RESOLUTION NO.
A RESOLUTION RATIFYING THE POSTPONEMENT OF
THE COLLECTION FROM VIZCATRAN, LIMITED, OF
HE FEES REQUIRED BY SECTION 2-99(a)(2) OF,
T E CODE OF THE CITY OF MIAMI, FLORIDA, AS
AM DED, TO EXTEND THE SUBDIVISION
IMP OVEMENTS `TIME LIMIT, AS RELATED TO THE
"VIZ TRAN GARDEN" SUBDIVISION FROM JUNE 26,
1990 O JUNE 26, 1992; FURTHER BY APPROVING
THE PO TPONEMENT OF THE COLLECTION OF SAID
FEES TO XTEND SAID SUBDIVISION IMPROVEMENTS
TIME LIM T FROM JUNE 26, 1992 TO JUNE 26,
1993, SAI FEES TO BE PAID IN FULL BY
VIZCATRAN, IlITED AT SUCH TIME THAT THE
NECESSARY F DING IS SECURED BY CODEC, INC.
TO BEGIN CO TRUCTION WITHIN THE AFORESAID
SUBDIVISION.
WHEREAS, after ful ,lling the requirements of the
subdivision regulations conta ed in Chapter 54.5 of the Code of
the City of Miami, Florida, as amended, a subdivision entitled
"Vizcatran Garden" was recorded i Plat Book 129 at Page 89 of
the Public Records of Dade County, Florida, on September 11,
1986; and
WHEREAS, the aforesaid subdivision egulations require the
subdivider to construct certain subdivisi improvements within
one (1) year from the date of approval of t e plat by the City
Commission; and
WHEREAS, the subdivider, Vizcatran, Limited,
bond in the amount of $121,000.00 for the event
of the subdivision improvements; and

WHEREAS, the supervisor of plats has granted a request by
Vizcatran, Limited to extend the time limit for the completion of
the subdivision improvements from June 26, 1990 to June 26, 1992;
and
WHEREAS, section 2-99(a)(2) of the Code of the City of
Miami, Florida, as amended, requires a fee to be charged by the
Public Works Department for each time limit extension granted for
completion of subdivision improvements required in conjunction
with a recorded plat; and
WHEREAS, the supervisor of plats has allowed the
postponement of the collection of said fees generated by the
extension of the time limit from June 26, 1990 to June 26, 1992
until the time the developer of the site, CODEC, Inc., secures a
construction loan with the U.S. Department of Housing and Urban
Development; and
WHEREAS, CODEC, Inc. was unable to close on said
construction loan within the time limit extension granted by the
supervisor of plats; and
WHEREAS, Vizcatran, Limited has requested an extension to
the time limit for the completion of the subdivision improvements
from June 26, 1992 to June 26, 1993 and the postponement of the
collection of said fees generated by this extension and the

NOW, THEREFORE, BE IT RESOLVED RY THE COMMISSION OF THE CITY
OF MIAMMI, FLORIDAt
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The postponement of the collection from
Vizcatran, Limited of the fees, in the amount of $12,100.00,
required by Section 2-99(a)(2) of the Code of the City of Miami,
Florida, as amended, to extend the subdivision improvements time
limit, as related to the "Vizcatran Garden" Subdivision, from
June 26, 1990 to June 26, 1992 is hereby ratified.
Section 3. The postponement of the collection of said
fees, in the amount of $6,050.00, to extend said subdivision
improvements time limit from June 26, 1992 to June 26, 1993, said
fees to be paid in full by Vizcatran, Limited at such time that
the necessary funding is secured by CODEC, Inc. to begin
construction within the aforesaid subdivision is hereby approved.
Section 4. The aforesaid fees, in the amount of
$18,150.00 shall be paid in full by Vizcatran, Limited at the
time the necessary construction funding is secured by CODEC, Inc.
to begin construction within the "Vizcatran Garden" subdivision.

Section 5. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It Is respectfully recommended that the City Commission adopt
the attached resolution ratifying the postponement of fees
required to extend the time limit for the completion of
subdivision Improvements from June 26, 1990 to June 26. 1992 and
approving the postponement of additional fees to extend the time
IImIt from June 26, 1992 to June 26, 1993 for the "Vlzcatran
Garden" subdivision until the developer of the site, CODEC,
Inc., secures the necessary construction funding.
BACKGROUND:
On October 17, 1979, the City Commission adopted Resolution
79-708 approving the Vizcaya Transit Station Area Plan which
Included the recommendation of the closure of S.W. 22 Terrace at
S.W. 32 Road and multi -family residential development In the
area adjacent to the Vizcaya Transit Station. in compliance
with the subdivision regulations contained In the City Code, a
subdivision entitled "Vlzcatran Garden" was recorded In the
Public Records of Dade County.
The subdivision regulations require the property owner,
Vlzcatran, Limited to construct certain subdivision Improvements
within one year from the date the plat was approved by the City
Commission and Vlzcatran, Limited has furnished a $121,000.00
bond for the eventual Installation of those Improvements. The
supervisor of plats has granted a request by Vizcatran, Limited
to extend the time limit for the completion of the Improvements
from June 26, 1990 to June 26', 1992 and has postponed the
collection of fees required by Section 2-99(a)(2) of the City
Code, In the amount of $12,100.00. to afford the developer of
the site, CODEC, Inc., sufficient time to secure the necessary
funding (letter attached).
CODEC, Inc. has not secured the necessary construction funding
and Vizcatran, Limited has requested another extension of the
time limit for construction of the subdivision Improvements from
June 26, 19.92 to June 26, 1993 and postponement of the
corresponding fee, In the amount of $6,050.00.

hereby granted a one-year extension of the Subdivision
Improvement Agreement provided that the fees generated by this
extension and the previous extension (approximately $12,000) are

The attached resolution will ratify the postponement of the
collection of the required subdivision improvement time limit
extension fees for the time from June 26, 1990 to June 26, 1992
and will approve Vlzcatran, Limited's request to postpone the
required time limit extension fee for the time from June 26,
1992 to June 26, 1993. The resolution further requires that the
postponed fees, In the amount of $18,160,00 be paid in full by
Vlzcatran, Limited at the time the necessary construction
funding is secured by CODEC, Inc. to begin construction within
the "Vlzcatran Garden" subdivision.
