A RESOLUTION REVERSING THE DECISION OF THE ZONING BOARD AND GRANTING A SPECIAL EXCEPTION FROM SECTION 1305 OF ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS LISTED IN CHAPTER 4, SECTION 4-10 OF THE CITY CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED TO ALLOW THE CONSTRUCTION AND OPERATION OF A PACKAGE LIQUOR STORE (FOR CONSUMPTION OFF PREMISES ONLY) WITH A REDUCTION IN DISTANCE SEPARATION REQUIREMENT FROM 1500' TO 600' FROM AN EXISTING PACKAGE LIQUOR STORE (BOULEVARD LIQUOR STORE), LOCATED AT 3101 BISCAYNE BOULEVARD, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), ZONED C-1 RESTRICTED COMMERCIAL, SUBJECT TO THE FOLLOWING CONDITIONS: (1) THERE SHALL BE NO SALE OF LIQUOR AT THE PROPERTY FOR A PERIOD OF TWO YEARS FROM THE DATE OF THIS HEARING; (2) SECURITY GUARDS SHALL BE PROVIDED AT THE PROPERTY AT ALL TIMES THAT THE LIQUOR STORE IS OPEN; (3) PUBLIC TELEPHONES SHALL BE LOCATED ONLY WITHIN STORES AND THERE SHALL BE NO PUBLIC TELEPHONES LOCATED IN THE AREA OUTSIDE STORES NOR IN THE PARKING AREA; (4) LANDSCAPING OF THE SITE SHALL BE SUBJECT TO THE ADVISORY REVIEW OF THE NEIGHBORHOOD COMMUNITY ORGANIZATIONS; AND (5) THE AMENDMENT TO THE COVENANT APPROVED BY THE CITY COMMISSION ON APRIL 25, 1991 PURSUANT TO RESOLUTION NO. 91-321 SHALL BE RECEIVED BY THE CITY IN A FORM ACCEPTABLE TO THE CITY ATTORNEY NO LATER THAN THIRTY (30) DAYS FROM JANUARY 9, 1992. WHEREAS, the Miami Zoning Board at its meeting of September 23, 1991, Item No. 3, duly adopted Resolution ZB 57-91 CIrYION NE,1'1iI QF. , J AN 9 1992 43 RESOWTION 84- i by a five to three (5-3) vote, denying a special exception as hereinafter set forth; and WHEREAS, 3101 Associates Limited, through its counsel, has taken an appeal to the City Commission from the Zoning Board's decision; and WHEREAS, the City Commission after careful consideration of this matter, notwithstanding the decision of the Zoning Board, finds that the application for a special exception does meet the applicable requirements of Zoning Ordinance No. 11000, subject to the conditions set forth herein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Miami Zoning Board in denying a special exception from Section 1305 of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, as listed in Chapter 4, Section 4-10 of the City Code of the City of Miami, Florida, as amended, to allow the construction and operation of a package liquor store (for consumption off premises only) with a reduction in distance separation requirement from 1500' to 600' from an existing package liquor lu -2- ` 9-- 43 store (Boulevard Liquor Store), _located at 3101 Biscayne Boulevard, Miami, Florida, also described as Lots 2-10 inclusive and East 14 ' of Lot 11, Block 1, BROADMOOR, as recorded in Plat Book 2 at Page 37 of the Public Records of Dade County, Florida, and East 24' of Lot 1, all of Lots 2-5 inclusive, and the East 1/2 of Lot 6 and West 45' of Lot 7, Block 3, ELWOOD COURT, as Recorded in Plat Book 9 at Page 181, of the Public Records of Dade County, Florida, as per plans on file, Zoned C-1 Restricted Commercial, is hereby reversed and the special exception is hereby granted, subject to the following conditions: (1) there shall be no sale of liquor at the property for a period of two years from the date of this hearing; (2) security guards shall be provided at the property at all times that the liquor store is open; (3) public telephones shall be located only within stores and there shall be no public telephones located in the area outside stores nor in the parking area; (4) landscaping of the site shall be subject to the advisory review of the neighborhood community organizations; and (5) the amendment to the covenant approved by the City Commission on April 25, 1991 pursuant to Resolution No. 91-321 shall be received by the City in a form acceptable to the City Attorney no later than thirty (30) days from January 9, 1992. The undersigned is a substantial waterfront property owner in the area and I am certain it will increase the value of my property. I noticed by the zoning application that you have asked for a special exception that will allow you to operate a liquor store within 600 feet of an existing package store. It may be unwise for your firm to attempt to locate within 600 feet of an existing individually owner liquor store which will undoubtedly succumb to your superior marketing ability. Of course, the liquor prices will vary considerably. Public relations would possibly hit a new low if this is publicized in the local media. Since the developers and their representatives were unable to attend, we directed our attention primarily to what we would like to see on the Boulevard. As you can see from the report, the neighborhood strongly supports the concept of a Walgreens, but is adamantly opposed to additional liquor stores. Some of this is based on loyalty to the owner of Boulevard Liquors, but most of the opinion seems to be based on a desire to fund projects that would enhance the area. As you can see from the report, there are a number of issues that concern the Task Force that have not been addressed by anyone to date. The sole issue is not the sale of liquors, although that is the primary issue. We are additionally concerned about the appearance of the structure, security, landscaping, and the historic character of the neighborhoods. I would be happy to sit down with you on behalf of the Northeast Task Force and its Economic Development co=ittee to see if there is any compromise we can reach, but I do _ not claim to represent the interests of the residents in Edgewater and would therefore urge that they also be present in any meeting. Present were Neil P. Robertson, Juan Crespi, Dory Auerbach, Janet Grigsby, Armando Rodriguez, Felix Rodriguez and Orlando Ruiz. Representatives of the developers of the property of Biscayne Boulevard on 31st Street did not appear due to the unavailability of their attorney to accompany them. At the meeting there was a general discussion as to the desirability of an additional liquor store affiliated with Walgreens within six hundred feet of Boulevard Liquors as currently contemplated under the developers tentative plans. It was established that the developers do not currently own the property but are scheduled to close on it in February if they can get special exception to the 1500 foot proximity of liquor stores. It was further established that while Walgreens expressed a strong interest in the property and the development, no agreement has been specifically reached with them to locate a Walgreens at this site. Additionally, it was represented that over 200 hundred signatures have been gathered against granting a special exception to the 1500 foot rule and that the city's polling residents of the vicinity ran 2:1 against the special exception. Since there had been some discussion of the possibility of Walgreens going into the location without its liquor store and since the entire project seemed to be relatively speculative, it was determined that the committee should, rather than address a speculative development, address issues of what they would like to see in the development of the Boulevard in this area. The general consensus is that the Development of the Boulevard should comply with existing zoning and land use provisions. In addition, all developments should have 24 hour security, preferably with use of off -duty police officers. Boulevard store fronts were strongly preferred to parking lots between the stores and the Boulevard. At a minimum, parking lots on the boulevard should be set back ten feet from the right-of-way and landscaped. Additionally, developers should be required to comply with the Northeast Task Force's beautification of the Boulevard Proposal including bearing the cost of such beautification on the public right-of-way as well as on their own property. The community and the Northeast Task Force should also require that they be presented with elevations of the structure for our review and comment. Tire design of all developments on the Boulevard should be in keeping with tine historic character of the neighborhoods. Specific suggestions for type of stores wanted by the Edgewater community were a grocery store of a major chain, a fish market and a major sit-down, nationally recognized restaurant as opposed to' a fast-food restaurant. Other types of retail operations not wanted by the committee were adult book stores, coin laundries, pawn shops or video arcades. It was also felt that public phones should be discouraged or if required, should be rotary as opposed to digital. There were some people at the meeting who were willing to compromise and accept the iiquor store in exchange for certain concessions, but others at the meeting took strong exception to compromise that would include additional liquor stores on the Boulevard. We in the neighborhood would welcome the addition of a Walgreen's Drug Store and other stores that would come with it, however, we are opposed to the opening of a liquor store in conjunction with the drug store. This neighborhood has enough problems with prostitutes, homeless, and people who hang out on the corners drinking. I totally oppose the idea of having two liquor stores within one city block. I'm sure that you can see the concern that this project has brought to the people who live and work in the area. We feel such a facility would increase the traffic of undesirable visitors to what is other- wise a local business and residential neighborhood. The existing retail liquor outlet certainly provides the legitimate needs of the residents. The addition of the Walgreen pharmicu- tical and related personal and household items would be a decided benefit to our area and we would.certainly support it. Otherwise, this proposal generates no negative impact in regard to ingress and egress, refuse service areas, capacity of public or private utilities, surface drainage, the scale of design, 'or the manner of proposed operation. One is 13 years old who is sight and hearing impaired. Her ex-husband died on July 9, 1991. His published Will left all to his second wife of about one year of marriage. Nothing was left to their children. It is my considered opinion that it would be horrendous public relations if Walgreen's profited by this Exception to install its Liquor Department fouLiquors. This would ruin No. Weinber ' s livelihood. I also wrote among other things; "I think a most viable concept for Walgreen's is to negotiate to lease (or buy) the entire 131st Street property.' They should plan a SHOWPLACE WALGREEN'S with parking and with a gigantic SHOWPLACE Liquor Department superior to Foremost Sunset Corners Liquors at 8701 S.W. 72nd Street at 87th Avenue." "They should be amenable to buying Boulevard Liquors' good will, license, stock and even Martha's management for continuity for a suitable transfer period. That is my opinion." "I also believe that whatever they pay could comfortably be amortized over a reasonable period for the great value of controlling the market of the 'Boulevard Liquor's area'." Mr. Chadroff was kind enough to respond by letter with a cc to Ms. Weinberg "As far as Walgreen's is concerned, as I have told you, they will not buy the store. They never care about competition. In addition, they will spend whatever money it takes in attorney's fees and consultants to get the variance necessary to place the store on 31st Street." Our local community, of which Boulevard Liquors is a part, is called Edgewater. The "Edgewater Area Association" has a membership of about 10,000.
