AN EMERGENCY ORDINANCE AMENDING SECTIONS 1, 2, 5 AND 6 OF ORDINANCE NO. 10920, AS AMENDED, ADOPTED SEPTEMBER 30, 1992, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1992, FOR THE PURPOSE OF IMPLEMENTING BUDGETARY ADJUSTMENTS TO COMPLY WITH GENERALLY ACCEPTED ACCOUNTING PRINCIPLES AS OUTLINED BY THE CITY EXTERNAL AUDITORS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 10920, the Annual Appropriations Ordinance on September 26, 1991, establishing revenues and appropriations for the City of Miami, Florida, for Fiscal Year ending September 30, 1992; and WHEREAS, amendatory adjustments to the FY192 appropriations ordinance are required as a result of the following events taking place during FY'92; higher transfer fees incurred by the Solid Waste Department totaling $820,000 as a result of a $12 per ton increase in the disposal fee by Metropolitan Dade County; additional pension payments of $800,000; higher self insurance costs of $1,300,000 as a result of increased claims payments for vehicle liability, workers compensation, court ordered legal expenditures and the settlement between the City and F.O.P. regarding the Police Lieutenant exam and emergency expenses resulting from Hurricane Andrew (estimated $2,000,000); and 10997 WHEREAS, revenues to support these required budgeting adjustments are available from the General Fund, (Fund Balance) of $4,000,000, $420,000 from reserve for Self Insurance in Special Programs and Accounts and $500,000 from the claims payable account in the Self Insurance Trust Fund; and WHEREAS, the Special Obligation Debt Service Bond fund will have an estimated accumulated cash balance of $675,195 of which $260,195 is additional Telephone Franchise Revenues, and the balance after debt service payments will be transferred to the General Fund; and WHEREAS, Municipal Fuel Tax Street Repairs Fund has unspent monies in the amount of $250,000, and said monies will be transferred to the General Fund; and WHEREAS, the Environmental Storm Water Sewer Fund will revise its contribution to the General Fund from $2,100,000 to $4,100,000 for FY 192, said advance will be repaid in future years as permitted by cash flow requirements; and WHEREAS, sale of units in the Affordable Housing Program will generate revenue in the amount of $750,000, said revenues will be transferred to the General Fund; and WHEREAS, the City Manager is authorized to borrow monies from other City Funds to cover expenditures relating to Hurricane Andrew to be reimbursed from the Federal Emergency Management Administration (FEMA) or any other federal, state or local governmental agency or instrumentality; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: - 2 - 10997 Section 1. Sections 1, 2, 5 , and 6 of Ordinance No. 10920, as amended, adopted September 26, 1991, the Annual Appropriations Ordinance for the fiscal year ending September 30, 1992, is hereby amended in the following particulars: 1/ "Section 1. Section 3. All ordinances or parts of ordinances insofar as they are in conflict with provisions of this Ordinance are hereby repealed. _ 5 _ 10997 Section 4. If any section, part of sections, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 7. The Budget and Finance Departments have identified the need to make certain budgetary changes to the FY192 Annual Appropriations Ordinance. The reasons for these adjustments are stated below.
