BATES CO., INC., THE SOLE SOURCE PROVIDER FOR THIS SERVICE, AT A PROPOSED COST OF $21,940.00 FOR THE DEPARTMENT OF POLICE; ALLOCATING FUNDS THEREFOR FROM THE LAW ENFORCEMENT TRUST FUND, SUCH EXPENDITURE HAVING BEEN CERTIFIED BY THE CHIEF OF POLICE AS COMPLYING WITH FLORIDA STATE STATUTE 932.7055, AND SUBJECT TO APPLICABLE CITY CODE PROCUREMENT PROCEDURES. WHEREAS, Florida State Statute 932.7055, as amended, authorizes the expenditure of forfeiture proceeds for law enforcement purposes not considered normal operating expenses; and WHEREAS, as the Miami Police Department Community Relations Section sponsors several programs utilizing various publications i which are distributed to different community groups, these publications include anti -drug education, crime prevention, bicycle safety and a host of other related topics; and WHEREAS, the Chief of Police has recommended adoption of this resolution and has determined that the proposed expenditure complies with Florida State Statute 932.7055, as amended; and CITY COMMISSION MEETI33G OF DEC 1 6 1993 Resolution No. 93- 797 WHEREAS, funds to cover the purchase are available in the City of Miami Law Enforcement Trust Fund, Project No. 690001, Index Code No. 290944-722; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a 4/5ths affirmative vote of the members of the City Commission, after a duly advertised public hearing, the requirements for competitive sealed bids are hereby waived and the Department of Police request for the acquisition of Community Relations Publications from Channing L. Bates Co., Inc., the sole source provider for this service, at a proposed total cost of $21,940.00 is hereby approved, with funds therefor hereby allocated from the Law Enforcement Trust Fund, Project No. 690001, Index Code No. 29044-722, such expenditure having been certified by the Chief of Police as complying with Florida State Statute 932.7055, and subject to compliance with applicable City Code procurement provisions. Section 3. The City Manager is hereby authorized to instruct the Chief Procurement Officer to issue a purchase order for this service. Section 4.
