ORDINANCE NO. 110 2 0
AN EMERGENCY ORDINANCE ESTABLISHING A TRUST
AND AGENCY FUND ENTITLED: "PROFFERED TRUST
FUND" CONSISTING OF VOLUNTARY CONTRIBUTIONS
FROM PRIVATE DEVELOPERS; APPROPRIATING
$84,000 FOR THE OPERATION OF SAID TRUST FUND;
AUTHORIZING THE CITY MANAGER TO EXPEND
$25,000 OF SAID APPROPRIATION FOR THE PURPOSE
OF PROVIDING SECURITY RELATED IMPROVEMENTS AT
RAINBOW VILLAGE, A PUBLIC HOUSING FACILITY
LOCATED AT APPROXIMATELY 2140 NORTHWEST 3RD
AVENUE, MIAMI, FLORIDA, AND TO EXPEND AN
ADDITIONAL AMOUNT, NOT TO EXCEED $10,000, OF
SAID APPROPRIATION FOR THE PURPOSE OF A STUDY
OF ALTERNATE SOLUTIONS TO THE COCONUT GROVE
PARKING PROBLEM; AND TO EXPEND ADDITIONAL
AMOUNTS OF $24,500 EACH FOR THE PURPOSE OF
IMPROVING VIRRICK AND DORSEY PARKS;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, on April 26, 1990, the City Commission adopted
Motion 90-329 directing the City Manager to establish a special
fund to contain all voluntarily proffered contributions made to
the City of Miami, said fund to be held in reserve for future
allocations by the City Commission on a quarterly basis; and
WHEREAS, to date, the City has received $84,000 in private
developer's contributions for the Proffered Trust Fund; and
WHEREAS, on May 24, 1990, a representative from
Metropolitan Dade County's Department of Housing and Urban
Development ("Dade County HUD") requested consideration of City

financial participation in making physical improvements to public
housing, resulting in the City Commission adopting Motion 90-177
on the same day directing the administration to earmark for Dade
County HUD an amount to be determined by the City Commission from
developer's voluntarily proffered land use related contributions;
and
WHEREAS, on September 27, 1990, the City Commission adopted
Resolution No. 90-731 directing the City Manager use the initial
$25,000 deposited in the Proffered Trust Fund for funding of
security related physical improvements for Rainbow Village; and
WHEREAS, several development projects have requested
waivers of required parking in the Coconut Grove area, and the
shortage threatens to become even more critical as a result of the
granting of such waivers; and
WHEREAS, a study is justified as a necessary means of
determining an alternative solution to this severe shortage of
parking in the Coconut Grove area; and
WHEREAS, on October 8, 1992, the City Commission adopted
Motion No. 92-648 allocating $24,500 each from the Proffered Trust
Fund for the purpose of improving Virrick and Dorsey Parks1
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference thereto
and incorporated herein as if fully set forth in this Section.

Section 2. The following Trust and Agency Fund, which
shall be funded by the voluntary contributions of private
developers, is hereby established as described herein:

APPROPRIATION: PROFFERED TRUST FUND $84,000
Section 3. The City Manager is hereby authorized to convey
to Metropolitan Dade County Department of Housing and Urban
Development, by letter agreement and subject to applicable City
Charter and Code Provisions, the sum of $25,000 to be used
exclusively for security related physical improvements at the
Rainbow Village Public Housing facility, as set forth in
Resolution No. 90-731, and to appropriate an additional amount,
not to exceed $10,000, to be used exclusively for a study of
alternative solutions to the severe parking shortage in Coconut
Grove, and to appropriate amounts of $24,500 each for the purpose
of improving Virrick and Dorsey Parks.
Section 4. All Ordinances or parts of Ordinances insofar as
they are inconsistent or in conflict, with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. The Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
reservation of peace, health, safety, and property of the City of
Miami and upon the further grounds of the necessity to make the

required and necessary purchases and payments, and to generally
carry out the functions and duties of municipal affairs.
Section 7. The requirement of reading this Ordinance on two
separate days is hereby dispensed with by a vote of not less than
four -fifths of the Members of the City Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the attached
emergency ordinance appropriating a sum of $84,000 from private developers
contributions for the Proffered Trust Fund and allowing for the payment of $25,000
to Metropolitan Dade County Department of Housing and Urban Development for
providing security at the Rainbow Village Public Housing facility, the payment of
up to $10,000 for a study of alternative solutions to the Coconut Grove parking
problem, and $24,500 each to the Parks Department for the purpose of improving
Virrick and Dorsey Parks.
BACKGROUND:
On April 26, 1990, by Motion 90-329, the City Commission directed that a special
fund - Proffered Trust Fund - be established to receive all voluntarily proffered
contributions, said fund to be held in reserve for future allocations by the City
Commission.
On September 27, 1990, the City Commission adopted Resolution No. 90-731
allocating $25,000 of initial private developer contributions to the Proffered
Trust Fund for security at the Rainbow Village Public Housing facility. Funds
must be appropriated before expenditures can occur. Therefore, in order to carry
out the directive of the City Commission to provide the aforementioned $25,000 to
Metropolitan Dade County for security at Rainbow Village, it is necessary for the
City Commission to appropriate the funds.
This emergency ordinance is justified by the immediate need to increase security
to residents of Rainbow Village, and to be timely and consistent with the onset of
the major rehabilitation program being undertaken for public housing projects by
Metropolitan Dade County's Department of Housing and Urban Development through a
multi -million dollar grant from the U.S. Department of Housing and Urban
Development.
On October 8, 1992, the City Commission adopted Motion 92-648 allocating $24,500
each for the improvement of Virrick and Dorsey Parks.

The final request is for an appropriation of up to $10,000 for a study of
alternative solutions to an existing severe shortage of parking in Coconut Grove.

It is requested that this item be added to the agenda for City Commission meeting
of November 12, 1992.
