O 9 AN ORDINANCE AMENDING CHAPTER 54 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREET AND SIDEWALKS" BY AMENDING SECTION 54-104 ENTITLED "NONSTANDARD STREET WIDTHS" BY MODIFYING THE WIDTH OF A CERTAIN STREET; ESTABLISHING AN EFFECTIVE DATE; AND CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE. WHEREAS, Article V of Chapter 54 of the Miami City Code establishes base building line locations for all public streets within the City of Miami; and WHEREAS, on April 11, 1991, the City Commission adopted Resolution No. 91-271 approving in principle, the process for retaining the historic Chaille Block Arcades, 401-445 North Miami Avenue, Miami, Florida; and WHEREAS, the City Administration explained that to preserve the Chaille Block Arcades which now encroach the public right of way, the zoned street width of this section of North Miami Avenue would have to be reduced from 60 feet to 50 feet; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 54-104 of the Code of the City of Miami, Florida, as amended, is hereby amended In the following particulars: 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks Indicate omitted and unchanged material. "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES Sec. 54-104. Nonstandard street widths. Base. building lines shall be located from the centerline as specified for each of the following streets: (245) Miami Avenue, North and South, North S+tt 4th Street to the Miami River and South 7th Street to a point 175 feet South of the centerline of S.W. 12th Street........................................30 (245.1) Miami Avenue, North and South, North 4th Street to North 5th Street and Miami River to South 7thStreet..............................................25 Section 2. All Ordinances, or parts of Ordinances Insofar as they are Inconsistent or in conflict with provisions of this Ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. - 2 - Section 4.
