCO Environmental, Inc. ("MCO"),
a local minority owned and operated firm with previous Orange Bowl
experience as a subcontractor doing a substantial part of the work.
This use complies with the letter and intent of Ordinance No. 10062
in the utilization of minority vendors.
Article 14 of the City's Instructions to Bidders provides that once
SAC has made a timely protest, the Chief Procurement Officer shall
make a decision as to the validity of the protest and submit her
decision to the City Commission within 30 days after receipt of the
protest. (City Code Section 18-56.1.1) Unless the awarding of this
contract is delayed until after the resolution of this protest,
irreparable harm will be done to SAC and its minority
subcontractors, including NCO. For that reason, SAC specifically
requests that the award of this contract be delayed until after a
decision by the Chief Procurement Officer and approval by the City
Commission.
It is our understanding and belief that an award of this contract
is scheduled to occur on Thursday, January 9, 1992. Unless we
receive the assurance from the City that the award of this contract
will not occur until after a resolution of the protest filed by
SAC, we will have not alternative but to proceed with the filing of

a complaint with appropriate administrative and/or judicial body
seeking injunctive relief prohibiting the City from awarding this
contract until a resolution of the protest on its merits. I trust
that procedure will not be necessary and that an amicable
resolution of this matter can be reached.

Pursuant to our recent conversation concerning the Orange Bowl
Asbestos Abatement Project, the situation as we understand it,
appears to be primarily one of licensing; compliance with applica-
ble laws and ordinances; and possibly Owner liability.
From a loss control and health prosepective, the scope of the
project as described, would demand a maximum degree of care and
attention to safety.
Our understanding is that the work will include careful disas-
sembly of structural components involving drilling, cutting, torch-
ing and jackhammering operations to free 18' X 3' 2000 lb. decking
planks, for removal by crane. Proper crane sizing, operation and
supervision to make these lifts are essential to minimize potential
injury to personnel and property.
In this case, rigging of the loads is critical and should only
be done by trained, experienced people under the supervision of the
General Contractor.
Attention to proper barricading of resulting floor openings
and use of personal protective equipment must not be overlooked.
As a Member of the AGC Self -Insurers' Fund for Workers' Com-
pensation, you are entitled to the following safety and health
consultive services at no additional cost:
1. Overall safety performance suvey;
2. Appraisal of mechanical hazards, power transmission appa-
ratus, material handling, unsafe work methods, and hazard-
ous processes;
3. Assistance in the detection of occupational health hazards
and exposures;
