Od ENCLOSURES: Resolution, Letter from City Manager Supervisor of Plats RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution ratifying the postponement of fees required to extend the time limit for the completion of subdivision Improvements from June 26, 1990 to June 26, 1992 and approving the postponement of additional fees to extend the time limit from June 26, 1992 to June 26, 1993 for the "Vizcatran Garden" subdivision until the developer of the site, CODEC, Inc., secures the necessary construction funding. BACKGROUND: On October 17, 1979, the City Commission adopted Resolution 79-708 approving the Vizcaya Transit Station Area Plan which included the recommendation of the closure of S.W. 22 Terrace at S.W. 32 Road and multi -family residential development In the area adjacent to the Vizcaya Transit Station. In compliance with the subdivision regulations contained in the City Code, a subdivision entitled "Vizcatran Garden" was recorded in the Public Records of Dade County. The subdivision regulations require the property owner, Vizcatran, Limited to construct certain subdivision Improvements within one year from the date the plat was approved by the City Commission and Vizcatran, Limited has furnished a $121,000.00 bond for the eventual Installation of those Improvements. The supervisor of .plats has granted a request by Vizcatran, Limited to extend the time limit for the completion of the Improvements from June 26, 1990 to June 26, 1992 and has postponed the collection of fees required by Section 2-99(a)(2) of the City Code, in the amount of $12,100.00, to afford the developer of the site, CODEC, Inc., sufficient time to secure the necessary funding (letter attached). CODEC, Inc. has not secured the necessary construction funding and Vizcatran, Limited has requested another extension of the time limit for construction of the subdivision Improvements from June 26, 12.92 to June 26, 1993 and postponement of the corresponding fee, in the amount of $6,050.00. ODIC) City Manager VIZCATRAN GARDEN - Located at S.W 32 Road and S.W. 1 Avenue This shall confirm our discussions of today with Mr. Jose Fabregas, Executive Director of CODEC, Inc., regarding the required improvements for the subject project. Vizcatran Ltd. is hereby granted a one-year extension of the Subdivision Improvement Agreement provided that the fees generated by this extension and the previous extension (approximately $12,000) are paid in full at the time of closing on the construction loan with the U.S. Department of Housing and Urban Development. Mr. Jose Fabregas has agreed to this arrangement in previous correspondence. By copy of this letter we are notifying Ocean Bank of Miami that the Department of Public Works will not call on the $121,000 Letter of Credit, SB-86-324, placed with that institution as guarantee of the subdivision improvements and do hereby grant to Vizcatran Limited, 7380 N.W. 77 Court, Miami, Florida a one-year extension of these improvements.
