AN ORDINANCE AMENDING SECTIONS 14-26 AND 14-27 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, CONCERNING THE DOWNTOWN DEVELOPMENT AUTHORITY BOARD, BY PROVIDING THAT ONE (1) MEMBER OF THE CITY COMMISSION SHALL SERVE AS CHAIRPERSON OF THE BOARD AND THE TWENTY-NINTH (29) MEMBER; FURTHER BY DELETING THE PROVISION WHICH ALLOWS THE MAYOR TO RELINQUISH THE POSITION OF CHAIRMAN; FURTHER PROVIDING THAT ANY MEMBER OF THE CITY COMMISSION SHALL BE ELIGIBLE FOR APPOINTMENT TO THE BOARD; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, by the authority of Chapter 65-1090 of the general laws of the state and pursuant to Ordinance No. 7652, adopted on April 25, 1968, the downtown development authority of the City was created; and WHEREAS, pursuant to said Ordinance, the affairs of said authority are under the direct supervision and control of a board consisting of twenty-nine (2.9) members confirmed by the City Commission, with the Mayor serving as chairman and the twenty- ninth (29th) member of said board; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 14-26 and 14-27 of the Code of the City of Miami, Florida, as amended, are hereby amended in the 10985 -1- following particulars:l/ "Sec. 14-26. (a) Each appointed member of the board shall reside in or have his or her place of business or public office in the city. He or she shall be an individual of outstanding reputation for integrity, responsibility and business ability and acumen. No officer or employee of the city other than the mayor &-- one member of the city commission shall be eligible for appointment to the board. Not less than thirty (30) days prior to the expiration of any member's term, or within thirty (30) days of the existence of a vacancy, the remaining members of the board shall nominate a successor and submit the name to the commission of the city for its confirmation of appointment, with the exception of the members who were nominated by the board of county commissioners and the 1/ Words and/or figures stricken through shall be deleted. In accordance with the provisions of law and with the provisions of this Ordinance, the appointment of each City Commissioner currently serving as a manber of any authority, board or committee created by resolution or ordinance shall be subject to the review of the City C.armission on an annual basis cam w cing June 1, 1990, such review to take place on or before the anniversary date of such appointment. It is the intent of the City Commission that each Cc missioner be considered for appointment to an authority, board or committee before any one Camu ssioner shall have served a consecutive term; however, there shall be no prohibition against any Commissioner from being reappointed to serve consecutive terms. Section 2. The City Clerk is hereby directed to take necessary steps to implement the provisions of Section 1 hereof by forthwith providing the City Commission and City Manager with information concerning the affected authority, boards or committees in regard to the length of past service by those City Commissioners so serving thereon. In each succeeding year and not later than 60 days before the first day of the month set forth in Section 1 above, the City Manager shall present the City Commission with a report on this subject for Commission review and oonsideratiom at a City Commission meeting scheduled to take place no later than 30 days before the first day of the month set forth in Section 1 above. Section 3. All ordinances or parts of ordinances in conflict herewith insofar as they are in conflict with the provisions of this Ordinance are hereby repealed. a 010'715 s Section 4. If any section, part of this section, paragraph, clause, phrase or word of this ordinance is declared invalid, the ruining provisions of this Ordinance shall not be affected. Section 5. It is the intention of the City Camiission that the provisions of this Ordinance shall became and be made a part of the code of the City of Miami, Florida, as amended, which provisions may be renumbered of relettered and that the word 'ordinance" may be changed to "section", "article", or other appropriate word to accarplish such intention.
