ORDINANCE NO.
AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF
ORDINANCE NO. 10938, AS ADOPTED DECEMBER 5,
1991, THE CAPITAL IMPROVEMENT APPROPRIATIONS
ORDINANCE, BY INCREASING THE TOTAL
APPROPRIATION TO THE CAPITAL PROJECT ENTITLED
"ORANGE BOWL MODERNIZATION - PHASE II",
PROJECT NO. 404238, BY $7,000,000; SAID
AMOUNT TO BE MADE AVAILABLE FROM THE
PROFESSIONAL SPORTS FRANCHISE FACILITY TAX
BONDS PROCEEDS ALLOCATED TO THE ORANGE BOWL
BY METROPOLITAN DADE COUNTY RESOLUTION OF
INTENT NO. R-1515-91, ADOPTED DECEMBER 19,
1991, WITH CASH FLOW TO BE PROVIDED THROUGH A
TEMPORARY LOAN FROM SPECIAL ASSESSMENT LIENS
FUND; CONTAINING A REPEALER PROVISION AND
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10938 on
December 5, 1991, establishing appropriations for the
implementation of Capital Improvements in the City of Miami; and
WHEREAS,
said Ordinance No.
10938,
established
appropriations
for Capital Improvement
Project
No. 404238,
"Orange Bowl Modernization - Phase II"; and
WHEREAS, the Board of County Commissioners of Metropolitan
Dade County adopted Resolution No. R-1515-91 on December 19,
1991, establishing its intention with regard to the allocation of
$7,000,000 from The Professional Sports Franchise Facility Tax
Bonds proceeds to the Orange Bowl; and

WHEREAS, in order to implement the intent expressed by
Resolution No. R-1515-91, the Dade County Commission must to
enact an ordinance appropriating the Professional Sports
Franchise Facility Tax Bonds proceeds in the manner indicated in
said Resolution; and
WHEREAS, due to the urgent need to complete necessary
repairs and improvements at the Orange Bowl by September 15,
1992, cash flow may be provided through a temporary loan from
the Special Assessment Liens Fund, said temporary loan to be
repaid from the bond proceeds of the Professional Sports
Franchise Facility Tax, when such funds become available; and
WHEREAS, the adoption of this amendatory Ordinance is
necessary on an emergency basis to protect the public health,
safety and general welfare and to implement the contractually
contemplated timetables for completion of necessary Orange Bowl
repairs and improvements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance 10938, adopted December 5,
1991, is hereby amended in the following particulars: V
"Section 1. The herein appropriations are hereby
made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvement project scheduled to begin during
fiscal year 1991-92. The herein appropriations which
are hereby designated by reference to descriptive

remaining provisions are now in effect and remain unchanged.

figures are rounded to the nearest hundred dollars.

project and title number also include appropriations of
previously approved scheduled projects as well as re -
appropriations of prior fund appropriations. The
source of revenues to support the herein appropriations
is hereby identified by fund and project with the
project appropriations and revenues therefore being set
forth for seven program areas (I-VII) based upon use or
functional category within said areas, as follows:

Section 2. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 3. All Ordinances or parts of ordinances,
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or work of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety and property of the City of
Miami, and upon the further grounds of the necessity to make the
required and necessary payments to its employees and officers,
payment of its debt, necessary and required purchases of goods
and supplies, and to generally carry on the functions and duties
of municipal affairs.
Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached
Emergency Ordinance which increases the total appropriations to the Capital
Project entitled "Orange Bowl Modernization - Phase II", Project No. 404238,
in the amount of $7,000,000 from The! Professional Sports Franchise Facility
Tax Bonds.
BACKGROUND:
The County Commission adopted Resolution No. R-1515-91 on December 12, 1991,
establishing its intention with regard to the allocation of $7,000,000 from
The Professional Sports Franchise Facility Tax Bonds to the Orange Bowl, in
order to implement the intent expressed by Resolution No. R-1515-91, the Dade
County Commission needs to enact an ordinance appropriating the Professional
Sports Franchise Facility Tax Bonds in the manner indicated in said
Resolution.
Due to the urgent need to complete necessary repairs and improvements at the
Orange Bowl by September 15, 1992, cash flow may be provided through a
