ORDINANCE NO. 11009
AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 10938, ADOPTED
DECEMBER 5, 1991, AS AMENDED, THE CAPITAL
IMPROVEMENTS APPROPRIATIONS ORDINANCE BY
DECREASING THE TOTAL APPROPRIATIONS TO
CAPITAL PROJECT ENTITLED "SCATTERED SITE
AFFORDABLE HOUSING DEVELOPMENT PROGRAM",
PROJECT NO. 321034, IN THE AMOUNT OF
$817,200; APPROPRIATING FUNDS THEREFOR IN THE
AMOUNT OF $2,258,000 FROM SPECIAL OBLIGATION
BONDS - SERIES 1986A IN THE AMOUNT OF
$1,554,000 AND FROM PROCEEDS FROM THE SALE OF
AFFORDABLE HOUSING UNITS IN THE AMOUNT OF
$704,000, AND ESTABLISHING A NEW PROJECT
ENTITLED "SAINT HUGH OAKS VILLAGE HOUSING
PROJECT", PROJECT NO. 321040, FOR THE PURPOSE
OF DEVELOPING TWENTY-THREE (23) NEW SINGLE
FAMILY HOMES ON THE CITY -OWNED ST. HUGH OAKS
PARCEL LOCATED IN THE COCONUT GROVE
NEIGHBORHOOD; CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE.
WHEREAS, there exists in the City of Miami a severe shortage
of housing within the affordable range of families and
individuals of low and moderate income; and
WHEREAS, in an effort to expand the availability and
affordability of housing for moderate income families and
individuals in the City of Miami, in September, 1986, the City
Commission authorized the acquisition of a three (3) acre parcel
of land located in the Coconut Grove neighborhood known as the
St. Hugh Oaks Academy property; and

WHEREAS, the City of Miami, serving as developer, intends to
develop a twenty-three (23) unit single family residential sales
housing development on the said parcel; and
WHEREAS, the City Commission adopted Ordinance No. 10938, on
December 5, 1991, appropriating funds for Capital Improvement
Projects; and
WHEREAS, the estimated bid cost of constructing the
twenty-three (23) single family homes planned on the St. Hugh
Oaks parcel is $2,258,000; and
WHEREAS, funding is available from Special Obligation
Bonds - Series 1986A in the amount of $1,554,000 and from
proceeds from the sale of affordable housing units in the amount
of $704,000;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Section 1 of Ordinance No. 10938, the Capital
Improvement Appropriation Ordinance adopted December 5, 1991, as
amended, is hereby amended in the following particulars: 1/
1/ Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.
Asterisks indicate omitted and unchanged material. All
figures are rounded to the nearest hundred dollars.

"Section 1. The herein appropriations are
hereby made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvement projects scheduled to begin during
fiscal year 1991-92. The herein appropriations which
are hereby designated by reference to descriptive
project title and number also include appropriations
for previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The
source of revenues to support the herein appropriations
is hereby identified by fund and project with the
project appropriations with revenues therefor being set
forth for seven program (I-VII) areas based upon use or
functional category within said areas, as follows:

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary purchases and payments and to
generally carry out the functions and duties of municipal
affairs.
Section 6. The requirements of reading this Ordinance on
two ( 2 ) separate days is hereby dispensed with by a vote of not
less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommend A that the City Commission adopt the
attached Emergency Ordinance, amending Section 1 of Ordinance NO,
10938, the Capita]. Improvement Appropriations Ordinance, adopted
December 5, 1991, by decreasing the appropriation for Capital
Improvement Program Project No. 321034, entitled "Scattered Site
Affordable Housing Development Program", in the amount of
$817,200, appropriating funds, in the amount zf 02,250,000 aria
establishing a new project entitled Saint Hugh Oaks Village
housing Project No. 321040, for the purpose of developing twenty-
three (23) now single family homes on the city -owned St. Hugh
Oaks parcel, located in the Coconut Grove neighborhood.
BACKGROUND:
In November of 1988, through Resolution No. 88-1042, the City
Commission approved the Administration's proposal which called
for the development of a thirty (30) unit single family
residential sales housing development on the city -owned St. Iiugh
Oaks property located in the Coconut Grove neighborhood.
Subsequently, in May of 1991, through Resolution No. 91--403, the
City Commission reduced the number of housing units which were
being proposed from thirty (30) to twenty-three (23) homes.
In July of 1992, the Department of Public Works
solicited bid
proposals from
general contracting firms
in connection with the
development of
the twenty-three (23) new single
family homes
planned on the
St. Hugh Oaks parcel. On
September
22, 1992, bid
proposals were
received by the City with
the lowest
bid received
from Associates
Construction, Inc. in tho
amount of
$2,258,000.

In an effort to nxpeditf4 the development of twenty-three (23)
single family homes on the city -owned St. Hugh oaks parcel, the
Department of Development .and dousing Conservation recommends
ratification of the attached Lmergency ordinance, amending
Section a, of Ordinance No. 10938, by decreasing the appropriation
for Capital Improvement Program Project No. 32L034, entitled
"Scatty?red Site Affordable Housing Development Program", in the
amount of $8171200, appropriating funds in the! amount - of.
$2,258,000 and establishing a new project entitled "saint Hugh
Oaks Village.ltousing Project No. 321040. The said funding will
be used to defray the cost of constructing twenty-three (23) new
single family homes on the ,,city -awned St. Hugh Oaks parcel
located in the Coconut Grove neighborhood.
