ORDINANCE NO. 10972
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 11000, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION OF THE
PROPERTY LOCATED AT APPROXIMATELY 4370-4650
NORTHWEST 7TH STREET, (SOUTH SIDE ONLY),
MIAMI, FLORIDA, (MORE PARTICULARLY DESCRIBED
HEREIN), FROM R-3 MEDIUM -DENSITY MULTI -FAMILY
RESIDENTIAL TO 0-OFFICE; BY MAKING FINDINGS;
BY MAKING ALL NECESSARY CHANGES ON PAGE NO.
32 OF SAID ZONING ATLAS; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of September 4, 1991, Item No. 2, following an advertised public
hearing, adopted Resolution No. PAB 50-91, by a 9 to 0 vote,
RECOMMENDING APPROVAL of a change of zoning classification, of
the hereinafter legally described property less Lot 2 of Block 4,
MORRIS MANOR, according to the plat thereof as recorded in Plat
Book 46 at page 56 of the Public Records of Dade County, Florida;
Lot 4 of Block 2, Lot 4 of Block 3, Lot 4 of Block 4, WATERMAN
PARK, according to the plat thereof, as recorded in Plat Book 19
at page 47 of the Public Records of Dade County, Florida; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the

general welfare of the City of Miami and its inhabitants to amend
the Zoning Atlas as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 11000, the
Zoning Ordinance of the City of Miami, Florida, as amended, is
hereby amended by changing the zoning classification from R-3
Medium -Density Multi -Family Residential to 0-Office for the
property located at approximately 4370-4650 Northwest 7th Street,
(south side only), Miami, Florida, more particularly described as
Lots 3-13 of Block 1, Lot 1 of Block 4, MORRIS MANOR, according
to the plat thereof, as recorded in Plat Book 46 at Page 56 of
the Public Records of Dade County, Florida; and Lot 1-3 of Block
2, Lots 1-3 of Block 3, and Lots 1-3 of Block 4, WATERMAN PARK,
according to the plat thereof, as recorded in Plat Book 19 at
Page 47 of the Public Records of Dade County, Florida.
Section 2. It is hereby found that this zoning
classification change:
a. is not out of scale with the needs of the
neighborhood or the City;
b. maintains the same or similar population density
pattern and thereby does not increase or overtax
the load on public facilities such as schools,
utilities, streets, etc.;
C. existing district boundaries are illogically drawn
in relation to existing conditions on the property
proposed for change;

d. is necessary due to changed or changing
conditions;
e. proposed change positively influences living
conditions in the neighborhood.;
f. has the same or similar impact on traffic and does
not affect public safety to a greater extent than
the existing classification;
g. has the same or similar impact on property values
in the adjacent areas as the existing
classification;
h. proposed change will contribute to the improvement
or development of adjacent property in accord with
existing regulations;
i. the proposed change conveys the same treatment to
the individual owner as to the owner within the
same classification and the immediate area; and
furthers the protection of the public welfare; and
j. it is difficult to find other adequate sites in
the surrounding area for the proposed use in
districts already permitting such use.
Section 3. Page No. 32 of the Zoning Atlas, made a part of
Ordinance No. 11000 by reference and description in Article 3,
Section 300 thereof, is hereby amended to reflect the changes
made necessary by this amendment.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.

Section 5. If any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective forty-five
(45) days after final reading and adoption thereof.

REQUEST To rezone the subject property to 0-Office
PLANNING RECOMMENDATION Approval.
BACKGROUND On May 6, 1991, the Zoning Board reviewed an
application for change of zoning for 4510 N.W.
7th Street and deferred the item, requesting a
study. On July 15, 1991, the Zoning Board
reviewed the study and recommended that instead
of 0-Office' as recommended in the study, that
the area should be rezoned to C-1. The
applicant will withdraw the application for
change of zoning.

ANALYSIS This proposed re -zoning. requires a plan
amendment, which is a companion item.
residential character is difficult to sustain
because of the heavy traffic, and noise on N.W.
7th Street. Some five of the 23 residential
structures have a home occupation license for
office use. These gradually changing conditions
dictate a change of zoning to Office, which will
allow offices to occupy the residential
structures, provided there is adequate parking.

At its seating of September 4, 1991, the
Planning Advisory Board adopted Resolution

Five replies AGAINST and eleven in FAVOR
were received by mail.
CITY COMMISSION At its meeting of October 24, 1991, the
City Commission passed the above on First
Reading.
