HomeMy WebLinkAboutO-10992J-92-470 6/24/92 ORDINANCE NO. 10 9 9 2 AN EMERGENCY ORDINANCE AMENDING ORDINANCE NO. 10934, ADOPTED ON NOVEMBER 14, 1991, WHICH ESTABLISHED RESOURCES AND APPROPRIATIONS FOR THE SPECIAL REVENUE FUND ENTITLED "DRUG FREE NEIGHBORHOOD TASK FORCE" TO PROVIDE FOR AN INCREASE IN THE AMOUNT OF $45,450 AS A RESULT OF A SUCCESSFUL APPLICATION FOR ADDITIONAL GRANT FUNDS; AUTHORIZING THE CITY MANAGER TO ACCEPT THE ADDITIONAL GRANT FUNDS IN THE AMOUNT OF $45,450 FROM THE UNITED STATES JUSTICE DEPARTMENT THROUGH METROPOLITAN DADE COUNTY AND TO ENTER INTO ANY NECESSARY AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE PURCHASE OF EQUIPMENT AND RELATED COSTS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the U.S. Department of Justice, Office of Justice Programs, has approved the award of $400,000 toward a joint Task Force between the City of Miami and Metropolitan Dade County Police Departments to be administered by Metropolitan Dade County; and WHEREAS, the purpose of these funds is to focus more effort and resources on narcotics trafficking in specific geographical areas; and WHEREAS, Ordinance No. 10934, adopted November 14, 1991, created a special revenue fund entitled the "Drug Free Neighborhood Task Force," and established initial resources and appropriations in the amount of $42,967; and 10992 WHEREAS, as a result of a successful application for grant funds, there is an additional amount of $45,450 available to be deposited in the "Drug Free Neighborhood Task Force" fund; and WHEREAS, any purchases would have to comply with applicable City Code purchasing requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 of Ordinance No. 10934, adopted November 14, 1991, is hereby amended in the following particulars: 1,/ "Section 1. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: Drug Free Neighborhood Task Force RESOURCES: Metropolitan Dade County $42,967 $88,417 APPROPRIATIONS: Total Related Costs $It, 7`96$17,200 Total Equipment $312i7 $71 .217" Section 2. The City Manager is hereby authorized to accept the grant as set forth in the Preamble to this Ordinance and to enter into the necessary agreement(s), in a form acceptable to the City Attorney, a/ for the purchase of equipment and other related costs. Words and/or figures stricken through shall be deleted. Underscored words/or figures shall be added. The remaining provisions are not in effect and remain unchanged. The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. -2- 10992 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity of the City of Miami to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally .arty on the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. Odio City Manager DA-E FILE 3 _�I U 1Z) L S)j6J_C7 Emergency Ordinance Amending Ordinance No. 10934, "Drug Free Neighborhood Task Force" REF=REC E S ENCLOSURES It is respectfully recommended that the City Commission adopt the attached emergency ordinance, as amended, increasing the appropriations to the "Drug Free Neighborhood Task Force" fund by $45,450. pETOW109111 s Ordinance No. 10934, adopted on November 14, 1991, established resources and appropriations for the "Drug Free Neighborhood Task Force" fund, in the amount of $42,967. As a result of a successful application for additional grant monies, there are an additional $45,450 available for deposit into this fund. These funds will be utilized to continue the joint effort to combat crime in what has been called a High Intensity Drug Trafficking Area. Working with the State Attorney's Office and H.U.D. the City of Miami Police Department intends to concentrate its efforts in the Liberty Square Housing Projects and progress outward. The combined effort is designed to regain control of these areas as well as foster a cooperative relationship between the agencies involved. This Ordinance is being requested on an emergency basis on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, by curtailing narcotics trafficking and other criminal activities in selected areas. 10992 3-1 MIAMI REVIEW Published Daily except Saturday, Sunday and Legal Holidays Miami, Dade County, Florida.
