HomeMy WebLinkAboutR-92-00250 J-91-977 12/6/91 RESOLUTION NO. 92- 25 A RESOLUTION, WITH ATTACHMENT M , AUTHORIZING THE CITY MANAGER TO -SIGH -OFF ON ARTICLE 28, ATTACHED HERETO, FOR INCORPORATION OF SAID ARTICLE INTO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF MIAMI AND THE SANITATION EMPLOYEES ASSOCIATION, PASSED AND ADOPTED BY THE CITY COMMISSION ON SEPTEMBER 11, 1991. a WHEREAS, on September 11, 1991, the Miami City Commission approved and ratified the Collective Bargaining Agreement between the City of Miami and the Sanitation Employee Association setting forth the terms and conditions of employment for the period of October 1, 1991 through September 30, 1994, except for Article 28, Group Insurance, that was left as an open Article for further negotiations; and WHEREAS, the City of Miami and the Sanitation Employees Association have negotiated in good faith and have agreed to the terms and conditions of Article 28; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to sign -off on Article 28, attached hereto and incorporated by reference, and that said Article 28 shall become part of the Crry ;II OSFON NEET JAN 9 1992 1 92 - - 251 wMajoN M. As of February 1, 1985, aii current, future, and retired unit employees shall be eligible to participate in the Association's Group Health Insurance, Life and Accidental Death and Dismemberment Plan, but shall forfeit the right to participate in the City's Plan. Employees who drop out of the Sanitation Employees Association's Group Health Insurance, Life and Accidental Death and Dismemberment Plan shall forfeit their right to said coverage. Should said employee wish to rejoin the SEA Health Trust, he/she may petition the SEA Health Trust Board of Trustees to rejoin. Section 2. The Association's Plan shall provide life and accidental death/dismemberment coverage equal to that which is provided by the City's group plan. The City agrees to pay $10.00 per pay period toward the cost of this coverage for active classified service bargaining unit employees participating in the Association's group medical plan. This contribution rate shall be effective as of the first full pay period following the date this Agreement is ratified by the parties. Section 3. The Association's Plan shal'I provide health insurance benefits that are reasonably comparable to those provided by the City's plan. The City will contribute $64.29 per pay period toward the cost of employee health coverage and $136 20 per pay period toward the cost of family coverage where the employee elects such coverage. It Is agreed by the parties that contributions received from the City shall only be used for health Insurance coverage and reasonable administrative costs, however, such contributions shall not be used In providing other benefits such as dental, long term disability, vision, etc. as separate packages. Contributions by the City and Association Plan participants shall be remitted by the City during the week following each bi-weekly pay period in a manner that shall be defined by the City Finance Director. Remittance of said contributions shall be conditioned upon the following: 1) The Association shall provide the City with a copy of the banking agreement (and subsequent modifications) it e*tabiishes with the institution that shall serve as a depository for Association Plan Funds. 2) The Association Insurance plan shall be administered In a manner that fully conforms with the terms of this Article and applicable law. Section 8. Failure of the Association Plan to meet these obligations shall result In rescission of this Article and enrollment of the Plan's participants in an Insurance plan authorized by the City. Section 7. The Association shall indemnify and hold the City harmless against any claim, demand, suit, or liability and for all legal costs arising in relation to the implementation or administration of the Association's Plan. Section 8. The Association agrees to enroll Department supervisors in Its Plan if those individuals elect to participate In that Plan. 92-- 25 Section 9. Upon request, the Association and Its Insurance Plan Administrator shall permit the City to review any records related to the Association's Insurance plan. Od I o REFERENCES: City Manager ENCLOSURES: RECOMMENDATION: It is recommended that the City Commission authorize the City Manager to sign -off on Article 28 - Group insurance as part of the collective bargaining agreement between the City of Miami and the Sanitation Employees Association adopted by the City Commission on September 11, 1991. BACKGROUND: Under Florida Statutes, Chapter 447, the City Is required to bargain collectively with the certified bargaining representatives of the Sanitation Employees Association. As previously ratified by the City Commission on September 11, 1991, the City and the Sanitation Employees Association agreed to a three year agreement with the exception of the Group Insurance article. The Group Insurance article which represented the only unresolved component of this three (3) year agreement was successfully negotiated on November 26, 1991. It stipulates that effective the first full pay period following ratification of this article the City will contribute $95,000 to the SEA Health Trust for fiscal year 1991-92. It was also agreed that effective the first full pay period following January 1, 1993, the City will contribute $120,000 to the SEA Health Trust (fiscal year 1992-93) at which time an audit would Abe conducted to determine what increase or decrease, if any, may be required to fund the Trust for fiscal year 1993-94.
