ORDINANCE NO.
AN EMERGENCY ORDINANCE AMENDING CHAPTER 54.5
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "SUBDIVISION REGULATIONS",
BY AMENDING SECTION 54.5-7 ENTITLED "SAME
[PLATS AND PLATTING] -PROCEDURE -CONFERENCE AND
TENTATIVE PLAT", BY EXTENDING FROM ONE YEAR
TO TWO YEARS THE TIME FRAME REQUIRED TO
OBTAIN FINAL PLAT APPROVAL BY THE CITY
COMMISSION AFTER APPROVAL OF THE TENTATIVE
PLAT BY THE PLAT AND STREET COMMITTEE FOR
GOVERNMENTAL ENTITIES AND AGENCIES; AMENDING
SECTION 54.5-13 ENTITLED "REQUIRED
IMPROVEMENTS", BY PROVIDING A WAIVER OF THE
BOND REQUIREMENT FOR THE REQUIRED
IMPROVEMENTS FOR GOVERNMENTAL ENTITIES AND
AGENCIES; PROVIDING FOR AN EFFECTIVE DATE;
AND CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, Section 54.5-7 of the Code of the City of Miami,
Florida, as amended, ("Code"), "Same [Plats and Platting] -
Procedure -Conference and tentative plat", provides a maximum one
(1) year time frame to obtain approval of a final plat by the
City Commission after approval of the tentative plat by the Plat
and Street Committee; and
WHEREAS, Section 54.5-13 of the Code, entitled "Required
Improvements" requires a subdivider submitting a plat or replat
to furnish an adequate bond for the

WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
the Code of the City of Miami, as amended, as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble of this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Sections 54.5-7 and 54.5-13 of the Code of
the City of Miami, Florida, as amended, are hereby amended in the
following particulars:l/
"Sec. 54.5-7. Same [Plats and Platting] -
Procedure -Conference and tentative
plat.
(E) Approval of tentative plat. Approval and
recommendation of the tentative plat by the plat and
street committee shall be valid for a period of one (1)
year under the terms and conditions stipulated by the
committee for said approval except for governmental
entities and agencies which shall be valid for a period
of two (2) years. In the event that the subdivider
does not submit a final plat and receive commission
approval within the above specified time limit, the
plat shall be deemed abandoned and must be resubmitted
with a new application and payment of the required
fees."

RECOMMENDATION:
The Department of Public Works respectfully recommends the
adoption of an emergency ordinance amending Chapter 54.5 of the
Code of the City of Miami entitled "Subdivision Regulations" by
amending Section 54.5-13 entitled "Required Improvements" by
waiving the bond requirement for the required subdivision
improvements for governmental entities and agencies and Section
54.5-7 entitled "Same -Procedure -Conference and Tentative Plat" by
providing an exemption to government entities and agencies from
the one year time period required to obtain final plat approval
by the City Commission after approval of the tentative plat by
the Plat and Street Committee.
BACKGROUND:
Section 54.5-13 of the City Code entitled "Required improvements"
requires a subdivider submitting a plat or replat to furnish an
adequate bond for the required subdivision improvements as a
method to ensure compliance to that section of the Code.
Subsequent to the adoption of this section of the Code, City Code
Section 54-30, entitled "Agreement and bond as to paving and
other improvements by persons submitting plats, replats, etc., to
commission" recognized that the bond was an unnecessary
requirement for plats submitted by government agencies and waived
the bond requirement for government entities and agencies.
Unfortunately, this waiver is not included in the superseding
Code Section 54.5-13 which specifically regulates the
requirements of platting. In addition, Section 54.5-7 of the
City Code entitled "Same -Procedure -Conference and Tentative Plat"
establishes a one (1) year time frame for a subdivider to obtain
final plat approval by the Commission after the approval of the
tentative plat by the Plat and Street Committee. This time limit
has been established to ensure timely completion and development
of the plat. However, often times governmental entities are
delayed in meeting the requirements of platting due to the need
to gain approvals from their own governing boards and legal
staff. The one (1) year time frame requirement can result in a
hardship for the governmental entity and seriously delay an
important public interest project.

Since the improvement bond and one (1) year plat approval time
limit are unnecessary and burdensome requirements for government
entities and agencies submitting plats or replats and
inconsistent with other parts of the Code, the Public Works
Department recommends the adoption of the attached Ordinance
waiving these requirements for plats submitted by government
entities and agencies.
Several tentative plats that have been previously submitted by
the Dade County School Board are currently being delayed and
their approvals are being jeopardized due to these requirements.
The Public Works Department respectively recommends that this
Ordinance be considered on an emergency basis to allow these
plats to proceed for final plat and to not further delay the
construction of the schools.
