RESOLUTION NO. 9 3 - 780
A RESOLUTION APPOINTING AN INDIVIDUAL AS A
MEMBER TO THE CITY OF MIAMI GENERAL
EMPLOYEES' AND SANITATION EMPLOYEES'
RETIREMENT TRUST, FOR A TERM AS DESIGNATED
HEREIN.
WHEREAS, as required by the Code of the City of Miami,
Florida, T. Willard Fair resigned as a member of the General.
Employees' and Sanitation Employees' Retirement Trust (the
"Trust") to become a Mayoral oandidate in the 1993 City of Miami
Election; and
WHEREAS, due to said resignation, it is neoessary for the
City Commission to appoint an individual to serve the remainder
of the term vacated by Mr. Fair;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The following individual is hereby appointed
as a member of the General Employees' and Sanitation Employees'
Retirement Trust to serve the remainder of an unexpired term,
said term to end on November 30, 1994:

Subject: Resolution appointing individual to serve on
GESE Retirement Board
Recommendation:
It is respectfully recommended that the City Commission adopt the
attached resolution appointing a new member to the City of Miami
General Employees' and Sanitation Employees' Retirement Board of
Trustees.
Background
City Code Sections 40-226 and 40-227 provide for the appointment of
a nine member board of trustees to administer and manage the
retirement plan known as the "City of Miami General Employees' and
Sanitation Employees' Retirement Trust." Of these nine members, one
is to be selected by the City Manager, two by the general employees
(AFSCME), two by the sanitation employees (SEA) and four
independent trustees selected by the commission from lists
submitted from AFSCME and SEA.
At present one vacancy on the Board exists for an independent
trustee to be selected as described above and the SEA has submitted
the attached list of six persons for the city commission's
consideration.

Enclosed herein please find a copy of R-93-780 which was passed
and adopted by the City of Miami Commission at its meeting held
on December 16, 1993, reappointing you as a member of the Miami
General Employees' and Sanitation Employees' Retirement Trust.
Pursuant to Dade County Ordinance No. 77-13, and the Financial
Disclosure law, Chapter 112.3145, Florida Statutes, as a member
of the GESE Retirement Trust, you will be required to file a
Statement of Financial Interests form with the Dade County
Supervisor, Elections Department. Their address is: Metro Dade
Center, Ill N.W. 1st Street, Suite 1910, Miami, Florida 33128-
1993 (Tel: 375-5553).
Sections 2-305 through 306 of the City of Miami Code require all
elective and appointive officers or employees of the City to
submit to the City Clerk a Statement of Real Property Owned by
him/her, whether the title be either legal or equitable, whether
owned in whole or in part, as well as a Statement of Corporate
Real Property in which he/she has a controlling interest, or is
an officer. Enclosed herein please find a copy of said forms to
fill out. Kindly complete and return them to us at your earliest
convenience.
Pursuant to the requirement under Section 40.225, City of Miami
Code, members of the GESE Retirement Trust are required to take
an oath of office. Please contact Sylvia Lowman at 250-5360 to
make an appointment to take said oath.
Also enclosed is a copy of a memorandum from A. Quinn Jones, III,
City Attorney, dated October 22, 1991, outlining some guidelines
to assist members of City Boards and Committees in complying with
the Government in the Sunshine Law.

Also enclosed, for informational purposes, is another memorandum
from the City Attorney, dated October 22, 1991 on legal
requirements concerning Conflict of Interest and Dual Office
Holding circumstances which may prohibit your membership in said
bodies.
