L f A RESOLUTION APPROVING THE FINDINGS OF THE COMPETITIVE SELECTION COMMITTEE AS TO THE MOST QUALIFIED TEAMS, IN RANK ORDER, TO PROVIDE PROFESSIONAL SERVICES FOR THE DESIGN, f PREPARATION OF CONSTRUCTION DOCUMENTS AND CONSTRUCTION ADMINISTRATION OF AN OLYMPIC POOL COMPLEX AT CHARLES HADLEY PARK; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO UNDERTAKE NEGOTIATIONS WITH THE MOST ' QUALIFIED TEAMS, IN RANK ORDER, UNTIL HE ARRIVES AT AN AGREEMENT WHICH IS FAIR, COMPETITIVE AND REASONABLE, AND FURTHER DIRECTING THE CITY MANAGER TO PRESENT THE NEGOTIATED AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO THE CITY COMMISSION FOR ITS RATIFICATION AND APPROVAL. WHEREAS, the City of Miami, pursuant to Resolution No. 91-433, adopted June 20, 1991, designated as a Category "B" Project, the acquisition of architectural, landscape architectural and engineering services for the design, preparation of construction documents, and construction administration of an Olympic Pool Complex at Charles Hadley Park, Miami, Florida; and WHEREAS, pursuant to Resolution No. 91-433, the City Commission appointed Herbert J. Bailey, Assistant City Manager, _ as Chairperson of the Competitive Selection Committee, and established a Certification Committee of not less than three professionals in the fields of endeavor or practice involved, to CITY CM=SIOPI NlEF ING OF JAN 23 199Z 92-- 48 �asoiatras !ws review the qualifications performance data and related information provided by those responding to the City's Request for Professional Services; and WHEREAS, the City of Miami issued a Request for Proposals for professional Architectural, Landscape Architectural and Engineering services on July 30, 1991; and WHEREAS, the Certification Committee found that none of the firms or individuals submitting proposals were fully qualified to render the required services; and WHEREAS, pursuant to Resolution No. 91-673, adopted on September 26, 1991, the City Commission authorized the City Manager to re -advertise for the required professional services for the Olympic Pool Complex project at Charles Hadley Park, and further reaffirmed the provisions of Resolution No. 91-433; and WHEREAS, on October 3, 1991, the Citv of Miami issued another Request for Proposals for professional Architectural, Landscape Architectural and Engineering services; and WHEREAS, the Certification Committee along with the Competitive Selection Committee evaluated the proposals received November 4, 1991, in response to the City's Request for Proposals, and selected in rank order four teams most qualified to provide the required professional services for this project; and WHEREAS, on January 9, 1992, the City of Miami Commission by Resolution No. 92-38, rejected the findings of the Competitive Selection Committee as to the most qualified teams in rank order, and authorized the City Manager to appoint a new Competitive -2- 92-- 48 Selectio» Committee in accordance with Section 18-52-3 of the Code of the City of Miami, Florida, as amended; and WHEREAS, the new Competitive Selection Committee constituting ten (10) members with five (5) or more members being professionals from the private sector in the field of endeavor or practice involved, heard presentations and interviewed the four certified teams on January 17, 1992; and WHEREAS, the selection procedures were performed in accordance with the Consultants Competitive Negotiation Act as set forth in Section 287.055 of the Florida Statutes and Ordinance No. 9572, adopted February 10, 1983 and codified at Section 1.8.52.3 of the Code of the City of Miami; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission hereby approves the findings of the Competitive Selection Committee of the following teams, in rank order, as the most qualified to provide professional Architectural, Landscape Architectural and Engineering services for the design, preparation of construction documents and construction administration of an Olympic Pool Complex at Charles Hadley Park, Miami, Florida: -3- 92- 48 Team Ranked #1 Prime Consultant: Thaddeus Cohen Architect, P.A. The City Commission hereby authorizes the City Manager or his designee to negotiate a professional services contract on behalf of the City of Miami with the team ranked first as set forth in Section 2 herein. In the event that the City Manager or his designee cannot negotiate an agreement which, in his opinion, is fair, competitive and reasonable with the team ranked first, then he is hereby authorized to formally terminate such negotiations. The City Manager or his designee shall then undertake negotiations with the team ranked second. In the event that he fails to negotiate a satisfactory agreement with the second team, then the City Manager or his designee is authorized to undertake negotiations with the third most qualified team, and if necessary the fourth ranked team. Section 4. The City Manager is hereby directed to present the negotiated agreement, in a form acceptable to the City Attorney, to the City Commission for their ratification and approval. -5- 92-- 48 Section 5. Odio RUERENCES : For January 23, 1992 City Manager Commission Meeting ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Resolution, approving the findings of the Consultant Selection Committee as to the most qualified Teams, in rank order, to provide professional services for the design, preparation of construction documents and construction administration of an Olympic Pool Complex for Charles Hadley Park; authorizing the City Manager to undertake negotiations with the most qualified Teams, in rank order, until he arrives at an agreement which is fair, competitive and reasonable and directing the City Manager to present the negotiated agreement to the City Commission for their ratification and approval. The Department of Development and Housing Conservation, Development Division, recommends that the City Commission authorize the City Manager to undertake negotiations to arrive at an agreement for professional architectural, landscape architectural, and engineering services for the design of an : Olympic Pool Complex at Charles Hadley Park, Miami. On June 20, 1991 by Resolution No. 91-433, the City Commission designated as a Category S Project, the acquisition of architectural, landscape architectural and engineering services for the Olympic Pool Complex Project at Charles Hadley Park. i In accordance with the Competitive Negotiation Act as defined in F.S. Section 287.055, and City of Miami Ordinance 9572 which appears as Section 18.52.3 of the Code of the City of Miami, the Certification Committee along with the Competitive Selection Committee evaluated and selected in ranked order four Teams most qualified to provide the required professional services for this I project. 9 2- 48 Honorable Mayor and Members of the City Commission Page two on January 9, 1992, the City of Miami Commission by Resolution No. 92-38, rejected the findings of the Competitive Selection Committee as to the most qualified Teams in rank order, and authorized the City Manager to appoint a new Competitive Selection Committee to hear presentations and interview the four certified Teams. The newly appointed Competitive Selection Committee consists of ten members, five members being professionals from the private sector in the fields of endeavor or practice involved in this project and five members from the City of Miami staff in accordance with the requirements of City Code Section 18-52-3 and Resolution No. 92-38. The findings of the new Competitive Selection Committee, as its recommendation to the City Manager, are as follows: Rank Team 1 Thaddeus Cohen Architect 2 Bellon & Taylor Architects 3 Polytech, Inc. 4 Ronald E.
