AN ORDINANCE AMENDING THE FUTURE LAND USE MAP OF ORDINANCE NO. 10544, AS AMENDED, THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN 1989-2000, FOR THE PROPERTY LOCATED AT 601-627 SOUTHWEST 8TH AVENUE, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), BY CHANGING THE LAND USE DESIGNATION OF THE SUBJECT PROPERTY FROM MEDIUM DENSITY MULTI -FAMILY RESIDENTIAL TO OFFICE; MAKING FINDINGS; INSTRUCTING THE TRANSMITTAL OF A COPY OF THIS ORDINANCE TO AFFECTED AGENCIES; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of March 11, 1992, Item No. 2, following an advertised public hearing, adopted Resolution No. PAB 15-92, by a 9 to 0 vote, RECOMMENDING APPROVAL of an amendment to the Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this Comprehensive Plan change as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11016 Section 1. The Future Land Use Map of Ordinance No. 10544, as amended, the Miami Comprehensive Neighborhood Plan 1989-2000, is hereby amended by changing the land use designation from Medium Density Multi -Family Residential to Office for the property located at 601-627 Southwest 8th Avenue, Miami, Florida, more particularly described as Lots 1, 2, 3, 4, 7, 8, 9 less the W 101, 10 and the N 20' of Lot 11, Block D, DRUID COURT FIRST ADDITION, as recorded in Plat Book 6 at Page 168 of the Public Records of Dade County, Florida. Section 2. It is hereby found that this Comprehensive Plan designation change: a. is necessary due to changed or changing conditions; b. is one which involves property that has not been the specific subject of a Comprehensive Plan change within the last year; and C. is one which does not involve the same owner's property within 200 feet of property that has been the subject of a Comprehensive Plan change within the last year. Section 3. The City Manager is hereby instructed to direct the Director of Planning, Building and Zoning to transmit a copy of this Ordinance immediately upon approval on first reading to Randall Kelly, Assistant Secretary, Florida Department of Community Affairs, 2740 Centerview Drive, Tallahassee, Florida 32399-2100, for 90 day review and comment. -2- 11016 Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. BACKGROUND Lighthouse for the Blind has been located on the subject property since approximately 1938 and in previous zoning ordinances was included as an eleemosynary use in residential districts. After 1983, Zoning Ordinances 95M and 11000 have presented increasing restrictions on non-residential activities in residential zoning districts. This request, if approved on first reading by the City Commission, must be transmitted to the Florida Department of Community Affairs for 90 day review -and -comment. ANALYSIS The existing facility is an institution, it is surrounded by medium density multi family designations. Granting this request will allow Lighthouse for the Blind to expand and conduct certain training activities in their building expansion program beyond those already granrfathered. The attached analysis and concurrency management system demonstrate the limited impact of this proposed change; no levels -of -service would deteriorate below city-wide criteria. PAB 3/11/92 CASE NUMBER 92-11 P A 8 - ITEM f2 March 11, 1992 ANALYSIS OF PROPOSED COMPREHENSIVE PLAN AMENDMENT NO.92-5 -4. 7. 8. 9 less the_W 10'. 10 and the N 20' of Lot 11 in Block DISCUSSION The subject 1.07 acre area is located in the north side of the block bounded by SW 6th and 7th Streets, between SW 7th and 8th Avenues, approximately at 601-627 SW 8th Avenue, in the Planning District D. MCNP Land Use Policy 1.6.1., establishes future land use categories according to the Future Land Use Plan Map and the "Interpretation of the Future Land Use Plan Map". The subject property is currently designated "Multifamily Medium Density --Residential". Blocks to the east, west, north and south of the property have the same land use designation. The south side of the block south of the property is designated "Restricted --Commercial". The "Multifamily Medium Density --Residential" land use category permits multifamily structures up to low-rise apartment structures and lower density residential structures. Permissible uses include accessary commercial and office activities in the same building that are intended to serve the retailing and persorfl services needs of the immediately surrounding neighborhood and community -based residential facilities (14 clients or less). The "Office" category allow residential uses to a maximum density equivalent to "High=- Density Multifamily Residential" subject to the same limiting conditions; transitory residential facilities such as hotels and motels; general office use; clinics and laboratories; and limited commercial A 911/�2 Item #E2 Pages 1 of 2 activities incidental to principal activities in designated areas. Supporting facilities such as auditoriums, libraries, convention facilities, places of worship, and primary and secondary schools may be allowed with the "Office" designation. The Planning, Building and Zoning Department contends that the increased densities created by this amendment are not inconsistent with the medium density land use pattern that is existing in the area. MNCP Land Use Goal 1, requires the City to promote the efficient use of land use and minimize land use conflicts. The change also, would be consistent with Land Use Policy 1.1.3. which requires that all areas of the City be protected from encroachment of incompatible land uses. Housing Policies 1.1.5. and 1.2.7. require the City to preserve and enhance the general appearance and character of the City neighborhoods. Together these goals and policies argue that the existing land use pattern in this area should be changed. In addition, Land Use Policy 1.1.1. requires new development or redevelopment, that results in an increase in density or intensity of land' use, to be contingent upon the availability of public facilities and services that meet or exceed the minimum LOS standards adopted in the Capital Improvement Element (CIE) Policy (Policy CI-1.2.3.). The attached Concurrency Management Analysis pertaining to concurrency demonstrates that no levels of service would be reduced below minimum levels. We reviewed the proposed amendments primarily to identify points of consistency or inconsistency with provisions of Dade County's Comprehensive Development Master Plan (CDMP). The following comments are offered for your consideration. Amendment No. 92-3 This amendment addresses a 1.43 acre parcel located between NW 72 Street and the Florida East Coast Railroad right-of-way and between NW 7 Avenue and NW 5 Place, and requests a change on the City's Future Land Use Plan Map from "General Commercial" to "Industrial." The "Industrial" land use category allows manufacturing, assembly and storage facilities and other uses which generally includes activities that would generate excessive amounts of noise, smoke, fumes, illumination, traffic, _hazardous wastes, etc. Contiguous areas to the east, west, and south of the site are designated "General Commercial" while the area north of the site across the FEC right-of-way is designated "Medium Density Multi - Family Residential." The Metro -Dade County CDMP Land Use Plan Map designates the amendment site as "Industrial and Office" which is consistent with the requested change. This Department concludes that this amendment is not Inconsis- tent with the policies of the CDMP. Mr. Robert Arredondo - 2 - Amendment No. 92-5 June 11, 1992 This amendment addresses a 1.07 acre parcel located on the south side of SW 6 Street between SW 7 and SW 8 Avenues, and requests a change on the City's Future Land Use Plan Map from "Multifamily Medium Density - Resi- dential" to "Office." The "Office" land use category allows residential uses to a maximum density equivalent to "High Density Multifamily Residential;" transitory residential facilities such as hotels and motels; general office use; clinics and laboratories. and limited commercial activities incidental to principal activities in designated areas. Adjoining areas surrounding the application site are designated "Multifamily Medium Density -Residential." According to the information provided with the amendment application, this site is developed as an institutional use, the Miami Lighthouse for the Blind, which has been located on .the subject property since approximately 1938. Granting the requested land use designation would allow this institution to expand their on -site facility and activities. Apparently, the applicant's desire to expand the current use requires a zoning category change from RU-3 to 0 (office) which in turn triggers the need for the land use plan map amendment for the site. The Metro -Dade County CDMP Land Use Plan map designates the amendment site as "Medium -High Density Residential Communities." Small scale institutional uses are not usually depicted on the CDMP Land Use Plan map. Only major institutional uses and utilities of metropolitan significance are shown. Also, the CDMP text, on page I-33 under the heading "Institutional and Public Facility," provides that the location of neighborhood or community -serving institutional uses and utilities may be approved where compatible in all urban land use categories in keeping with any conditions specified in the applicable .category. This Department concludes that the proposed amendment is not inconsis- tent with the policies of the Metro -Dade County CDMP and would not create any inter -jurisdictional land use conflicts and would not significantly impair any public services provided by the County.
