HomeMy WebLinkAboutO-10964J-92-165 2/28/92 ORDINANCE NO. 10964 AN ORDINANCE AMENDING CHAPTER 54 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREET AND SIDEWALKS" BY AMENDING SECTION 54-104 ENTITLED "NONSTANDARD STREET WIDTHS" BY MODIFYING THE WIDTH OF A CERTAIN STREET; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of Chapter 54 of the Miami City Code establishes base building line locations for all public streets within the City of Miami; and WHEREAS, Bayvlew Road between Main Highway southeasterly to Its terminus, south Coconut Grove, Miami, Florida, is lined with tall palm trees and lush landscaping and developed in harmony with the scale and style of the residences in the neighborhood; and WHEREAS, the property owners abutting Bayview Road have expressed a strong desire- in preserving the tall palms, landscaping and character of the roadway; and WHEREAS, the City Administration explained that to preserve the tall palms, landscaping and scale of the aforementioned roadway in relation to the neighborhood residences, the zoned street width of this section of Bayvlew Road would have to be reduced from 50 feet to 25 feet; and WHEREAS, the Police, Fire, Rescue and Inspection Services and Solid Waste Departments have evaluated the effects of the reduction of the zoned street width of this section of Bayvlew Road on their operations and have no substantial objections; 10964 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 54-104 of the Code of the City of Miami, Florida, as amended, is hereby amended In the following particulars: 1/ "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES Sec. 54-104. Nonstandard street widths. Base building Iines shall be located from the centerline as specified for each of the following streets: (203.1) Bayvlew Road, Main Highway southeast to Its terminus.............................12.5 * at Section 2. All Ordinances, or parts of Ordinances insofar as they are inconsistent or In conflict with provisions of this Ordinance are hereby repealed. 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks Indicate omitted and unchanged material. _2_ 10964 Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. This Ordinance shall become effective 30 days after final reading and adoption thereof. Od l o ENCLOSURES Ordinance, Location Map, City Manager Department Memorandums RECOMMENDATION: It Is respectfully recommended that the City Commission adopt the attached Ordinance amending Chapter 54 of the Code of the City of Miami entitled Streets and Sidewalks" by amending Section 54-104 entitled "Nonstandard Street Widths". BACKGROUND: Article V of Chapter 54 of the Miami City Code establishes the width of all public streets within the City by establishing base building line locations. The Department of Public Works is proposing to change the base building line location for Bayview Road from Main Highway southeasterly to Its terminus (approx. 1.000.feet) by adding this street to Section 54-104 entitled "Nonstandard Street Widths"'. Bayvlew Road is currently zoned 50 feet In width, however, the original subdivisions that created this roadway dedicated a total width of only 20 feet. Tall palm trees and lush landscaping currently line the roadway along Its entire length and 100% of the abutting property owners have expressed a strong desire, by petition, In preserving the character of the road and the neighborhood. The Public Works Department, working wlth the property owners of Bayvlew Road, has determined a suitable roadway width. that Is in scale with the existing residences, preserves the palm trees and landscaping and provides for the necessary City vehicles that must serve the neighborhood. The Public Works Department, wlth concurrence of the Fire, Rescue and Inspection Services, Police and Solid Waste Departments, recommends that the zoned width of Bayvlew Road be reduced from 50 feet to 25 feet. 10964 o� i� wt.
