("PDG"), IN THE PROPOSED AMOUNT NOT TO EXCEED $729,920.00, TOTAL BID OF THE PROPOSAL, FOR ORANGE BOWL MODERNIZATION PROJECT PHASE II (1992) - ASBESTOS - CONTAINING MATERIALS REMOVAL B-6200; WITH MONIES THEREFOR ALLOCATED FROM THE FISCAL YEAR 1991-92 CAPITAL IMPROVEMENT ORDINANCE NO. 10938, PROJECT NO. 404238, IN THE AMOUNT OF $729,920.00 TO COVER THE CONTRACT COST AND $124,231.24 TO COVER THE ESTIMATED EXPENSES, FOR AN ESTIMATED TOTAL COST OF $854,151.24, CONDITIONED UPON PDG POSTING AN INDEMNITY BOND IN THE AMOUNT OF $729,920.00 AT THE TIME THE CONTRACT IS EXECUTED; AND AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH SAID FIRM. WHEREAS, sealed bids were received January 3, 1992, for ORANGE BOWL MODERNIZATION PROJECT PHASE II (1992) - ASBESTOS - CONTAINING MATERIALS REMOVAL B-6200; and WHEREAS, the City Manager and the Director of the Department of Public Works recommend that the bid from Project Development Group, Inc., be accepted as the lowest responsible and responsive bid; and WHEREAS, Fiscal Year 1991-92 Capital Improvement Ordinance No. 10938, was adopted on December 5, 1991, and monies are available for the proposed amount of the contract, project expense, and incidentals under Project No. 404238 of said WHEREAS, SAC Construction, 44 40 Inc. has filed a bid protest whioh has not been resolved as of this date; and WHEREAS, the City Commission has determined that the renovation of the Orange Bowl is of an emergency nature in order for the Orange Bowl to be ready for the 1992 Football Season and to meet the City's commitment to the Orange Bowl Committee and the University of Miami; and WHEREAS, an indemnity bond in the tuii amount ai tinu oontract will protect the City from any attorney fees, costs and damages that may be incurred because of the awarding of this bid prior to the final determination of the bid protest filed by SAC Construction, Inc.; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The January 3, 1992, bid of Project Development Group, Inc., in the proposed amount $729,920.00, for the project entitled ORANGE BOWL MODERNIZATION PROJECT PHASE II (1992) - ASBESTOS - CONTAINING MATERIALS REMOVAL B-6200, for the total bid of the proposal, based on lump sum and unit prices, is hereby aocepted at the price stated therein, conditioned upon PDG -2- ➢ �- 36 'a posting an indemnity bond in the amount of $729,920.00 at the time the contract is executed. Section 3. The total estimated project cost of $854,151.24 is hereby allocated from Fiscal Year 1991-92 Capital Improvement Ordinance No. 10938, Project No. 404238. Said total project cost consists of the $729,920.00 contract cost and $124,231.24 estimated expenses incurred by the City. Section 4. The City Manager is hereby authorized to enter into a contractI/ on behalf of the City of Miami with Project Development Group, Inc., for ORANGE BOWL MODERNIZATION PROJECT PHASE II (1992) - ASBESTOS - CONTA$ING MATERIALS REMOVAL B-6200, total bid of the proposal. Odi ' City Manager RECOMMENDATION DATE �;� 9 J 1991 PILE B-6200 SUBJECT Resolution Awarding Contract for ORANGE BOWL MODERNIZATION PROJECT PHASE II (1992) - ASBESTOS - CONTAINING MATERIAL REFERENCES REMOVAL ENCLOSURES It is respectfully recommended that the City Commission adopt the attached resolution authorizing the City Manager to enter into contract on behalf of the City with the lowest responsible and responsive bidder, for the ORANGE BOWL MODERNIZATION PROJECT PHASE II (1992) - ASBESTOS - CONTAINING MATERIALS REMOVAL B-6200 which will be received on January 3, 1992. The project consists of furnishing all labor, materials and equipment for the removal of asbestos - containing form board from specified areas within the Orange Bowl Stadium, 1501 N.W. 3 Street, Miami, Florida. BACKGROUND Cost Estimate: Source of Funds: $780,000.00 Fiscal Year 1991-92 Capital Improvement Ordinance No. 10938 Minority Representation: Public Hearings/Notices: Assessable Project: No 5 invitations mailed No public hearing Discussion: The Department of Public Works will evaluate the bids to be received on January 3, 1992, and will determine which will be the lowest responsible and responsive bid, at which time a recommendation will be submitted. Funds are available to cover the contract cost, and for such incidental items as postage, blueprinting, advertising, and reproduction costs.
