ORDINANCE NO. 11013
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY
CHANGING THE ZONING CLASSIFICATION FROM R-1
SINGLE FAMILY RESIDENTIAL AND SD-2 COCONUT
GROVE CENTRAL COMMERCIAL DISTRICT TO G/I
GOVERNMENTAL INSTITUTION, FOR THE PROPERTY
LOCATED AT APPROXIMATELY 3490 AND 3500 MAIN
HIGHWAY, MIAMI, FLORIDA (MORE PARTICULARLY
DESCRIBED HEREIN); AND BY MAKING ALL THE
NECESSARY CHANGES ON PAGE NO. 46 OF SAID
ZONING ATLAS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning Advisory Board, at its meeting of
July 8, 1992, Item No. 1, following an advertised hearing,
adopted Resolution No. PAB-23-92, by a seven to zero (7-0) vote,
RECOMMENDING APPROVAL of a change of zoning classification, as
herein set forth; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The Zoning Atlas of Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida, is
hereby amended by changing the zoning classification from R-I
Single Family Residential and SD-2 Coconut Grove Central
Commercial District to G/I Government Institutional for the
property located at 3490 and 3500 Main Highway, Miami, Florida,
also known as the Unnumbered lots being N. 117 FT of E. 140 FT
plus the E. 52.5 FT less N. 117 FT, Block 29 AMEND PLAT FROW
HOMESTEAD (B-106) P.R.D.C.; and Lot 10 (pt.) lying N.Westerly of
Main Highway., MONROE SUBDIVISION (D-253) P.R.D.C.; and Lot 1, 2
and Tr. "B" ENGLE SUBDIVISION (64-43) P.R.D.C.; and Lot 73 (pt.)
DE HEDOUVILLE'S SUB (B-150) P.R.D.C.
Section 3. It is hereby found that this zoning
classification change:
(a) is in conformity with the adopted Miami
Comprehensive Neighborhood Plan;
(b) is not contrary to the established land use
pattern;
(c) will not create an isolated district unrelated
to adjacent and nearby districts;
(d) is not out of scale with the needs of the
neighborhood or the City;

(e) will not materially alter the population
density pattern or increase or overtax the load
on public facilities such as schools,
utilities, streets, etc.;
(f) is necessary due to changed or changing
conditions;
(g) will not adversely influence living conditions
in the neighborhood;
(h) will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) will not create a drainage problem;
(j) will not seriously reduce light and air to
adjacent areas;
(k) will not adversely affect property values in
the adjacent area;
(1) will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(m) will not constitute a grant of special
privilege to an individual owner so as to
compromise the protection of the public
welfare.
Section 4. Page No. 46 of the Zoning Atlas, made a part of
Ordinance No. 11000, as amended, by reference and description of
said Ordinance, is hereby amended to reflect the changes made
necessary by this amendment.

Section 5. All ordinances or parts of ordinances insofar as
they are consistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

PETITION Consideration of amending the zoning classification in the Official Zoning
Atlas of Zoning Ordinance 11000, as amended, the Zoning Ordinance of the City
of Miami, from R-1 Single Family Residential, and SD-2 Coconut Grove Central
Commercial District to G-I Government Institutional.
PLANNING RECOMMENDATION Approval
BACKGROUND The property was granted a land use amendment on December 14, 1989 changing
the designation from restricted commercial and single family residential to
major public facilities. A simultaneous zoning change was granted amending
the zoning from SPI-2 Coconut Grove Central Commercial District and RS-2/2
Single Family Detached Residential to GU Government Use. In the transition
to Zoning Ordinance 11000 the zoning atlas was never updated to reflect the
zoning amendment.
ANALYSIS The proposed zoning change is in harmony with the Miami Comprehensive
Neighborhood Plan (MCNP) adopted on 2/9/89 and, through an oversight in the
transition of the zoning atlas to Zoning Ordinance 11000, was never updated.
The proposed change requires no plan amendment. The subject site is owned by
the State of Florida and the Offstreet Parking Authority; the MCNP
establishes that Major Public Facilities, Transportation, and Utilities
designation is intended "to accommodate the development of major
concentrations of national, state, and local government activities,..." The
subject site is within the village center of Coconut Grove, which is located
north and west of Main Highway; therefore, the proposed zoning change to G-I
Government Institutional will be appropriate.
PLANNING ADVISORY BD At its meeting of July 8, 1992, the Planning Advisory Board adopted
Resolution PAB 24-92, recommending approval of the above by a vote
of 7-0.
At its meeting of September 24, 1992, the City Commission
CITY COMMISSION passed the above on First Reading.
