AN EMERGENCY ORDINANCE AMENDING ARTICLE II, "BURGLARY AND ROBBERY ALARMS" OF CHAPTER 3.5, "ALARM SYSTEMS" OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY SETTING FORTH PROVISIONS DEALING WITH FALSE ALARMS INCLUDING THE INSTANCE WHERE A SYSTEM FOR WHICH NO ALARM PERMIT HAS BEEN ISSUED OR HAS NOT BEEN RENEWED GENERATES A FALSE ALARM; PROVIDING FOR THE SUSPENSION OF POLICE RESPONSE TO ALARMS AFTER TWELVE FALSE ALARMS AND IN THE INSTANCE WHERE NO PERMIT HAS BEEN ISSUED OR HAS EXPIRED AFTER FOUR FALSE ALARMS; SETTING FORTH PROVISIONS FOR THE REINSTATEMENT OF POLICE SERVICE; AUTHORIZING NOTICE TO BE SENT BY CERTIFIED MAIL; MORE PARTICULARLY AMENDING SECTION 3.5-23 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; FURTHER REPEALING SECTION 3.5-29 IN ITS ENTIRETY AND SUBSTITUTING NEW PROVISIONS ENTITLED "FALSE ALARM SERVICE CHARGES; ENFORCEMENT PROVISIONS"; AND CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 3.5-23 of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars: .1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. KPLKEC Y1 08alIitANCE "Sec. 3.5-23. Alarm user permits required; fee; renewal; enforcement provisions. (d) Whenever the police responds to a location where no alarm permit has ever been issued or the alarm permit has expired for the alarm system generating a false alarm, a copy of City Code Section 3.5-23 entitled "Alarm permits required; fee; renewal; enforcement provisions." shall be sent by certified mail return receipt requested to the alarm user who will also be notified as follows: (i) The alarm user will be billed a one hundred and fifty dollar ($150.00) fine for each subsequent police response to an activation by an alarm system for which no alarm permit has every been issued pursuant to Sec. 3.5-23 (a)-(b). (ii) The alarm user will be billed a one hundred dollar ($100.00) fine for each police response to an activation by an alarm system for which the alarm permit has not been renewed pursuant to Sec. 3.5-23 (c). (iii) Police service will be discontinued after the fourth occurrence of police responding to an activation by an alarm system for which no permit has ever been issued or the alarm permit has not been renewed. fz} LelIf a business has one (1) or more alarm systems protecting two (2) or more separate structures having different addresses, a separate permit will be required for each structure. (f) To reinstate police service the alarm user must obtain a valid alarm permit pursuant to Sec. 3.5-23 (b) or (c) and pay all outstanding fines." Section 2. Sec. 3.5-29 of the Code of the City of Miami, Florida, as amended, is hereby repealed in its entirety and the following is substituted in its place: -2- 1094 Sec. 3.5-29. False alarm service charges; enforcement provisions. (A) There shall be no service charge for the first five (5) false alarms during a permit year. There shall be a service charge of twenty-five dollar ($25.00) for the sixth through eighth false alarm; a fifty dollar ($50.00) service charge for the ninth and tenth false alarm; and a one hundred dollar ($100.00) service charge for the eleventh and twelfth false alarm occurring in a permit year. (B) Police will not respond to alarms at locations where twelve or more false alarms occurred in a permit year. (C) A notice that police service will be discontinued will be sent to the alarm user by certified mail return receipt requested at least thirty (30) days prior to discontinuing police service. (D) Reinstatement of police service will be made upon receipt of a letter from an alarm company licensed by the City [to the effect] that the alarm system is operating properly and payment of all outstanding service charges. (E) For the purpose of this section, a permit year will extend from October 1 to September 30 of the following calendar year." Section 3. All ordinances or parts of ordinances insofar as they are inconsistent with the provision of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the gounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. -3- Section 7. Quinn eat I I I REFERENCES City Att ear ENCLOSURES 1 Pursuant to City Commission directives discussed during the January 9, and January 23, 1992 Commission Meetings, this office has prepared an amendment to Chapter 3.5 "Alarm Systems" of the Code of the City of Miami. In summary, the modifications provide as follows$ I. Alarm users and/or the owner of the property, wherein an alarm system is maintained without a valid alarm permit, will be charged a penalty of $150.00 for each alarm signal which results in a response by the police to said location. Please note that the amendment as proposed provides that the $150.00 penalty charge is in addition to any service charges assessed under Section 3.5-29 for police responses to excessive false alarm activations. 2. The police will be required to respond to all alarm signals whether or not the alarm user has a valid alarm permit. 3.
