AN ORDINANCE ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "EMERGENCY SHELTER GRANT (FY'92)"; APPROPRIATING FUNDS FOR OPERATION OF SAME IN THE AMOUNT OF $287,000 FROM THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (USHUD) 1992 EMERGENCY SHELTER GRANT; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the U.S. Department of Housing and Urban Development (USHUD) notified the City of Miami that it is eligible to receive an FY'92 Emergency Shelter Grant in the amount of $287,000 from the Stewart B. McKinney Homeless Assistance Act to provide programs for the homeless; and WHEREAS, the City Commission adopted Resolution No. 92-86 on February 13, 1992, which authorized the City Manager to accept a grant award in the amount of $287,000 to the U.S. Department of Housing and Urban Development for the 1992 Emergency Grant; and WHEREAS, Resolution No. 92-86 further authorized the City Manager to execute the necessary implementing agreement with USHUD; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. 10953 Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: EMERGENCY SHELTER GRANT (FY'92) RESOURCES: U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT $287,000 APPROPRIATION: FY'92 EMERGENCY SHELTER GRANT $287,000 Section 3. This appropriation is contingent upon funding by the U.S. Department of Housing and Urban Development. Section 4. The herein authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. Section 5. If any section, part of section, paragraph clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. All ordinances or parts of ordinances insofar as they are in conflict with the provisions of this Ordinance are hereby repealed. Section 7. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. PASSED ON FIRST READING BY TITLE ONLY this 13th day of February , 1992. Odio FROM City Manager REFERENCES Agenda Item ENCLOSURES February 13, 1992 RECOMMENDATION It is respectfully recommended that the City Commission approve the attached ordinance establishing a new special revenue fund entitled "Emergency Shelter Grant 1992" and appropriating funds for said purpose. BACKGROUND The Department of Community Development has prepared the attached ordinance establishing a new special revenue fund entitled "Emergency Shelter Grant 1992" and appropriating funds for said purpose. USHUD notified the City of Miami that it is entitled to receive an Emergency Shelter Grant of $287,000 as a result of the Stewart B. McKinney Homeless Assistance Act adopted by Congress to provide services to the nation's homeless population. The grant requires a one-to-one match which may be met through either cash or in kind services. This is the City's seventh emergency shelter grant and is based on the same formula used to award Community Development Block Grant Funds to eligible jurisdictions. The City's 1992 ESG application maintained support of the Beckham Hall Shelter ($244,950) for homeless males and provided $42,050 for the City operated project for the homeless at the I-395 underpass. The City's application for this grant has been submitted to USHUD to meet the February 6, 1992 deadline and it is anticipated that USHUD approval will be received within 30 days. The emergency shelter grant may be used only for one or more of the following eligible activities related to emergency shelter for the homeless: 1. Renovation, major rehabilitation, or conversion of buildings for use as emergency shelters for the homeless. 2. Provision of essential services (which may include employment, health, substance abuse, education of food) if, i. the service is a new service or there is a y 3� Honorable Mayor and Members - 2 - of the City Commission quantifiable increase in the level of service from the prior 12 month period; and ii. not more than 30% of the total grant may be used for these services. 3. Payment of maintenance, operation (including rent, excluding staff), insurance, utilities and furnishings. 4. The development and implementation of homeless prevention activities (not more than 30% of the total grant may be used for these services). Adoption of the proposed legislation establishes a new special revenue fund and appropriates FY'92 Emergency Shelter Grant funds. This is a companion item to a proposed resolution authorizing the City Manager to accept the Emergency Shelter Grant, enter into implementing agreements with USHUD and allocates funds to approved projects. 2 10953 MIAMI REVIEW Published Daily except :Saturday, Sunday and Legal Holidays Miami, Dade County, Florida.
