RESOLUTION NO. 9 3 v 783
A RESOLUTION OF THE MIAMI CITY COMMISSION
EXPRESSING ITS OPPOSITION TO THE CONSTRUCTION
OF A NEW ARENA IN THE CITY OF MIAMI AND
APPOINTING A NEGOTIATION TEAM TO NEGOTIATE
WITH ALL INTERESTED PARTIES.
WHEREAS, the City of Miami owns the land upon which the
Miami Arena is located and has leased said land for fifty-two
(52) years to the Miami Sports and Exhibition Authority ("MSEA"),
an autonomous agency of the City of Miami; and
WHEREAS, MSEA is the owner of the Miami Arena and was the
driving governmental force responsible for the development of the
Miami Arena; and
WHEREAS, the Miami Arena is the cornerstone to the
redevelopment of the Overtown/Park West area and has stimulated
economic growth in said area and Downtown Miami; and
WHEREAS, MSEA constructed the Miami Arena and at the time of
construction said Arena was approved by the National Basketball
Association ("NBA") and by the Miami Heat as an acceptable NBA
franchise facility; and
WHEREAS, the Miami Heat has been a valuable tenant of the
Miami Arena for the past five years and has had a beneficial
economic impact on Downtown Miami and the Overtown/Park West

WHEREAS, based upon the amount of annual bookings, the Miami
Arena is one of the most successful arenas in the United States
and has provided the citizens of the City of Miami and South
Florida with numerous entertainment events which were not
available to this community prior to the Arena's existence; and
WHEREAS, the Miami Heat has publicly stated that it is
dissatisfied with the long-term economic opportunities the Miami
Arena presents to the Franchise and has announced its intention
to play in a new arena upon the termination of its lease; and
WHEREAS, the Miami Heat has requested the officials of the
City of Miami and Metropolitan Dade County to approve of and
significantly contribute to the construction of a new arena in
Downtown Miami; and
WHEREAS, the construction of a new arena in the Downtown
area would have an extreme adverse impact on the financial
stability of the Miami Arena; and
WHEREAS, it would be fiscally irresponsible for the City of
Miami to dedicate its financial resources to the construction of
a new arena given the tremendous success the Miami Arena has had
in the last five years and the extreme adverse impact an
additional arena would have on the Miami Arena, and the
Overtown/Park West area; and
WHEREAS, the Commission of the City of Miami believes that
by retrofitting the Miami Arena the long-term economic concerns
raised by the Miami Heat can be reasonably satisfied;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIt1MI, FLORIDA:

Section 1. The recitals and :Findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Commission hereby expresses its
opposition to considering the construction of a new arena for the
Miami Heat until such time the Miami Heat negotiates in good
faith to stay in the Miami Arena and all viable options to retain
the Miami Heat in the Miami Arena after its 10 year term have
been exhausted.
Section 3. A negotiation team is hereby appointed
consisting of a member of the City Commission or its designee,
the City Manager or his designee, and one designee of the Miami
Sports and Exhibition Authority, to negotiate on behalf of the
City of Miami and the Miami Sports and Exhibition Authority with
all interested parties, including but not limited to, the Miami
Heat, Decoma Miami Associates, Ltd., Metropolitan Dade County and
the State of Florida, to retain the Miami Heat in the Miami
Arena. No negotiations involving the construction of a new arena
in the City of Miami shall be conducted by the negotiation team
without prior approval of the City Commission. The negotiation
team shall only seek such approval from the City Commission at
such time the negotiation team is convinced that there are no
viable options for retaining the Miami Heat in the Miami Arena.
The negotiation team shall have exclusive authority to negotiate
on behalf of the City of Miami and shall report back to the City
Commission on any and all final negotiations. All final

negotiations shall be ratified and approved by the City
Commission.
Section 4. This Resolution shall become effective
immediately upon its adoption.

The accompanying Resolution opposing the construction of a new
downtown Arena is being placed on the 16 December 1993 Agenda at
my request.

AMENDMENT TO ITEM 12
* Section 2 as stated below will replace Sections 2 of the
existing resolution.
* Section 3 as stated below will replace Section 3 of the
existing resolution.
Section 2. The City of Miami is opposed to considering the
construction of a new arena for the Miami Heat until such time
the Miami Heat negotiates in good faith to stay in the Miami
Arena and all viable options to retain the Miami Heat in the '
Miami Arena after its 10 year term have been exhausted.
