HomeMy WebLinkAboutO-11005J-92-458 6/10/92 ORDINANCE NO. 11005 AN ORDINANCE AMENDING CHAPTER 54-17 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY EXTENDING THE DEADLINE DATE FOR DEPOSIT(S) OF THE FUNDS NECESSARY TO PAY FOR THE CONSTRUCTION OF THE WALL(S) ACROSS NATOMA STREET, TA-LU-GA DRIVE AND ALATKA STREET TO THE DATE OF JANUARY 10, 1993; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, on April 11, 1991 the City Commission adopted Ordinance No. 10868 amending Section 54-17 of the Code of the City of Miami by authorizing the construction of wall(s) across Natoma Street, Ta-lu-ga Drive and Alatka Street at their Intersection with South Dixie Highway subject to the condition that construction of the wall(s) shall not commence until such time as neighbors have placed all funds necessary to pay for construction of the wall(s) on deposit with the City, with the deadline for such deposits) being established as July 4, 1991; and WHEREAS, the neighbors have requested that the deadline date be extended to provide sufficient time to collect all the funds necessary to pay for construction of the walls at all three locations; and WHEREAS, the City Commission after careful consideration of this matter, deems it advisable and in the best Interest of public safety and the general welfare of the City of Miami and Its inhabitants to amend the Code of the City of Miami, Florida, as amended, as set forth herein] 11005 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 54-17 of the Code of the City of Miami, Florida, as amended, Is hereby amended in the following particulars: 1l "Sec. 54-17. Prohibition of Vehicular/Pedestrian access. (f) The director of public works is authorized to place and erect a fence at city expense across Natoma Street, Ta-lu-ga Drive and Alatka Street at their Intersection with South Dixie Highway in the City of Miami, Florida, for enhancement of public safety by prohibiting pedestrian access at these locations. It Is further provided that as an alternative measure, a wall may be constructed by the city at any or all of such Intersections, subject to the condition that construction of the wall(s) shall not commence until such time as neighbors have placed all funds necessary to pay for construction of the wall(s) on deposit with the City of Miami, with the deadline for such deposit(s) being hereby established as duly 4, 1991 January 10, 1993." Section 2. If any section, or part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Odio City Manager RECOMMENDATION: DATE ;y L `�JFILE SUBJECT : Amendment to C I ty Code First Reading of Ordinance Amending Code Section 54-17 REFERENCES: ENCLOSURES : Ordinance The Department of Public Works recommends adoption of an ordinance amending Chapter 54 of the Code of the City of Miami entitled "Streets and Sidewalks" by amending Section 54-17 entitled "Prohibition of Vehicular Access/Pedestrian Access" by extending the deadline date for the deposit of funds necessary to pay for the construction of the walls across Natoma Street, Ta-lu-ga Drive and Alatka Street to January 10, 1993. BACKGROUND: On April 11, 1991, the City Commission adopted Ordinance No. 10868 amending City Code Section 54-17 authorizing the construction of walls across Natoma Street, Ta-lu-ga Drive and Alatka Street at their Intersection with South Dixie Highway subject to the condition that construction of the walls shall not commence until such time as neighbors have placed all funds necessary to pay for construction of the walls on deposit with the City. The Commission further established July 4, 1991, as the deadline date for the deposit of funds. Sufficient funding was collected by the neighbors to construct the wails at Natoma Street and Ta-lu-ga Drive and these walls have been constructed.
