ORDINANCES NO.
AN ORDINANCE AMENDING CHAPTER 31, ARTICLE II,
ENTITLED "SCHEDULE OF OCCUPATIONAL LICENSE
TAXES" OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED, BY CLARIFYING THE
DEFINITION OF THE EXHIBITORS CLASSIFICATION
AND PROVIDING FOR A LOWER TAX WHEN THE EVENT
IS HELD IN A FACILITY OWNED BY THE CITY OF
MIAMI; CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Florida Statutes Subsection 205.042 and Chapter 31
of the City of Miami Code provide the authority for issuing
Occupational Licenses; and
WHEREAS, changing business environment requires updating
Chapter 31 of the City Code to provide adequate licensing of
businesses and professions in the City; and
WHEREAS, the definition for the "Exhibitors' classification
needs further clarification; and
WHEREAS, it is in the City's best interest to provide a
reduced tax for licenses required by the use of City facilities:
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. Article II, entitled "Schedule of Occupational
License Taxes", of Chapter 31 of the Code of the City of Miami,
Florida, as amended is hereby amended in the following
particulars:'
"CHAPTER 31
LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS
ARTICLE II. SCHEDULE OF OCCUPATIONAL LICENSE TAX
Sec. 31-35. Established.
The assessments of occupational license taxes are
hereby fixed as follows:

EXHIBITORS
(a) "General Exhibitor" is hereby defined as any
individual, partnership, or other incorporated or
unincorporated business entity, or promotor using
public facilities for the purpose of exhibiting or
displaying products or sale or to take orders to
sell their products, or to sell their products:
Per day $75.00
(b) When held in a facility owned by the City of Miami
where a fee has been charged for use of the
facility:

Section 2. All ordinances or parts of Ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 3. If any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.

It is respectfully recommended that the attached ordinance be
adopted amending the Code of the City of Miami, Florida, as
amended, Chapter 31, Article II, entitled "Schedule of
Occupational License Taxes", by clarifying the definition of the
exhibitors classification and providing for a lower tax when the
event is held in a facility owned by the City of Miami;
continuing a repealer provision and a severability clause; and
providing an effective date.
BACKGROUND:
Chapter 31 of the City Code requires any business, profession or
occupation operating or engaging in the City of Miami to procure
occupational licenses from the City of Miami
The Finance Department recommends that the "Exhibitor"
classification in the occupational license chapter be clarified
to explicitly allow sales of product in addition to allowing
exhibiting or displaying products for sale or to take order to
sell products. A reduced rate of 50% of the regular rate is
being recommended for exhibitors using City of Miami owned
facilities. State Statutes do not allow increases in municipal
occupational licenses.
At the first reading of this ordinance the City Commission
requested a comparison of the rates for the Exhibitor license to
those for retail merchants. The "Merchants Retail License" is
based on value of inventory with a base rate of $47.50 for the
first $1,000 of merchandise and $5.50 for each additional $1,000
or fractional part thereof. Attached "Occupational Licenses
Comparison" indicates that the average cost of the annual
"Merchants Retail License" is $280.00 and the mean (half of the
licenses are lower than this amount) is $102.50. The existing
"Exhibitor License" is $75 per day, with the proposed ordinance
reducing the daily rate to $37.50 for events held at City -owned
facilities.
