AN ORDINANCE AMENDING THE FUTURE LAND USE MAP
OF ORDINANCE NO. 10544, AS AMENDED, THE MIAMI
COMPREHENSIVE NEIGHBORHOOD PLAN 1989-2000,
FOR THE PROPERTY LOCATED AT APPROXIMATELY
4370-4650 NORTHWEST 7TH STREET, (SOUTH SIDE
ONLY), MIAMI, FLORIDA, (MORE PARTICULARLY
DESCRIBED HEREIN), BY CHANGING THE LAND USE
DESIGNATION OF THE SUBJECT PROPERTY FROM
MEDIUM -DENSITY MULTI -FAMILY RESIDENTIAL TO
OFFICE; BY MAKING FINDINGS; INSTRUCTING THE
TRANSMITTAL OF A COPY OF THIS ORDINANCE TO
AFFECTED AGENCIES; CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of September 4, 1991, Item No. 1, following an advertised public
hearing, adopted Resolution No. PAB 49-91, by a 9 to 0 vote,
RECOMMENDING APPROVAL of an amendment to the Future Land Use Map
of Ordinance No. 10544, as amended, the Miami Comprehensive
Neighborhood Plan 1989-2000, of the hereinafter legally described
property less Lot 2 of Block 4, MORRIS MANOR, according to the
plat thereof as recorded in Plat Book 46 at page 56 of the Public
Records of Dade County, Florida; Lot 4 of Block 2, Lot 4 of Block
3, and Lot 4 of Block 4, WATERMAN PARK, according to the plat
thereof, as recorded in Plat Book 19 at page 47 of the Public
Records of Dade County, Florida; and

WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this Comprehensive Plan change as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Future Land Use Map of Ordinance No. 10544,
as amended, the Miami Comprehensive Neighborhood Plan 1989-2000,
is hereby amended by changing the land use designation from
Medium -Density Multi -Family Residential to Office for the
property located at approximately 4370-4650 Northwest 7th Street,
(south side only), Miami, Florida, more particularly described as
Lots 3-13 of Block 1, Lot 1 of Block 4, MORRIS MANOR, according
to the plat thereof, as recorded in Plat Book 46 at Page 56 of
the Public Records of Dade County, Florida; and Lots 1-3 of Block
2, Lots 1-3 of Block 3, and Lots 1-3 of Block 4, WATERMAN PARK,
according to the plat thereof, as recorded in Plat Book 19 at
Page 47 of the Public Records of Dade County, Florida.
Section 2. It is hereby found that this Comprehensive Plan
designation change:
a. is necessary due to changed or changing
conditions;
b. involves a residential land use of 5 acres or less
and a density of 5 units per acre or less or
involves other land use categories, singularly or
in combination with residential use, of 3 acres or

less and does not, in combination with other
changes during the last year, produce a cumulative
effect of having changed more than 30 acres;
C. is one which involves property that has not been
the specific subject of a Comprehensive Plan
change within the last year; and
d. is one which does not involve the same owner's
property within 200 feet of property that has been
the subject of a Comprehensive Plan change within
the last year.
Section 3. The City Manager is hereby instructed to direct
the Director of Planning, Building and Zoning to transmit a copy
of this Ordinance immediately upon approval on first reading to
Bill Sadowski, Secretary, Florida Department of Community
Affairs, 2740 Centerview Drive, Tallahassee, Florida 32399-2100,
for 90 day review and comment.
Section 4. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 5. If any section, part of this section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective forty-five
(45) days after final reading and adoption thereof.

The City of Miami, on April 30, 1992, adopted Ordinance 10971 amending the
Miami Comprehensive Neighborhood Plan 1989-2000 (MCNP). This proposed
amendment is a small scale development activity and, according to Chapter
163.3187, was submitted without regard to statutory limits on the frequency of
consideration. Pursuant to the requirements of Chapter 163.3184 F.S. 1987 and
Rule 9J-11.011, Florida Administrative Code, and the direction of the
De artment of Community Affairs (DCA), I am pleased to provide you with four

Consideration of amending Ordinance 10544, as
amended, Miami Comprehensive Neighborhood Plan,
1989-2000, Future Land Use Plan Map, by changing
the land use designation of the subject property
from MEDIUM DENSITY MULTI FAMILY RESIDENTIAL to
OFFICE, per Resolution PAS 43-91, July 10, 1991.
REQUEST To amend the Comprehensive Plan map by changing
the designati0'n for the subject property to
office.
PLANNING RECOMMENDATION Approval.
BACKGROUND This amendment, if approved for transmittal on
first reading, will be forwarded to the Florida
Department of Community Affairs as a small scale
amendment without regard for the number of times
proposed amendments are forwarded annually.
On April 17, 1991, the Planning Advisory Board
reviewed an application for plan amendment to
C-1 for the property at 4510 N.W. 7th Street and
recommended approval by Resolution PAS 24-91.
By Resolution PAS 25-91, a Planning Study was
requested.
On July 10, 1991, the Planning Advisory Board
reviewed the Planning Study (attached) for this
area and approved the concept by Resolution PAB
43-91. 10971
ANALYSIS Eighteen of the existing structures are
developed and used primarily as residential
single family, duplex and multi -family, while
five have office uses with a home occupation
license.
The increased densities created by this
amendment are not inconsistent with the low and
medium density land use pattern.
This type of change meets the requirements of
goals, objectives and policies established in
the MCNP which require the City to 1) protect
all areas from encroachment of incompatible land
uses; 2) protect and enhance the general
appearance and character of the City's
neighborhoods; and 3) promote the efficient use
of land use and minimize land use conflicts.
RECOMMENDATIONS At its meeting of September 4, 1991, the
PLANNING ADVISORY BOARD Planning Advisory Board adopted Resolution
PAB 49-91, by a 9-0 vote, recosmeading
approval of the above, deleting the 4 lots
not facing NU 7 Street.
Five replies AGAINST and eleven in FAVOR
were received by nail.
CITY COMMISSION At its sleeting of October 24, 1991, the
City Comissioa passed the above on First
Reading.

DISCUSSION
The subject 1.9 acre area is located in the south side of NW 7th Street,
between NW 43rd Place and 47th Avenue, being approximately 4370-4650 NW 7th
Street, in the Flagami Planning District.
MCNP Land Use Policy 1.6.1., establishes future land use categories according
to the Future Land Use Plan Map and the "Interpretation of the Future Land Use
Plan Map". The subject property is currently designated "Multifamily Medium
Density --Residential". Blocks to the east and west. on the south side of NW
7th Street are designated "Restricted --Commercial"; to the north, i-n the north
side of NW 7th Street, there is also a 'Restricted --Commercial" land use
designation, while to the south is a "Residential-- Duplex" land use
designation.
The "Multifamily Medium Density --Residential" land use category permits
multifamily structures up to low-rise apartment structures and lower density
residential structures. Permissible uses include accessary commercial and
office activities in the same building that are intended to serve the
retailing and personal services needs of the immediately surrounding
neighborhood and community -based residential facilities (14 clients or less).
The "Office" category allow residential uses to a maximum density equivalent
to "High Density Multifamily Residential" subject to the same limiting
conditions; transitory residential facilities such as hotels and motels;
general office use; clinics and laboratories; and limited commercial

activities incidental to principal activities in designated areas. Supporting
facilities such as auditoriums, libraries, convention facilities, places of
worship, and primary and secondary schools may be allowed with the "Office"
designation.
The Planning, Building and Zoning Department contends that the increased
densities created by this amendment are not inconsistent with the low and
medium density land use pattern that is existing in the area.
The 23 structures on the south side of NW 7th Street are developed primarily
as residential single family, duplex and multi -family except for five with
office uses which have a home occupation license. Northwest 7th Street is a
major transportation arterial street. The traffic carried by NW 7th Street
creates a busy, noisy, environment which is difficult to reconcile with
strictly residential use.
MNCP Land Use Goal 1, requires the City to promote the' efficient use of land
use and minimize land use conflicts. The change also, would be consistent with
Land Use Policy 1.1.3. which requires that all areas of the City be protected
from encroachment of incompatible land uses. Housing Policies 1.1.5. and
1.2.7. require the City to preserve and enhance the general appearance and
character of the City neighborhoods. Together these goals and policies argue
that the existing land use pattern in this area should be changed.
In addition, Land Use Policy 1.1.1. Requires development or redevelopment,
that results in an increase in density or intensity of land use, to be
contingent upon the availability of public facilities and services that meet
or exceed the minimum LOS standards adopted in the Capital Imiprovement Element
(ICE) Policy 1.2.3.. The attached Concurrency Management Analysis pertaining
to concurrency demonstrates that no levels of service would be reduced to or
below acceptable City-wide levels. "

No. 91-10) for the City of Miami which was submitted on
November 7, 1991. Copies of the proposed amendment have
been distributed to appropriate state, regional and local
agencies for their review and their comments are enclosed.
The Department has reviewed the proposed amendments for
consistency with Rule 9J-5, Florida Administrative Code, Chapter
163, Part II, Florida Statutes, and the adopted City of Miam
Comprehensive Plan. The Department raises no objections•to `aie
proposed amendment, and this letter serves as our Objections '
Recommendations and Comment Report. 75
This letter and the enclosed external agency comments are
being issued pursuant to Rule 9J-11.010, Florida Administrative
Code. Upon receipt of this letter, the City of Miami has 60 days.

This Department has reviewed the referenced City of Miami Comprehensive
Neighborhood Plan amendment which you transmitted to us under cover
memorandum dated November 15, 1991. We reviewed the proposed amendment
primarily to identify points of consistency or inconsistency with the
provisions of Dade County's Comprehensive Development Master Plan
,(CDMP). The following comments are offered for your consideration.
This amendment application, proposed by the City of Miami Planning,
Building and Zoning Department, consists of a 2.7 acre area located on
4the south frontage of NW 7 Street between NW 43 Place and NW 47 Avenue.
The request is to change the site's land use designation on the City's
Future Land Use Plan Map from "Multifamily Medium Density -Residential"
to "Office". Permitted uses within the "Office" designation include:
residential uses to a maximum density equivalent to "High Density
Multifamily Residential" (150 dwelling units per acre), hotels, motels,
general office uses, clinics and limited commercial uses incidental to
principal activities in designated areas. Contiguous areas to the east
and west of the site on the south frontage of NW 7 Street are designated
"Restricted -Commercial"; to the north on the north side of NW 7 Street
the land use designation is "Restricted -Commercial"; and the contiguous
area to the south of the proposed amendment site is designated
"Residential Duplex". According to the information submitted in the
amendment application the area is fully developed as single-family,
duplex and multifamily residential units except for three lots which
have office uses.
The Metro -Dade County CDMP Land Use Plan map designates the amendment
site as "Medium Density Residential Communities". The CDMP Land Use
Element text allows approval of office uses on site$ having the

characteristics of the application site. Specifically, the CDMP text on
page I-22 and 23 as amended October 22, 1991, under the heading
"Commercial Uses (in Residential Areas)" states that Office uses may be
approved in residential community areas where the residential lot fronts
directly on a Major Roadway as designated on the Land We Plan map; the
lots do not exceed one acre in size; and the residential area is not
zoned, developed or designated on the Land Use Plan map for Estate
Density Residential (up to 2.5 dwelling units per acre), and the
property does not face such an Estate Density area.
On balance, we find that this amendment application would not be
inconsistent with the policies of the Metro -Dade County CDMP given that
the application site which is made up of 21 individual lots ,directly
fronts on NW 7'Street, a Major Roadway; office uses already exist on 3
of the 21 lots; individual lot sizes are less than one acre in size; the
application area and vicinity are not zoned, developed, or designated
for estate type residential densities, and the proposed office use
designation would be compatible with the commercial uses to the east,
west and north. We have also reviewed the availability of County public
facilities and services, and find that no County -wide levels of service
would be reduced below acceptable levels.

Introduction
On November 18, 1991, staff received the proposed comprehensive plan amendment No. 91-10 (DCA
No. 92S2) for the City of Miami transmitted from the Department of Community Affairs for review of
consistency with the Regional Plan for South Florida. Staff review is undertaken pursuant to the Local
Government Comprehensive Planning and Land Development Regulation Act, Chapter 163, Part II,
Florida Statutes, and Rules 9J-5 and 9J-11, Florida Administrative Code.
Summary of Staff Anal
Amendment No. 91-10 proposes to change an area of 2.7 acres on the future land use map from
"Medium Density Multi -family Residential" to "Office". The contents and location of the amendment
are described in Attachment 1.
Amendment No. 91-10 qualifies as proposed small scale development activities pursuant to subsection
163.3187(1)(c), Florida Statutes. Because of the scale and nature of this amendment, staff finds that
amendment No. 91-10 will not generate significant adverse regional impacts. Staff will continue to
work with local governments, the Department of Community Affairs, and other review agencies
during the remainder of the amendment review and adoption process.
Recommendation
Find the proposed comprehensive plan amendment No. 91-10 (DCA No. 92S2) for the City of Miami
generally consistent with the Regional Plan for South Florida. Approve this summary for transmittal to
the Department of Community Affairs.

According to this agency's responsibilities under section
267.061, Florida Statutes, and the provisions of sections
163.3177 and 163.3178, Florida Statutes, and Chapter 9J-5,
Florida Administrative Code; we have reviewed this proposed
amendment to the City of Miami Comprehensive Plan regarding land
use changes to see if data regarding historic resources have been
given sufficient consideration.
The proposed change in land use designation, from multifamily
residential to office, of a 2.7 acre parcel near 4370-4650 NW 7th
Street should have no effect on Miami's historic resources. Our
review of this project revealed that it has previously been
surveyed by the Historic Preservation Division of the Metro Dade
Office of Community and Economic Developed. The survey revealed
that no historically significant structures were located in this
area. Further, it is our opinion that the property holds little
promise for containing significant, undisturbed archaeological
resources.
In sum, it is opinion of this agency that the amended
comprehensive plan meets the concerns of the Division of
Historical Resources and the State of Florida's requirements as
promulgated in Chapters 163.3177 and 163.3178, F.S., and Chapter
9J-5, F.A.C., regarding the identification of known historical
resources within their specified area of jurisdiction, and for
the establishment of policies, goals and objectives for
addressing historical and potentially significant historical
